HomeMy WebLinkAbout5081RESOLUTION NO: 5081 A RESOLUTION ESTABLISHING THE PROCEDURES FOR THE CALCULATION OF FEES FOR THE ISSUANCE OF CONSTRUCTION PERMITS. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 As provided by Sections 304(a), 304 (d) (2), and 305 (g) of the Uniform Building Code adopted by Section 4 -2 -1 of the 1971 Code of Ordinances, as amended, applicants for construction permits shall pay the following permit, reinspection, and investigation fees: A. Advance Construction Starts a. The Building Official may issue a preliminary permit to start construc- tion prior to the issuance of a Building Permit, or before the entire plans and specifications for the building or structure have been sub- mitted or approved, provided that adequate information and details have been submitted, which clearly indicate compliance with the per- tinent requirements of the Code. b. These permits shall not be issued until after final zoning approval has been obtained for the new construction and after certification by the Department of Public Works that required public improvements will be made. c. The holder of a permit to start construction prior to the issuance of a Building Permit, may proceed only to the point of construction for which that permit has been qiven, and at his own risk, and without any expressed or implied assurances that changes will not be required in the final design to insure Code compliance. d. Foundation Permit. The Building Official may issue a foundation permit to start the construction of the foundation. e. Removal Permit. The Building Official may issue a removal permit to start the removal of existing construction. f. The permit fee for permits described in this section shall be 10 per cent of the indicated final building permit fee and shall be credited against payment of the final permit fee, except for the basic fee of $5.00 /permit. g. Advance permits for plumbing, HVAC, and electrical work shall be issued under the same guidelines listed above for Building Permits. B. Fees Required Any person desiring to do or cause to be done any work for which a permit is required, shall at the time the permit is issued therefore, pay a fee in the amount fixed by this resolution. Where work for which a permit is required is started prior to ob- taining such permit, the fees may be doubled, as required by the Building Official, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of the Building Code in the exe- cution of the work nor from any other penalties prescribed. However, this double fee shall not apply to any emergency or urgently necessary work if a permit for such work is obtained as provided for. C. Plans Inspection Fee Plans inspection fees shall be assessed according to the following schedule: New one and two family dwellings $25.00 per building -2- New apartment building not over two stories high New residential garages and accessory buildings Additions and alterations to existing one, two, and three family dwellings, apartment buildings not over two stories high, and associated garages and accessory buildings All other new buildings and any additions and alterations to existing buildings $10.00 per dwelling unit $10.00 per building $10.00 per building and $3.00 per garage or accessory $25.00 for the first 1,000 square feet of area, plus $.50 for each additional 100 square feet, or frac- tion thereof; the maximum fee is $1,000 per building Examination of plans by the Regional Building Department is provided as a service and approval by the Department is not to be construed as relieving the architect, engineer, contractor or owner of responsibility for complying with all life - safety provisions of the Code. All such fees shall be credited to the cost of the final building permit. If the project is not built, these fees constitute payment in full for this service. Plan examination fees for plumbing, HVAC and electrical shall be assessed on the same basis as building fees. D. Building Permit Fees - New Buildings and Additions 1. Building permits for new buildings and additions to existing buildings shall be issued to include only the work shown on approved plans and specifications. 2. Building Permit fees for new buildings and additions to existing build- ings shall be based on the calculated value of the project less the cost of Mechanical, Electrical, and Plumbing work. -3- 3. Fees are assessed as follows: For new or modified residences, garages, etc., the following valuation shall be used for computing fees. a. New Residence Wood frame Masonry Basement, finished Basement, unfinished b. Garages Garages Carports, open on two or more sides c. Additions Wood frame Masonry Open patios with roof Family fallout shelters d. Commercial Buildings e. A basic fee for issuance of permit shall be charged in to fees based on valuation Permit fees shall be calculated above by the following: Contract Cost $1,000 to $15,000 $15,001 to $50,000 $50,001 to $100,000 $100,001 to $500,000 $500,001 and up Valuation per square foot $ 17.00 19.00 6.00 5.00 7.00 4.00 12.00 13.00 4.00 No fee Contract price ex- cluding elect., mech., the plbg. addition 5.00 by multiplying the valuation shown -4- Fee $5.00 per $1,000 or fraction thereof $75.00 plus $3.00 for each additional $1,000 or fraction thereof $180.00 plus $2.00 for each additional $1,000 or fraction thereof $280.00 plus $1.50 for each additional $1,000 or fraction thereof $880.00 plus $1.00 for each additional $1,000 or fraction thereof Parking lots or similar non - structure $25.00 per lot or facilities for which separate permits facility are required because the lots or facil- ities are not constructed at the same time as, or under the permits originally issued for the building associated with them, or because they are a separate project. E. Building Permit Fees - alterations 1. Building permits for alterations of existing, multi -story buildings shall require a separate permit for each floor, except that all floors occupied by a single tenant shall require only one permit. 2. Building permits for alterations of existing buildings shall be issued to include only the work shown on the approved plans or specifications. 3. Building permits for alterations to existing structures shall be one- half (2) the fee for new structures shown in D -3 above. F. Building Permit Fees - rehabilitation 1. Building permits for rehabilitation of existing building shall be required whenever any of the following conditions apply: a. The proposed work will not involve any change, rearrangement or modification in the construction or exit facilities, or the movement of any partitions from one location to another. b. Only interior or exterior repair work, or both, is to be done, and the work is due to, and usually involving, one or more of the mechanical or electrical systems. c. The work to be done shall be to restore the building exactly to its original design and shape, and shall involve only the removal and replacement in kind of structural or non - structural members, or -5- both, damaged by factors including, but not limited to, fire, storm, termites or vandalism. 2. Submission of a list of approved specifications indicating the work to be done shall be sufficient to obtain a building permit for rehabili- tation. 3. If changed circumstances cause alteration of a building to be necessary or desirable after rehabilitation work has begun, a building permit for the alteration shall be required in addition to the building permit for rehabilitation already issued. 4. Building permit fees for rehabilitation of existing building shall be assessed as follows, except that the permit fee for rehabilitation of any building condemned by the Building Official shall not be less than $50.00. 5. Permit fees for rehabilitation shall be one -half (2) the fee for new work shown in D -3 above. SECTION II. Plumbing Permit Fees Applicants for permits under the 1979 edition of the Uniform Plumbing Code shall pay permit fees as follows: A. Pre -start permits and Plans examination fees shall be assessed as delineated under Section I. B. For new structures or complete replacement of existing systems: 1. For issuance of each permit 2. For each fixture or trap 3. For each building sewer or mobile park sewer or for each private sewage dis- posal system other than septic tanks $5.00 $2.00 $.05 per lineal foot or a minimum of $5.00 4. For each Septic Tank 5. For each industrial waste pre- treatment interceptor, including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps 6. For each back flow prevention device on a lawn sprinkler system. 7. For vacuum breakers or back flow protective devices in tanks, vats, etc. or for installation on unpro- tected plumbing fixtures including necessary water piping 8. Swimming Pool 9. For each tap into a sanitary sewer or storm sewer SECTION III Mechanical Permit Fees $5.00 $2.00 Commercial $5.00 Residential $2.00 $2.00 $25.00 $5.00 Applicants for permits under the 1979 edition of the Uniform Mechanical Code shall pay fees as follows: A. Fees for Pre -start permits and Plan examinations shall be assessed as delineated under Section I. B. A basic fee shall be assessed as follows: For issuance of each permit $5.00 C. In addition, fees shall be assessed for specific items as follows: 1. For the installation or relocation of each forced -air or gravity -type furnace or burner, including ducts and vents attached to such appliances, up to and including 100,000 B.T.U's 2. For the installation or relocation of each forced -air or gravity -type furnace or burner, including ducts and vents attached to such appliances over 100,000 B.T.U.'s $6.00 $7.50 -7- 3. For the installation or relocation of each $6.00 suspended heater, recessed wall heater, or floor mounted unit heater 4. For the installation, relocation or replace- $4.00 ment of each appliance vent installed and not included in an appliance permit 5. For the repair of, alteration of, or addition $6.00 to each heating appliance, refrigeration unit, cooling unit, absorption unit, or each heating, cooling absorption, or evaporative cooling system, including installation of controls regulated by this Code 6. For the installation, conversion or relocation $6.00 of each boiler or refrigeration compressor to and including three horsepower, or each ab- sorption system to and including 100,000 B.T.U.'s 7. For the installation, conversion or relocation $11.00 of each boiler or refrigeration compressor over three horsepower to and including 15 horsepower, or each absorption system over 100,000 B.T.U.'s to and including 500,000 B.T.U.'s 8. For the installation, conversion or relocation $15.00 of each boiler or refrigeration compressor over 15 horsepower to and including 30 horsepower, or for each absorption system over 500,000 B.T.U.'s to and including 1,000,000 B.T.U.'s 9. For the installation, conversion or relocation $22.50 of each boiler or refrigeration compressor over 30 horsepower to and including 50 horsepower, or for each absorption system over 1,000,000 B.T.U.'s to and including 1,750,000 B.T.U.'s 10. For the installation, conversion or relocation $37.50 of each boiler or refrigeration compressor over 50 horsepower, or each absorption system over 1,750,000 B.T.U.'s 11. For each air handling unit to and including $4.50 10,000 cubic feet per minute including ducts attached thereto NOTE: This fee shall not apply to an air handling unit which is a portion of a fac- tory assembled appliance, cooling unit, evaporative cooler or absorption unit for which a permit is required elsewhere in this Code. we 12. For each air handling unit over 10,000 $15.00 cubic feet per minute 13. For each evaporative cooler other than $4.50 portable type 14. For each ventilation fan connected to a $3.00 single duct 15. For each ventilation system which is not $4.50 a portion of any heating or air condition- ing system authorized by a permit 16. For the installation of each hood which is $4.50 served by mechanical exhaust, including the ducts for such hood 17. For the installation or relocation of each $7.50 domestic type incinerator 18. For the installation or relocation of each $30.00 commercial or industrial type incinerator 19. Replacement of water heater, including gas $6.00 and water installations 20. Ranges, gas oven range /oven combinations, $4.00 laundry ironers or kilns (gas fired) and decorative fireplaces, and replacement of heat exchanges 21. Dryer (including vent) (up to and including $4.00 100,000 B.T.U.'s) 22. Dryer (including vent) $5.00 (over 100,000 B.T.U.'s) 23. Infra -red heater $4.00 24. Roof -top unit - combination H/C up to 3 tons $4.00 Over 3 tons to 15 tons $7.50 Over 15 tons to 30 tons $10.00 Over 30 tons to 50 tons $15.00 Over 50 tons $25.00 25. Cleaning of all types of furnaces $4.00 26. Gas piping up to and including $6.00 two outlets 27. Each additional outlet $2.00 28. Gas piping for outdoor gas appliances $4.00 (up to two units) 29. Each additional outlet $1.00 C. Prefabricated Fireplace, Wood or Coal burning stove fees. The permit fee for a permit to install a non - electric heating device not interconnected or not to be interconnected with central heating systems such as prefabricated fireplaces or wood or coal burning stoves shall be $5.00 This permit shall be subject to regular heating inspection procedures. In- stallations requiring interconnection with central heating systems are covered in A & B above. SECTION IV. Electrical Permit Fees Applicants for permits under the 1981 edition of the National Electrical Code shall pay fees as follows: A. Fees for pre -start and plan inspection shall be assessed as delineated under Section I. B. Residential: (this includes Modular Homes, Mobile Homes and Travel Trailers, also Duplexes and Condominiums) remodeling and additions to (ba Not more than 1,000 sq. ft. Over 1,000 sq. ft and not more than 1,500 sq. Over 1,500 sq. ft and not more than 2,000 sq. Per 100 sq. ft. in excess of 2,000 sq. ft. Construction and extensive sed on enclosed living area) $18.00 ft. $26.00 ft. $32.00 $0.65 -10- C. All Other Buildings All other Fees; except for inspection in mobile homes and travel trailer parks, shall be computed on the dollar value of the electrical installations, including fixtures and installation costs thereof, and such fees shall be as follows: VALUATION OF WORK 1 to $500.00 More than $500.00 but not more than $2,000.00 More than $2,000.00 but not more than $50,000.00 More than $50,000 but not more than $500,000 More than $500,000 Mobile Homes and Travel Trailer Parks, per space SECTION V . Fire Protection System FEE $5.00 $12.00 $12.00 plus $7.00 per $1,000 valuation or fraction thereof in excess of $2,000 $348 plus $6.00 per $1,000 valuation or fraction thereof in excess of $50,000 $3,048 plus $5.00 per $1,000 valuation or fraction thereof in excess of $500,000 $12.00 A. Fire Protection System permits shall be required as follows: 1. Residential a. Exemption: Low voltage systems installed in 1, 2, and 3 family dwellings are exempt from the provisions of this section. b. Only one Fire Protection System permit shall be required for each building of 1, 2, or 3 family dwellings or multi - family buildings. 2. Non - Residential A separate permit is required for each structure. -11- B. The minimum fee for a Fire Protection System permit shall be $5.00 C. Fire Protection permit - fire detection and alarm systems. 1. Fire Protection permits shall be required for fire detection and alarm systems as follows: a. Fire detection and alarm systems include line voltage (over 49 volts) and low voltage (49 volts or less) systems. b. Only a licensed electrical contractor shall be issued a permit to install a line voltage system. c. All line voltage connections of a low voltage system shall be by a licensed electrical contractor, and shall require an electrical permit. 2. Fire Protection permit fees for fire detection and alarm systems shall be assessed according to the following schedule: a. Battery powered automatic household fire warning devices, when used in residential buildings b. Fire detection and alarm systems in all occupancies, outlets, detectors, alarms, horns, audible signaling appliances, loudspeakers, manual fire alarm boxes, or similar devices or fire detection and alarm systems No permit or fees required 0 - 2,000 sf $10.00 2001 - 100,000 sf $10.00 plus .05 per 100 sf over 100,000 sf $60.00 plus .05 per 1,000 sf D. Fire Protection Permit - automatic fire suppression systems 1. Fire Protection permits shall be required for automatic fire suppression systems as follows: a. Construction of accessory on -site water supply and fire pump build- ings or structures shall require separate building permits and fees, in addition to Fire Protection permits and fees. -12- b. On -site water supply piping shall be included in the fire pro- tection system permit issued for the building. c. No permits or fees shall be required for portable fire extinguishers or fire protection systems within residential kitchen range hoods, and ducts. 2. Fire Protection permit fees for automatic fire suppression systems shall be assessed according to the following schedule: a. Standpipe $10.00 each b. On -site water supply piping beyond the $18.00 per building water meter installation c. Installation of new automatic fire sup- $1.00 per sprinkler pression system or alteration of existing head /Maximum fee $750 system E. Where fire suppression systems are included as part of the normal electrical contract, fees shall be calculated as part of that contract.. This section shall apply only where a separate, fire system contractor is retained for performing such work. SECTION VI . Sign Permits All applications for sign permits under the Uniform Sign Code as adopted by the 1971 Code of Ordinance of the City of Pueblo shall pay a minimum permit of $5.00. In addition to the minimum permit fee, flat wall signs shall also be assessed a fee of $1.00 for every 25 square feet of sign surface area or portion thereof; and projecting or free standing signs shall also be assessed a fee of $2.00 for every 25 square feet of sign surface area or portion thereof. SECTION VII. Wrecking, Moving, Sidewalk occupance, and Miscellaneous permits A. Wrecking Permits: each permit for wrecking a structure shall be assessed a fee of $10.00 plus $5.00 per $1,000 of contract price or fraction thereof. -13- B. Moving Permits: 1. The fee for moving structures shall be $10.00 for the first 500 square feet in the structure plus $1.00 for each additional 100 square feet or fraction thereof. 2. Structures 8 feet or less in width and containing less than 1,000 cubic feet do not require a permit. SECTION VIII Other Inspections and Fees A. An inspection fee of thirty dollars ($30.00) is required to inspect a build- ing for the purpose of checking for comp! lance with, or changing of the use group of, an existing commercial building when no work is proposed which would otherwise require a Building Permit. B. In situations which require annual inspections, and building inspection for licensing by the City or County of Pueblo such as nursing homes, rest homes, day care centers, dance halls, hospital facilities, group homes, family homes, foster - homes, schools, head start shcools, and similar buildings, an inspection fee of twenty -five dollars ($25.00) is required. C. Inspections conducted outside of normal business hours at the request of the permittee will be $25.00 per hour with a minimum charge of two hours. D. Reinspection In the event that work covered by any permit or inspection required by the Building Code is initially installed with violations of the Code, thereby requiring one or more reinspections, the Building Official shall assess a fee for each reinspection. This reinspection fee shall equal the original permit or inspection fee but shall not exceed $18.00 for each reinspection required to achieve Code compliance. -14- The Building Inspector may waive the requirement for a reinspection fee if he determines that failure to complete or install the work according to the Code was caused by circumstances beyond the control of the contractor. E. Inspections for which no fee is specifically indicated will be $18.00 per hour. F. Fees for prefabricated assemblies shall be assessed the same fee as for comparable services listed herein. SECTION IX . Certificate of Occupancy Fees A. The final certificate of occupancy fee is included as part of the building permit fee. B. Partial, temporary or preliminary occupancy fees shall be an additional fee as follows: 1. Residential - one, two, and three family $10.00 2. All other buildings, or portions thereof $10.00 that require a separate permit SECTION X . Building Code applicable to the City and County Buildings The Building Code shall be applicable to the buildings owned and occupied by the City and County of Pueblo, its departments and divisions; and the City and County shall comply with all Building Code requirements; provided, however, that the City and County shall be exempt from payment of fees relating to work performed upon City and County owned buildings, structures and sites. Fees which may be exempt in such limited circumstances include those normally assessed for: permits, certificates, inspections and appeals. -15- CErTMM VT Resolution No. 4673 passed and approved on October 27, 1980, Resolution No. 4674 passed and approved on October 27, 1980, Resolution No. 4675 passed and approved on October 27, 1980, Resolution No. 4676 passed and approved on October 27, 1980, are hereby rescinded.
