FIBER EXPANSION FOR THE EAST FIRE STATION #6 PROJECT AS AUTHORIZED BY THE AMERICAN RESCUE PLAN ACT AND THE U.S. TREASURY FINAL RULE 31 CFR 35 BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Funds in the amount of $26,562.97 are hereby un-obligated from the two projects in Project CI2113 American Rescue Plan Act listed below: Resolution/ Project Amount Unobligated Ordinance 1 Resolution Pueblo Community College PEAK (Place for $20,959.64 10154 Education and Academic Knowledge) 2 Resolution Teen Nights Fri & Sat with Boys & Girls Club $5,603.33 10470 SECTION 2. Funds in the amount of $26,562,97 are re-obligated to the I.T. Fiber Expansion to the East Fire Station #6 Project. SECTION 3. The officers and staff of the City are authorized to perform all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon final passage. FIBER EXPANSION FOR THE EAST FIRE STATION #6 PROJECT AS AUTHORIZED BY THE AMERICAN RESCUE PLAN ACT AND THE U.S. TREASURY FINAL RULE 31 CFR 35 SUMMARY: This Resolution un-obligates $26,562.97 from two projects in American Rescue Plan Act -obligates those funds to the I.T. Fiber Expansion for the East Fire Station #6 Project as authorized by ARPA and the U.S. Treasury Final Rule CFR 35. PREVIOUS COUNCIL ACTION: By Ordinance No. 9931, approved on May 17, 2021, the City Council established Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which were expected to be distributed to the City from ARPA funds for covered costs and eligible expenses to be incurred during the period which began on March 3, 2021, until December 31, 2024, (to be expended by December 31, 2026). By Resolution No. 154409, City Council approved the allocation of ARPA to the I.T. Fiber Expansion for the East Fire Station #6 Project. BACKGROUND: Between 2021 and 2023, the two projects set forth in the table below were approved by Resolution for the allocation of ARPA funds. Resolution/ Project Amount Ordinance Unobligated 1 Resolution Pueblo Community College PEAK (Place for $20,959.64 10154 Education and Academic Knowledge) 2 Resolution Teen Nights Fri & Sat with Boys & Girls Club $5,603.33 10470 The subrecipient agreements for these two projects have expired, but the projects still have unexpended funds. These funds must be re-obligated by December 31, 2024. The I.T. Fiber Expansion to the East Fire Station #6 Project was funded with ARPA funds and general fund dollars. The monies from the two projects identified above will be transferred to the I.T. Fiber Expansion to the East Fire Station #6 Project to reduce the amount of general fund dollars needed to complete the project. FINANCIAL IMPLICATIONS: Unobligated funds in the total amount of $26,562.97 will be transferred to the I.T. Fiber Expansion to the East Fire Station #6 Project to reduce the amount of general fund dollars needed to complete the project. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to un-obligate and re-obligate the remaining funds from the two ARPA projects listed above.
