A RESOLUTION ACCEPTING AN EASEMENT AND RIGHT OF
WAY FOR THE PORTLAND LIFT STATION FROM RAYMOND J.
DETELLO
WHEREAS, the owner of real property has granted the Easement and Right of Way to
the City of Pueblo; and
WHEREAS, the Easement and Right of Way are required for operation of the Portland
Lift Station; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The Easement and Right of Way granted by Raymond J. Detello, dated October 9, 2024,
a copy of which is attached hereto, having been approved as to form by the City Attorney, is
hereby approved and accepted.
SECTION 2.
Funds for the easement shall be from Sewer User Funds.
SECTION 3.
The City Clerk is directed to cause said Easement and Right of Way to be recorded in
the office of the Pueblo County Clerk and Recorder forthwith.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Resolution to implement the policies and procedures described herein.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

FOR THE PORTLAND LIFT STATION FROM RAYMOND J. DETELLO
SUMMARY:
A Resolution accepting an easement and right of way for a portion of the Portland Lift
Station located on the property.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
The easement and right of way are for a portion of the Portland Lift Station that was
constructed out of the existing right of way onto the property. To correct such record
and clearly establish the use of the area for the purpose of servicing and maintaining
the lift station, the owner has executed the easement and right of way.
FINANCIAL IMPLICATIONS:
The cost associated with the acceptance of the easement and right of way is the sum of
$500.00 payable to the property owner, Raymond J. Detello. Funds are available from
the Sewer User Funds.

Not applicable

None
ALTERNATIVES:
Alternative No. 1 No Action
Under this alternative, the use of the property for the operation of and access to the lift
station will not be clearly established and may be subject to challenge.
RECOMMENDATION:
Approval of the Resolution.
