HomeMy WebLinkAbout5282V f RESOLUTION NO. 5282 A RESOLUTION ACCEPTING A PEDESTRIAN AND BIKE PATH EASEMENT FROM MGIC DEVELOPMENT CORPORATION WHEREAS, MGIC Development Corporation on September 30, 1983, granted to the City of Pueblo, a six (6) foot pedestrian and bike path easement in Eagleridge Subdivision Second Filing; and WHEREAS, this easement is necessary to accommodate pedestrian traffic on land that is not within a publicly dedicated right -of -way but will be used for park purposes. NOW THEREFORE BE IT RESOLVED THAT the City Council hereby approves and accepts the easement granted by NIGIC Development Corporation dated September 30, 1983, which easement is attached hereto and incorporated herein. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the Seal of the City of Pueblo, Colorado, this 21st day of December, 1983. ut�4 e ll, r .: 1 33 r EASEMENT AND RIGHT OF WAY BOOK 2163 PACE-27 THIS EASEMENT, granted this 30th day of September , 1983, by MGIC DEVELOPMEN CORP GRANTOR, to PUEBLO, a Municipal Corporation, GRANTEE: WITNESSETH: THAT IN CONSIDERATION of the sum of One Dollar ($1.00) and other good and valuable consideration, paid by the GRANTEE, receipt of which is hereby acknowledged, GRANTOR hereby grants to GRANTEE, its successors and assigns, a of way for the purpose of Six (6) foot easement and right Pedestrian and Bike Path in, through, over, under and across GRANTEE'S property situated in Pueblo County, Colorado, and described as follows: Three foot on each side of centerline of existing Pedestrian and Bike Path in Lot 1 of Block 201 of Eagleridge, Second Filing. TOGETHER WITH the right to enter upon said property for the purpose of construction, maintenance, control, and repair, and together with the right to use so much of the adjoining property of GRANTOR for said purposes. The GRANTOR reserves the right to use and occupy said property for any purpose consistent with the right and privilege above granted and which will not interfere with or endanger any of the GRANTEE'S equipment or facilities therein or use thereof. Such reservation by the GRANTOR shall in no event include the right to locate or erect or cause to be located or erected any building or any other structure or mobile home trailer unit upon the easement herein granted. "GRANTEE" shall include the plural and the feminine. This easement and right of way shall be binding upon, and shall inure to the benefit of the heirs, personal representatives, successors, IiEC.
