SUBJECT: AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO
SIGN A SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF
PUEBLO, A COLORADO MUNICIPAL CORPORATION AND PUEBLO
CITY-COUNTY HEALTH DEPARTMENT, A DIVISION OF THE STATE
OF COLORADO, AND AUTHORIZING THE PAYMENT OF FIFTY FIVE
THOUSAND DOLLARS ($55,000) FROM FUND NO. 226 - OPIOID
ABATEMENT SETTLEMENT, FOR PURPOSES THEREOF
SUMMARY:
This agreement will distribute $55,000 to the Pueblo Department of Public Health &
Environment (PDPHE) to be used as funding for the implementation of a county-wide
substance use plan and for facilitation of the Substance Use Response Ecosystem
(SURE) program.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
In August 2021, the Colorado Attorney General announced a plan for distributing opioid
settlement funds obtained from a number of settlements with major drug manufacturers
and distributors. Mayor Gradisar chose to opt into receiving these settlement funds, and
to opt out of putting the City of Pueblo's funds into a regional pot for broader use,
electing to take the funds to ensure specific use within the City itself. Approximately
$200,000 was received in Year 1, 2022, and about $100,000 is expected every year for
the next 19 years. This amount could increase as additional settlements take place.
The SURE program was created in November of 2017 as a collective impact modeled
coalition working to ensure everyone in Pueblo County has access to substance use
related knowledge, resources, and supports and feels safe discussing substance use.
In 2022, SURE created a county-wide Substance Use Plan with the help of various
entities including the Office of the Mayor, City Council, the Board of County
Commissioners, the District Attorney's Office, PDPHE, Pueblo Department of Human
Services, Pueblo Police Department, Pueblo County Sheriff's Office, and Pueblo Fire
Department. This plan serves as the guide for community implementation of opioid
settlement funds and other various forms of funding to ensure that collectively as a
community, substance use resources are enhanced and gaps are filled.
FINANCIAL IMPLICATIONS:
Funding received directly from the Opioid Settlement will be used for this project; this
program falls under proper intended use.
BOARD/COMMISSION RECOMMENDATION:
N/A.
STAKEHOLDER PROCESS:
The County-Wide Substance Use Plan invited and took in feedback from all major
action groups in the region in the substance use space as part of its creation. The ideas
were then ranked and prioritized by local elected and appointed officials. The continued
facilitation of this plan by SURE will ensure our local support entities will continue to
coordinate and talk to one another, prevent duplication of efforts, and create a broader
cooperation amongst organizations as it comes to putting the priorities of the Substance
Use Plan into effect.
ALTERNATIVES:
Funding could be diverted elsewhere in keeping with the possible uses for Opioid
Abatement Settlement Funds.
RECOMMENDATION:
Passing of the Ordinance.

THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Subrecipient Agreement (“Agreement”) dated March 27, 2023, between the City of
Pueblo, a Colorado municipal corporation and the Pueblo Department of Public Health &
Environment, a Municipal/County Public Health Agency, a copy of which is attached hereto,
having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute said Agreement for and on behalf of the City
and the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 3.
Funds in the amount of $55,000.00 are hereby authorized to be paid from Fund No. 226
- Opioid Abatement Settlement, for purposes of implementation of the Substance Use
Response Ecosystem (“SURE”) Program.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance and the attached Agreement to implement the policies and procedures
described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.
