SUBJECT: AN ORDINANCE ACCEPTING AN EASEMENT AND RIGHT OF WAY
FROM THE URBAN RENEWAL AUTHORITY, A BODY CORPORATE
AND POLITIC OF THE STATE OF COLORADO, TO THE CITY OF
PUEBLO, A COLORADO MUNICIPAL CORPORATION, FOR THE
PURPOSE OF STORM DRAINAGE AND AUTHORIZING EXECUTION
THEREOF BY THE MAYOR
SUMMARY:
Attached is an Ordinance accepting an easement and right of way from the Urban
Renewal Authority, for the purpose for storm drainage.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
This Ordinance accepts an easement and right of way from the Urban Renewal
Authority.
The design and construction of the storm sewer was placed outside of the existing
easement; therefore, it was determined the best course of action was to change the
easement location to match the location of the storm sewer line.
FINANCIAL IMPLICATIONS:
None

ALTERNATIVES:
Rejection of this agreement will result in the City not being able to complete the
necessary work within the Urban Renewal Authority property.
RECOMMENDATION:
Approval of the Ordinance.

ORDINANCE NO. 10864
AN ORDINANCE ACCEPTING AN EASEMENT AND RIGHT OF
WAY FROM THE URBAN RENEWAL AUTHORITY, A BODY
CORPORATE AND POLITIC OF THE STATE OF COLORADO,
TO THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION, FOR THE PURPOSE OF STORM DRAINAGE
AND AUTHORIZING EXECUTION THEREOF BY THE MAYOR
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Easement and Right of Way, by the Urban Renewal Authority, a Body Corporate
and Politic of the State of Colorado, a copy of which is attached hereto, having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute said Agreement for and on behalf of the City
and the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance and the attached Agreement to implement the policies and procedures
described therein. The City Clerk is directed to cause the Easement Agreement to be recorded
in the office of the Pueblo County Clerk and Recorder in accordance with the terms of the
Memorandum of Agreement.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
