HomeMy WebLinkAbout10859ORDINANCE NO. 10859 AN ORDINANCE APPROVING AMENDMENT NO. 1 TO THE REAL ESTATE LEASE AGREEMENT BETWEEN THE PUEBLO RESCUE MISSION AND SAFESIDE RECOVERY FOR THE TH PROPERTY AT 710 WEST 4 STREET SUBSEQUENT TO THE ACQUISITION OF THE PROPERTY BY THE CITY OF PUEBLO AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amendment No. 1 to Real Estate Lease Agreement between the City of Pueblo, a Colorado Municipal Corporation and Life Continues, LLC, a foreign limited liability company dba SafeSide Recovery, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver the lease in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 2. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance and the attached Lease which are necessary or desirable to effectuate the transactions described therein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: On October 23, 2023, by Ordinance No. 10581, City Council approved a Subrecipient Agreement with the Pueblo Rescue Mission by which Pueblo Rescue Mission executed a Promissory Note in favor of the City in the amount of $400,000 for the purchase of the th real property located at 710 W. 4 On October 15, 2024, by Ordinance No. 10819, City Council approved a new Subrecipient Agreement with the Pueblo Rescue Mission by which Pueblo Rescue Mission th transferred the 710 Property back to the City as well as transferred 728 W. 4 Street, Pueblo, Colorado to the City. BACKGROUND: During its ownership, the Pueblo Rescue Mission leased office space in the 710 Property to SafeSide Recovery. The lease expires on September 15, 2025 and the current rent is $450 per month. Amendment No. 1 recognizes the City as the new owner of the property, provides new notice provisions, and clarifies to whom rent payments should be paid. SafeSide Recovery provides addiction support and recovery services to homeless and near homeless individuals in the City of Pueblo. SafeSide is assisting the Citywith the transition of the Rescue Mission and emergency shelter to a new provider. It has provided day programming for residents and assisted with staffing. It volunteered to provide this assistance without compensation. By Amendment No. 1 and in recognition of its assistance and efforts, the City is forgiving its monthly rent from November 1, 2024 through March 31, 2024. FINANCIAL IMPLICATIONS: The lease requires SafeSide to pay base rent to the City in the amount of $450 per month beginning April 1, 2024. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, lease between the Pueblo Rescue Mission and SafeSide Recovery will not be amended. RECOMMENDATION: Approve the Ordinance. ATTACHMENTS: 1.
