HomeMy WebLinkAbout5223RESOLUTION NO- 5223 A RESOLUTION APPROVING AND ADOPTING FINDINGS AND DETERMINATIONS CONCERNING THE PROPOSED ANNEXATION OF THE TERRITORY COMMONLY KNOWN AND DESCRIBED AS THE 100 BLOCK OF PARK DRIVE WHEREAS, the Pueblo City Council held a public hearing on August 22, 1983, for the purpose of determining and finding whether or not the proposed annexation of the territory described in Resolution No. 5180 meets the require- ments of and complies with the applicable provisions of 8 31 -12 -104 and 105, C.R.S. 1973 (as amended); and WHEREAS, the Pueblo City Council has now considered the testimony and evidence presented including the annexation plat of the territory to be annexed, prepared, and certified under the date of April 29, 1983, by Raymond Koester, Registered Professional Engineer and Land Surveyor. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, that: The City Council hereby finds and determines that a petition has been received for the annexation of the area described below, and that such petition has been signed by persons comprising more than fifty percent of the landowners in the area and owning more than fifty percent of the area, excluding public streets, and alleys, and any land owned by the City of Pueblo. SECTION 2. The City Council hereby finds and determines that the boundaries of the territory to be annexed as described in said annexation plat and Resolution No. 5180 do not divide into separate parts or parcels any land held in identical ownership as restricted and defined in Section 31 -12- 105(2), C.R.S. 1973. SECTION 3 The City Council hereby finds and determines that the territory to be annexed as described in said annexation plat and Resolution No. 5180 does not include land held in identical ownership comprising twenty (20) acres or more which together with the buildings and improvements situated thereon, has an assessed value in excess of $200,000 for ad valorem tax purposes for the year 1982 as defined in Section 31- 13- 105(b), C.R.S. 1973• SECTION 4. The City Council hereby finds and determines that no annexation pro- ceedings have been commenced for annexation to another municipality of part or all of the territory proposed to be annexed to the City of Pueblo. The City Council hereby finds and determines that the proposed annexa- tion meets the requirements of and complies with all applicable provisions of Sections 31 -12 -104 and 105, C.R.S. 1973 (as amended), that a community of interest exists between the area proposed to be annexed and the City of Pueblo, that said area is urban or will be urbanized in the near future, and that said area is integrated with or is capable of being integrated with the City of Pueblo. SECTION 6 The City Council hereby finds and determines that an annexation election under Section 31- 12- 107(2), C.R.S. 1973 (as amended) is not required. SECTION 7 The City Council hereby finds and determines that no additional terms or conditions are to be imposed upon the territory proposed to be annexed. SECTION 8. The City Council hereby finds and determines that not less than 1/6 of the perimeter of the area proposed to be annexed is contiguous with the City of Pueblo. 4FnTTnM Q This Resolution and the findings and determinations herein contained shall become effective immediately upon passage and approval.
