RESOLUTION NO. 5 293
A RESOLUTION AUTHORIZING THE ISSUANCE
OF A TEMPORARY CERTIFICATE OF ZONING
COMPLIANCE FOR THE PROPERTY LOCATED
AT 101, 103, 131, 131 1/2, AND 133
SOUTH MAIN STREET
WHEREAS,several parcels of property in downtown Pueblo
are currently undergoing renovation and historic preservation
including the property located at 101, 103, 131, 131 1/2,
and 133 South Main Street which is legally described as
Lots 17, 18, 31, and 32, Block 60, South Pueblo; and
WHEREAS,,Energy Conservation Systems, Inc., (E.C.S.), the
owner and developer of this property, desires to change the
buildings located on this property to residential use; and
WHEREAS,said property is currently located in an I -2
industrial zone district which does not permit residential
use; and
WHEREAS,the proposed residential use is a more restrictive
use than the uses presently permitted in an I -2 zone district;
and
WHEREAS,the property is currently being planned for a
historic preservation zone district which would permit residential
use; and
WHEREAS,the temporary certificate Qf zoning compliance,
requested by E.C.S. to authorize residential use will be com-
patible with surrounding land uses and present development in
the area; and
WHEREASithe Council finds that the strict application of
the zoning ordinance would create an undue hardship and that a
temporary certificate of zoning compliance may be granted without
substantial detriment to the public and without substantially
impairing the intent and purpose of the City Zoning Ordinance.
Now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that:
SECTION 1
The Director of Zoning is hereby authorized and directed
to issue a temporary certificate of zoning compliance to Energy
Conservation Systems, Incorporated, to authorize residential
use for the property located at 101, 103, 131, 131 1/2, and
133 South Main Street, for a period of up to six months from
the date of this Resolution to allow time for this property
to be rezoned pursuant to notice and public hearing into a
historic preservation or residential zone district. Unless
this property is timely rezoned as herein provided, the Zoning
Director's temporary certificate of zoning compliance shall
automatically terminate and be canceled.
SECTION 2
This Resolution shall be effective upon final passage
and approval.
