A RESOLUTION ADOPTING DETAILS AND SPECIFICATIONS FOR A
SPECIAL IMPROVEMENT DISTRICT IN PUEBLO, COLORADO, TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 83 -2, AND OR-
DERING PUBLICATION OF NOTICE TO THE OWNERS OF THE PROP-
ERTY TO BE ASSESSED WITH THE COST OF THE IMPROVEMENTS
TO BE CONSTRUCTED OR INSTALLED IN SAID DISTRICT
WHEREAS, by Resolution passed and adopted at a regular meeting of the
City Council of Pueblo, held on the 12th day of September, 1983, an order was made
for the creation of a special improvement district in the City of Pueblo, to be
known as Special Improvement District No. 83 -2, and directing the Director of
Public Works to make the necessary preliminary surveys, estimates and maps as re-
quired by the provisions of the Charter and Chapter 1 of Title 12 of the 1971 Code
of Ordinances of the City of Pueblo; and
WHEREAS, the Director of Public Works, in pursuance of the order in said
Resolution made, has reported to this Council the completion of all matters and
things in said Resolution enjoined upon him in the form and manner as therein
directed, all of said data being now on file in his office in completed form and
substance as by said order and by law required.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
1. Said Director's report, together with the details, specifications,
estimates, maps and schedules prepared and filed in his office, be and the same
are hereby approved and adopted by this Council for use in the construction and in-
stallation of the street improvements and incidentals thereto, to be made in Special
Improvement District No. 83 -2, of the City of Pueblo, Colorado.
2. The materials to be used in constructing the proposed improvements,
the number of installments and time in which the cost of the improvements shall be
payable, the rate of interest to be paid on unpaid and deferred installments, and
the property to be assessed for the same are specifically stated in the form of
notice hereinafter set forth.
3. The attorneys for the City be, and they are hereby authorized and
directed to prepare an ordinance in conformity with, and under the provisions of
the Charter and Chapter 1 of said Title 12 of the 1971 Code of Ordinances, City of
Pueblo, creating within the corporate limits of the City of Pueblo, a local im-
provement district to be known as Special Improvement District No. 83 -2, pro-
viding in and by said ordinance for the construction and installation in said
district of the said street improvements, said resolution for said street improve-
ments set forth and described, and in accordance with the report, plans, maps,
specifications, details and estimate of the Director of Public Works, herein
referred to and now on file in the office of the Director of Public Works.
4. The public hearing on the proposition to create Special Improvement
District No. 83 -2 shall be set for the 10th day of October, 1983, at 7:30 P. '-9.,
in the Council Chambers at City Nall.
5. Notice of the proposed street improvements shall be given by the
Director of Public Works and published once in a daily newspaper of general circu-
lation in said City, therein giving notice to the owners of the property to be
assessed, of the matters and things required by law, which notice shall be in
substantially the following form, to -wit:

KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 83 -2,
AND TO CONSTRUCT IMPROVEMENTS THEREIN'
All owners of real estate and property hereinafter described, and all
persons generally, are hereby notified that the City Council of Pueblo, Colorado,
pursuant to a Resolution heretofore passed and under provision of the Charter and
Chapter 1 of Title 12 of the 1971 Code of Ordinances, City of Pueblo, has adopted
full details, plans and specifications for the construction and installation of
street improvements and appurtenances incidental thereto, in and for a proposed
special improvement district within the corporate limits of the City of Pueblo,
to be known as Special Improvement District No. 83 -2. Said persons are further
notified as follows:
(a) The kind of improvements proposed shall consist of concrete curb
and gutter and sidewalk, and miscellaneous items incidental thereto.
(b) The assessment for said improvements will be due and payable with-
out demand within thirty (30) days from and after the passage of the ordinance
assessing the whole cost of said improvements against the real estate in said
district. In case any owner of real estate shall fail to pay the whole of such
assessment against his property within thirty (30) days after final passage of
the assessing ordinance, then the total assessment so assessed against said own-
er's property shall be payable in ten (10) equal annual installments, the first
of such installments shall be due and payable at such time as may be determined
in and by the assessing ordinance, and the remainder of said installments shall
be due and payable successively on the same day in each year thereafter until all
are paid in full.
(c) The rate of interest to be paid on unpaid and deferred installments
shall be the same as the highest rate of interest on the bonds to be thereafter
determined upon the sale of bonds issued to finance the construction of the im-
provements as prescribed in Sections 12- 1 -4(c) and 12- 1- 4(d)(4) of the 1971 Code
of Ordinances.
(d) An ordinance authorizing the improvements will be considered by the
City Council on October 10, 1983, at 7:30 P.M. in the Council Chambers of City Hall.
(e) All complaints and objections that may be made IN WRITING to the City

Council and filed with the City Clerk concerning the proposed improvements by the
owner or owners of any real estate to be assessed, or any person interested gen-
erally, will be heard and determined by the City Council at a public hearing to be
held in the Council Chambers at City Hall on October 10, 1983, at 7:30 P.M. or at
some adjournment thereof, before final action shall be taken.
(f) As shown by the estimates of the Director of Public Works, the prob-
able total construction cost of this project is $ 26,240.06 , inclusive of the cost
of engineering and inspection, but exclusive of the costs of collection, financing
and other incidentals, as provided by Chapter 1 of Title 12 of the 1971 Code of
Ordinances of the City of Pueblo.
Seventy -five percent (75 %) of the total cost of the improvements, as pro-
vided for by the drawings and specifications for this project, shall be paid by
Pueblo, a Municipal Corporation, in consideration of general benefits conferred
upon the City by such improvements; the remainder of such costs shall be assessed
against property immediately abutting the block to be improved in direct proportion
to the owner's footage within the district.
Property owners are specifically referred to the schedule of proposed
assessments on file in the office of the Director of Public Works, from which the
approximate amount to be assessed against any particular piece or parcel of prop-
erty may be determined.
Upon completion of said improvements, or upon completion from time to
time, and upon acceptance by the Council, or as soon as the total cost thereof is
definitely ascertained, such cost shall be apportioned to the property in the
district. Notice of such apportionment shall be given and a hearing will be held
prior to the adoption of an ordinance assessing such cost, all as provided by
Chapter 1 of said Title 12 of the 1971 Code of Ordinances of the City of Pueblo.
(g) Maps, estimates and schedules showing the approximate amounts to be
assessed, and all resolutions and proceedings are on file and can be seen and
examined by any person interested at the office of the Director of Public Works,
211 East "D" Street (Phone 543 - 2860), at any time during normal business hours
prior to or on the 10th day of October, 1983.
(h) The extent of the district to be improved and the streets with
missing curb and gutter and sidewalk on which such improvements shall be made, the
properties to be assessed and the probable cost per front foot, as shown by the
estimate of the City Engineer are as follows:
