HomeMy WebLinkAbout10855ORDINANCE NO. 10855 AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND THE PUEBLO CONSERVANCY DISTRICT, A COLORADO CONSERVANCY DISTRICT, BY WHICH THE PUEBLO CONSERVANCY DISTRICT WILL PAY TO THE CITY OF PUEBLO $75,000 FOR FUNDING OF A PORTION OF THE CITY PARK AND ARKANSAS RIVER CORRIDOR MASTER PLAN PROJECT, AUTHORIZING THE MAYOR TO EXECUTE THE SAME, ACCEPTING THE DISTRICT FUNDS, ESTABLISHING PROJECT NO. CI2456, AND BUDGETING AND APPROPRIATING THE FUNDS TO PROJECT NO. CI2456 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Intergovernmental Agreement, dated November 25, 2024, by which the Pueblo Conservancy District will pay to the City $75,000 to be used for the City Park and Arkansas River Corridor Master Plan Project, attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor of the City is authorized to accept the funds from the Pueblo Conservancy District and to execute said Intergovernmental Agreement on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest the same. SECTION 3. Project No. CI2456 City Park and Arkansas River Corridor Master Plan Project is hereby established, and the amount of $75,000 is budgeted and appropriated. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Intergovernmental Agreement to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. CI2456 SUMMARY: This Ordinance approves and authorizes the Mayor to sign an Intergovernmental Agreement accepting Pueblo Conservancy District funds in the amount of $75,000 to be used to fund, in part, the City Park and Arkansas River Corridor Master Plan Project. PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: In 2017, the City in cooperation with the Pueblo Conservancy District, championed an effort to provide a Master Plan for the 2.75-mile stretch of the Arkansas River Flood Levee adjacent to Historic Downtown Pueblo. The planning process was initiated in response to ongoing work at that time to lower the existing Levee in this area, develop safety features to the popular whitewater course, enhance the murals, and assess the opportunities and challenges of this urban river park. The plan laid out a vision for the th area below 4 Street bridge, which increased community focus on active river recreation, improved connectivity to the river, improved the ecology of the river, and increased economic development opportunities. In early 2024, the City and the Pueblo Conservancy District partnered to solicit the expertise of a third-party consultant to help expand the vision of the Arkansas River Corridor for further development, specifically, from Pueblo Dam to Runyon Lake. On November 11, 2024, City Council approved a Resolution awarding a contract to Confluence, Inc. for design services as part of the City Park and Arkansas River C FINANCIAL IMPLICATIONS: The Plan is expected to cost up to $175,000. Pursuant to the Intergovernmental Agreement, the Pueblo Conservancy District will contribute $75,000 to the project. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: The City Council could decide not to enter into the IGA to accept the $75,000 offered by the Pueblo Conservancy District. The City Park and Arkansas River Corridor Master Plan Project will not be completed without the contribution from the Pueblo Conservancy District. RECOMMENDATION: Approval of the Ordinance.
