HomeMy WebLinkAbout10876 City Clerk's Office Item # S2 Background Paper for Proposed Ordinance COUNCIL MEETING DATE: December 9, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 724 AND 728 WEST 4TH STREET FROM B-4, CENTRAL BUSINESS ZONE DISTRICT TO S-1, GOVERNMENT USE ZONE DISTRICT SUMMARY: The City of Pueblo is requesting to rezone approximately 21,000 square feet of land at 724 and 728 West 4th Street from B-4, Central Business Zone to S-1, Government Use Zone District. The purpose of the rezoning is to utilize the city-owned building for the operation of services for people experiencing homelessness, including an overnight shelter through cooperative agreements with non-profit organizations. PREVIOUS COUNCIL ACTION: None. BACKGROUND: th The rezone site is a 21,000 square foot parcel generally located south of 4 Street and east of Midtown Circle Drive. The building onsite was built in 1953, and records indicate that a homeless shelter was operating at this property as early as 1989 when the Wayside Cross Gospel Rescue Mission was issued a special use permit to do so. The property was deeded to the City on November 5, 2024. The main purpose of the rezoning to an S-1, Government Use is for the City to cooperate with non-profit organizations to utilize the building for the operation of an overnight homeless shelter and other services for people experiencing homelessness. Currently, the site is zoned as B-4, Central Business Zone District that includes primarily commercial uses and retail building design standards that in many cases would be very challenging to adhere to for the operation of a homeless shelter and other services. Should the parcel be rezoned as S-1, Government Use, the City will have more flexibility with potential future uses, but ultimately must have all proposed new building plans approved by the Planning and Zoning Commission. Generally, land owned and active used by local, state, or federal governments including public schools or special districts is zoned asS-1, Government Use. The S-1 District is intended to retain and provide land areas held, used, or controlled for governmental purposes by or for any department or branch of government. The S-1 District will allow flexibility regarding development and use of the site following the provisions within the FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their November 13, 2024 Regular Meeting, voted 5-0 to recommend approval, Commissioners Castellucci and Aznar absent. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will remain in a B-4, Central Business Zone District and the operation of the homeless shelter will be subject to the requirements of a B-4, Central Business Zone District. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from B-4, Central Business Zone District to S-1, Government Use Zone District: LOTS 18-24 BLK 3 THATCHER + GAST SUB FORMERLY 05-362-05-007, -013, -018, -019 SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council.
