HomeMy WebLinkAbout15828 City Clerk's Office Item # M6 Background Paper for Proposed Resolution COUNCIL MEETING DATE: November 25, 2024 TO: President Mark Aliff and Members of City Council CC: Mayor Heather Graham VIA: Marisa Stoller, City Clerk FROM: Barb Huber, Fire Chief SUBJECT: A RESOLUTION AMENDING RESOLUTION 11711 AND ESTABLISHING PERMIT, INSPECTION AND PLAN REVIEW FEES REQUIRED UNDER CHAPTER 2 OF TITLE III OF THE PUEBLO MUNICIPAL CODE AND THE 2015 INTERNATIONAL FIRE CODE SUMMARY: This Resolution amends Resolution 11711 and establishes an updated Plan Review Fee International Fire Code as adopted by the City of Pueblo. PREVIOUS COUNCIL ACTION: On September 14, 2009, City Council passed an ordinance amending Chapter 2 of Title III of the Municipal Code relating to the Fire Code, modifying the 2009 International Fire Code, as adopted and amended and establishing permit fees for required operational and construction permits. On September 28, 2009 City Council passed Resolution 11711 which established the Plan Review Fee for reviewing construction plans for compliance with the International Fire Code. Resolution 11711 also set inspection and re-inspection fees required for special inspections for new businesses and sales tax, etc. BACKGROUND: conduct inspections for International Fire Code compliance. FINANCIAL IMPLICATIONS: The financial impact is based on the fees for service for inspections/tasks performed. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: The City Council could decide not to support or fund the permitting needs preventing these new facilities conducting their business operations through electronic means and compromising public safety services and calls for service for our citizens. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: None RESOLUTION NO. 15828 A RESOLUTION AMENDING RESOLUTION 11711 and ESTABLISHING PERMIT, INSPECTION AND PLAN REVIEW FEES REQUIRED UNDER CHAPTER 2 OF TITLE Ill OF THE PUEBLO MUNICIPAL CODE AND THE ADOPTED 2015 INTERNATIONAL FIRE CODE BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO that: SECTION 1. Fees required to be paid pursuant to Chapter 2 of Title Ill of the Pueblo Municipal Code, as amended, or pursuant to the 2015 International Fire Code as adopted and amended by the City of Pueblo, in connection with any construction permit, inspection or re-inspection, or plan review, or which is otherwise required to be paid in accordance with said Chapter or Code, shall be determined and paid in accordance with the following schedule, and are subject to the additional conditions, if any, specified herein: A. Plan Review Fees: Plan review fees shall be collected for reviewing construction plans for compliance with the International Fire Code for all occupancies except R-3, but shall not be charged in addition to any construction permit fee for construction of the types listed above, except where changes have been made to plans and additional review is needed. Plan review fees are: $25 at time of submittal, $50 per hour of fire official review time. C. Inspection Fees: Inspection fees are included in construction permit fees. For other required special inspections (new business, sales tax, etc.) $50 shall be collected at the time of inspection prior to sign-off of City license paperwork. D. Re-inspection Fees: Each return trip re-inspection required due to non-compliance or performance issues shall be assessed a $50 fee per occurrence. E. Conditions and Limitations. 1. Review of plans by the fire official is merely a code compliance review and not a structural or suitability review. Such review shall not relieve the designer, architect, engineer or contractor of responsibility for the structural integrity of the contemplated work or from compliance with all provisions of all applicable building, zoning and land use codes. 2. Construction permits are issued only for work shown or described on approved plans and specifications. The issuance of construction permits under the International Fire Code does not relieve the applicant or permittee from requirements for obtaining any other required building permits or authorizations, and from compliance with all zoning and land use requirements. Concurrent permit fees require concurrent fees. SECTION 2. The officers and staff of the City are authorized to perform all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 3.
