A RESOLUTION AUTHORIZING THE CITY
SUBDIVISION REVIEW COMMITTEE TO
APPROVE A LOT LINE REARRANGEMENT
FOR LOTS 2 -7, BLOCK 23, UNIVERSTIY
PARK SUBDIVISION ELEVENTH FILING
WHEREAS, the City Subdivision Review Committee has
received a request from Otero Savings and Loan Association
through KLH Engineering Consultants, Inc., to rearrange
the property boundaries for Lots 2 -7, Block 23, University
Park Subdivision, Eleventh Filing; and
WHEREAS, the Subdivision Review Committee pursuant to
Section 12- 4 -5(C) of the 1971 Code of Ordinances is authorized
to approve a rearrangement of property boundaries that does
not involve more than five (5) lots; and
WHEREAS, the City Planning and Zoning Commission reviewed
and approved this request on December 14, 1983; and
WHEREAS, this request will reduce the density from 6
lots to 5 lots to allow for solar access; and
WHEREAS, all other requirements for a rearrangement of
property boundaries have been met by the applicant; and
WHEREAS, Chapter 23, Title 31, Colorado Revised Statutes
encourages Colorado cities and towns to accommodate building
sites for solar access; and
WHEREAS, strict adherence to the lot line rearrangement
ordinance would pose an undue hardship upon this property;
and
WHEREAS, Council finds that the public welfare and interest
of the City and surrounding area of this property would not
be adversely affected.
NOW THEREFORE BE IT RESOLVED BY THE CITY SUBDIVISION
REVIEW COMMITTEE it is hereby authorized and directed to
grant a rearrangement of property boundaries to Otero Savings
and Loan Association for Lots 2 -7, Block 23, University Park
Subdivision, Eleventh Filing.
