HomeMy WebLinkAbout5393RESOLUTION NO. 5393 A RESOLUTION APPROVING A MEMORANDUM OF UNDER- STANDING BETWEEN THE CITY OF PUEBLO AND SALT CREEK WATER AND SANITATION DISTRICT AND BLENDE SANITATION DISTRICT AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAME. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1. The Memorandum of Understanding between the City and Salt Creek Water and Sanitation District and Blende Sanitation District attached hereto is hereby approved. SECTION 2. The City Manager is hereby authorized to execute said Memorandum of Understanding on behalf of the City of Pueblo, and the City Clerk is authorized to attest to same. INTRODUCED: May 29, 1984 By PAUL JONES Councilman ATTEST: Ci r Clerk APPROVED: , 1ee4' _� L� r sident o t e City Council May , 1984 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into by the City of Pueblo ( "City "), Blende Sanitation District ( "Blende ") and Salt Creek Water and Sanitation District ( "Salt Creek ") on the date above written, and this supplements the intergovernmental agree- ments heretofore existing between and among these parties. 1. Blende and Salt Creek, if they have not already done so, shall within 60 days of execution hereof, adopt as their rules and regulations, those ordinances adopted by the City and relating to the City's Industrial Pretreatment Requirements. 2. The Industrial Pretreatment Program of the City, as set forth in that document dated June 1983 and entitled "City of Pueblo, Industrial Waste Pretreatment Program" shall be applicable, effective and enforceable within Blende and Salt Creek. 3. The aforementioned Pretreatment Program will be principaly administered by the City with the full cooperation and assistance of Blende and Salt Creek. All fees, charges and penalties assessed against Industrial Users as provided by the Pretreatment Program shall be collected by Blende and Salt Creek in their respective Districts, and remitted to the City. Nothing herein contained shall restrict Salt Creek or Blende from collecting additional fees, charges or penalties to be retained by Blende and Salt Creek. 4. It is expressly understood that at any time the City shall deem it necessary or required, the City may take direct enforcement actions against any Industrial User that is subject to pretreatment requirements in Blende or Salt Creek. Upon written order from the City, Blende and Salt Creek agree to discontinue service, as part of an authorized enforcement action, to any Industrial User subject to pretreatment requirements.
