RESOLUTION NO. 5372
• RESOLUTION APPROVING A LEASE BETWEEN PUEBLO,
• MUNICIPAL CORPORATION AND THE SPANISH PEAKS
MENTAL HEALTH CENTER, INC. AND AUTHORIZING
THE CITY MANAGER TO EXECUTE SAME.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The Lease dated April 23 , 1984 between Pueblo, a
Municipal Corporation and the Spanish Peaks Mental Health Center,
Inc., a copy of which is attached hereto and incorporated herein,
is hereby approved and the City Manager is directed and authorized
to execute same for and on behalf of the City.

L E A S E
THIS LEASE entered into the 23rd day of April, 1984 by
and between Pueblo, a Municipal Corporation (herein "Lessor ")
and the Spanish Peaks Mental Health Center, Inc. (herein "Lessee "),
WITNESSETH:
Lessor hereby leases to Lessee for professional purposes
75 square feet of space, at such location or locations determined
from time to time by Lessor, at the premises owned by Lessor and
located at 130 Central Main, Pueblo, Colorado.
1. The terms of this Lease shall be for a term expiring
April 30, 1985.
2. Lessee shall pay Lessor a yearly rent of $1.00 payable
on the first day of the term of this Lease.
3. Lessee may not sublet the leased premises and shall not
assign this Lease without prior written consent of Lessor.
4. Lessee shall observe proper care of the leased premises,
and all improvements, fixtures and furnishings thereon belonging
to Lessor.
5. Should the leased premises be damaged or destroyed by
fire or other casualty, Lessor or Lessee may terminate this Lease
upon 10 days prior written notice.
6. If Lessee shall fail to pay the rent or perform the
conditions on its part to be performed, Lessor may terminate
this Lease upon 10 days prior written notice.
7. All personal property, fixtures, and equipment owned
by Lessee and located on the leased premises will be removed
from the leased premises by Lessee on or before termination
of this Lease. Lessor assumes no liability relating to such
property and all risk of loss or damage thereto shall be with
the Lessee.

9. As to Lessor, Lessee assumes all liability for any
injury or damage to persons or property while on the leased
premises and Lessee shall indemnify and save harmless Lessor
from all claims, demands, costs and expenses (including
reasonable attorney fees) made against Lessor or incurred or
suffered by Lessor resulting from or arising, directly or
indirectly, out of this Lease, Lessee's performance hereunder,
or acts or omissions of Lessee, its officers, agents or employees.
10. Lessee shall at its cost obtain and keep in force
during the effective term of this Lease workmen's compensation
insurance as required by Colorado law and comprehensive public
liability insurance in amounts not less than $500,000.00 per
occurrence.
11. Notice shall be deemed delivered if mailed by first
class mail, postage prepaid, to:
Lessor, in care of the City Manager, 1 City Hall Place,
Pueblo, Colorado, 81003;
Lessee at 2003 East 4th Street, Pueblo, Colorado, 81001.
12. Either party hereto may cancel and terminate this Lease
or any extension thereof at any time on 90 days advance written
notice.
13. Lessee shall use said space solely to perform mental
health services.
14. This Lease may, at Lessee's option, be extended for
up to four additional one year terms on notice of exercise of
the option being given to Lessor not less than 30 days prior
to the end of any term.
15. This Lease contains the entire agreement between the
parties and shall not be modified in any manner except by an
agreement in writing executed by all parties.
16. This Lease shall be binding upon and inure to the
benefit of Lessor and Lessee and their heirs, personal repre-
sentatives, successors and assigns.
