AN ORDINANCE APPROVING AN OPERATING AGREEMENT
BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION AND LIFE CONTINUES, LLC DBA SAFESIDE
RECOVERY FOR THE TEMPORARY OPERATION OF THE
HOMELESS SHELTER AND AUTHORIZING THE MAYOR TO
EXECUTE THE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Operating Agreement between the City of Pueblo, a Colorado Municipal Corporation
and Life Continues, LLC, a foreign limited liability company dba SafeSide Recovery, a copy of
which is attached hereto, having been approved as to form by the City Attorney, is hereby
approved. The Mayor is authorized to execute and deliver the Operating Agreement in the
name of the City and the City Clerk is directed to affix the seal of the City thereto and attest
same.
SECTION 2.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with this Ordinance and the attached Operating Agreement which are necessary or
desirable to effectuate the transactions described therein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
Attached is an Ordinance approving an Operating Agreement between the City of
Pueblo and Life Continues, LLC dba SafeSide Recovery for the temporary operation of
the homeless shelter.
PREVIOUS COUNCIL ACTION:
On October 15, 2024, by Ordinance No. 10819, City Council accepted ownership of

710 W. 4 Street and 728 W. 4 Street from the Pueblo Rescue Mission and approved
a Subrecipient Agreement with the Pueblo Rescue Mission by which Pueblo Rescue

Mission agreed to employ staff and operate a homeless shelter at 728 W. 4 Street and

an emergency shelter at 710 W. 4 Street until December 31, 2024. On October 15,
2024, by Ordinance No. 1018, City Council budgeted and appropriated $200,000 for
Homeless Shelter Operations.
BACKGROUND:
On October 2, 2024, the Pueblo Rescue Mission notified the City and other community
partners of its intention to dissolve and cease operations no later than December 31,
2024. It represented that its available funds will be exhausted in approximately two
months. The Pueblo Rescue Mission is the only full-time homeless shelter in the City of
Pueblo. Closure of the shelter will leave hundreds of unhoused individuals without
shelter during a time of year when the weather is turning substantially colder.
To avoid the dire consequences associated with the immediate closure of the Pueblo

Rescue Mission, the City took ownership of 710 W. 4Street and 728 W. 4Street
The City is currently paying for all utilities, repair and
maintenance for the Shelter. The Pueblo Rescue Mission is continuing to employ staff
and operate the Shelter until December 31, 2024 when it will dissolve. The City is
currently working to stabilize operations of the Shelter until it can find a qualified
contractor to operate it long term. The City will begin the bidding process to find a new
contractor after January 1, 2025.
SafeSide Recovery is currently on-site and provides addiction support and recovery
services to homeless and near homeless individuals in the City of Pueblo. SafeSide
has been assisting the City with the transition of the Shelter to a new provider. The
attached Operating Agreement formalizes the agreement between the parties. As of
January 1, 2025, SafeSide will employee and manage all staff and operate the Shelter.
In return, the City will compensate SafeSide in the monthly amount set forth in the
budget attached to the Operating Agreement as Exhibit A. The City will continue to pay
all utility, repair, and maintenance costs for the Shelter. The term of the Operating
Agreement is January 1, 2025 through March 31, 2025.
FINANCIAL IMPLICATIONS:
The City has budgeted and appropriated $200,000 for the temporary operation of the
Shelter.

Not applicable to this Ordinance.
ALTERNATIVES:
If this Ordinance is not approved, SafeSide will not operate the Shelter from January 1,
2025 through March 31, 2025.
RECOMMENDATION:
Approve the Ordinance.
