RESOLUTION NO. 5048
A RESOLUTION RELATING TO THE SALE AND LEASE OF INDUSTRIAL
PROPERTY AT PUEBLO MEMORIAL AIRPORT
WHEREAS, it would be in the best interest of the City to
develop the industrial property at Pueblo Memorial Airport (here-
in "Industrial Property "); and
WHEREAS, the involvement of real estate brokers licensed
by the State of Colorado who do business in Pueblo, Colorado
(herein "Licensed Broker ") would probably result in greater ex-
posure for sale or lease of such Industrial Property; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO COLORADO, that:
SECTION 1.
Upon written request of a Licensed Broker, City will furnish
such Licensed Broker a plot map showing the Industrial Property,
its development, parcels then available for sale or lease, and
the predetermined value thereof upon which a real estate.commission
may be paid as provided in Section 2 hereof. The actual sales
price or rent and terms thereof will be those approved by the
City Council on a parcel -by- parcel transaction basis. Such
written request by a Licensed Broker shall constitute acceptance
of the terms and provisions of this Resolution and authorization
for such Licensed Broker to show the Industrial Property to a
prospective purchaser or lessee.
SECTION 2.
If a Licensed Broker produces a purchaser or lessee who
is ready, willing and able to complete the purchase or lease
of Industrial Property upon terms and conditions for the sale
or lease of such Industrial Property approved by Resolution of
the City Council, and if such sale or lease is consummated through
the Licensed Broker's efforts, the City will pay a commission
to such Licensed Broker equal to three percent (3%) of the
predetermined value of the Industrial Property sold or leased,
or a negotiated commission based upon such predetermined value
if the Industrial Property sold involves more than ten acres,
regardless of the actual sale price or rent; provided, however,
that City will not be obligated to pay any commission until after
the said sale or lease is approved by the Federal Aviation Admini-
stration and a provision to pay the commission and the amount
thereof is included in and made a part of the Sale Agreement
or Lease approved by Resolution of the City Council for the sale
or lease of such Industrial Property to the purchaser or lessee
so produced by said Licensed Broker.
SECTION 3.
Notwithstanding anything in this Resolution to the contrary,
this Resolution is not and shall not be construed to be a listing
or contract to list, either exclusively or nonexclusively, the
Industrial Property for sale or lease with Licensed Brokers,
either individually or jointly, nor shall this Resolution
constitute or be deemed to constitute the employment or
appointment of any Licensed. Broker or any other person as the
City's agent for the sale or lease of its Industrial Property.
