A RESOLUTION AUTHORIZING THE ACQUISITION OF CERTAIN
ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY LAND
AND THE INSTITUTION OF CONDEMNATION PROCEEDINGS THERE—
FOR AND RESCINDING RESOLUTION NO. 4938
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO
that:
SECTION 1
The City Council of Pueblo, Colorado hereby finds and determines that
the public use, convenience and necessity require the acquisition of the land
hereinafter described and all structures and appurtenances incident thereto and
the Council does further determine that the public interest will be served by the
acquisition of said properties.
SECTION 2
The City Manager is hereby authorized to take such steps as may be
necessary to acquire, from the Atchison, Topeka and Santa Fe Railway Company,
the following described land:
All that part of the Northeast Quarter (NE /4) of Section 36, Township 20
South, Range 65 West of the 6th principal Meridian, described as follows:
PARCEL NO. 1
All that part of Lots 9 and 10 in Block 11 of State Addition to
the City of Pueblo, Colorado according to the recorded plat thereof,
described as follows:
Beginning at the southwest corner of said Lot 9; Thence North
along the west line of said Lot 9, a distance of 45.40 feet; thence
Southeasterly along a straight line, a distance of 68.04 feet to a
point on the south line of said Lot 10; thence West along the south
lines of said Lots 9 and 10, a distance of 50.83 feet to the point
of beginning;
Containing 1,153.84 square feet of land more or less.
PARCEL NO. 2
All of Lots 3, 4 and 5 and part of Lots 2, 6, 7 and 8 in Block
12 of State Addition to the City of Pueblo, Colorado according to the
recorded plat thereof, described as follows:
Beginning at the northwest corner of said Lot 8; thence East
along the north lines of said Lots 3 thru 8, a distance of 264.0 feet
to the northeast corner of said Lot 3; thence South along the east line
of said Lot 3, a distance of 60.6 feet; thence Southeasterly along a
straight line, a distance of 69.0 feet to a point on the east line of
said Lot 2 that is 6.25 feet north of the southeast corner of said
Lot 2; thence East along a line that is 6.25 feet north of and para-
llel to the south line of said Lot 1, a distance of 44.0 feet to a
point on the east line of said Lot 1; thence South along the east
line of said Lot 1, a distance of 6.25 feet to the southeast corner
of said Lot 1; thence west along the south lines of said Lots 1 thru
6, a distance of 263.0 feet, more or less, to a point that is 100.0
feet southwesterly of and normally distant to the centerline of the
original main track (now taken up) of the Atchison, Topeka and Santa
Fe Railway Company; thence Northwesterly along a straight line that
is 100.0 feet southwesterly of and parallel to said centerline of
original main track (now taken up) of said Railway Company, a distance
of 117.0 feet, more or less, across said Lots 6 thru 8 to a point on
the west line of said Lot 8; thence North along the west line of said
Lot 8, a distance of 51.7 feet, more or less, to the point of beginning;
Containing 30,361 square feet of land, more or less.
PARCEL NO
All of Lots 15 and 16 and part of Lots 11 thru 14 in Block 12, of
State Addition to the City of Pueblo, Colorado according to the recorded
plat thereof, described as follows:
Beginning at the southeast corner of said Lot 16; thence West along
the south lines of said Lots 15 and 16, a distance of 88.0 feet to the
southwest corner of said Lot 15 and a point that is 100.0 feet south-
westerly of and normally distant to the centerline of the original main
track (now taken up) of the Atchison, Topeka and Santa Fe Railway Company;
thence Northwesterly along a straight line that is 100.0 feet southwesterly
of and parallel to said centerline of original main track (now taken up)
of said Railway Company, across said Lots 11 thru 15, a distance of 197.5
feet, more or less, to a point on the north line of said Lot 11; thence
East along the north lines of said Lots 11 thru 16, a distance of 246,0
feet, more or less, to the northeast corner of said Lot 16; thence South
along the east line of said Lot 16, a distance of 120.0 feet to the point
of beginning;
Containing 20,029 square feet of land, more or less.
PARCEL NO. 4
All that part of Lots 6 thru 8 in Block 5 of State Addition to the
City of Pueblo, Colorado according to the recorded plat thereof, described
as follows:
Beginning at the southwest corner of said Lot 6; thence North along
the west line of said Lot 6, a distance of 100.0 feet, more or less to a
point that is 75.0 feet northeasterly of and normally distant to the
centerline of the original main track (now taken up) of The Atchison,
Topeka, and Santa Fe Railway Company; thence Southeasterly along a straight
line that is 75.0 feet northeasterly of and parallel to said centerline of
original main track (now taken up) of said Railway Company across said Lots
6 thru 8, a distance of 165.3 feet, more or less to the southeast corner
of said Lot 8; thence west along the south lines of said Lots 6 thru 8,
a distance of 132.0 feet, more or less, to the point of beginning;
Containing 6,600 square feet of land, more or less.
PARCEL NO. 5
All of Lots 1 and 2 in Block 13 of State Addition to the City of
Pueblo, Colorado according,to the recorded plat thereof, containing 10,560
square feet of land, more or less.
PARCEL NO. 6
All of Lots 15 and 16 in Block 13 of State Addition to the City
of Pueblo, Colorado according to the recorded plat thereof, containing
10,560 square feet of land, more or less.
PARCEL NO. 7
All of Lots 1 and 2 and part of Lots 3 thru 5 in Block 4 of State
Addition to the City of Pueblo, Colorado and also all of the North half
of Block 48 of the original Town now City of Pueblo, Colorado according
to the recorded plats thereof, described as follows:
Beginning at the northeast corner of said Block 48; thence South
along the east line of said Block 48, a distance of 120.0 feet to the
S. E. corner of Lot 1 of Block 48; thence west along the south lines of
said North half of Block 48 and Lots 1 thru 3 in said Block 4, a distance
of 250.0 feet, more or less, to a point that is 100.0 feet southwesterly
of and normally distant to the centerline of the original main track
(now taken up) of The Atchison, Topeka and Santa Fe Railway Company;
thence Northwesterly along a straight line that is 100.0 feet southwest-
erly of and parallel to said centerline of original main track (now taken
up) of said Railway Company across said Lots 3 thru 5, a distance of 125.0
feet, more or less, to a point on the west line of said Lot 5; thence North
along the west line of said Lot 5, a distance of 40.0 feet, more or less,
to the northwest corner of said Lot 5; thence East along the north lines
of said Lots 1 thru 5 in Block 4 and said North Half of Block 48, a distance
of 352.0 feet to the point of beginning;
Containing 37,999 square feet of land, more or less.

All of the South half of Block 48 of the original Town now City of
Pueblo, Colorado according to the recorded plat thereof, plus vacated 10
foot strip of 2nd Street adjacent to said South Half of said Block 48,
containing 15,898 square feet of land, more or less.

All of Lot 9 in Block 4 of State Addition to the City of Pueblo, Colorado,
according to the recorded plat thereof, containing 5,280 square feet of land
more or less.

All that part of Lot 10 in Block 4 of State Addition to the City of Pueblo,
Colorado according to the recorded plat thereof, described as follows:

Beginning at the southeast corner of said Lot 10; thence South along
the south line of said Lot 10, a distance of 52.7 feet, more or less, to the
southwest corner of said Lot 10; thence North along the west line of said
Lot 10, a distance of 7.0 feet, more or less; thence Easterly across said
Lot 10, a distance of 52.9 feet, more or less, to the east line of said Lot
10; thence South along the east line of said Lot 10, a distance of 12.0 feet,
more or less, to the point of beginning;
Containing 502 square feet of land, more or less, also

All of Lots 1 thru 3 and part of Lots 4 thru 6 in Block 14 of State
Addition to the City of Pueblo, Colorado according to the recorded plat
thereof, described as follows:
Beginning at the northeast corner of said Lot 1; thence South along
the east line of said Lot 1, a distance of 120.0 feet to the southeast corner
of said Lot l; thence West along the south lines of said Lots 1 thru 6, a
distance of 264.0 feet to the southwest corner of said Lot 6; thence North
along the west line of said Lot 6, a distance of 20.2 feet, more or less, to
a point that is 100.0 feet northwesterly of and normally distant to the
original centerline of Track No. 13 ( east leg of the wye now relocated) of
The Atchison, Topeka and Santa Fe Railway Company; thence Northeasterly along
a straight line that is 100.0 feet northwesterly of and parallel to said
original centerline of Track No. 13 of said Railway Company and across said
Lots 3 thru 6, a distance of 173.0 feet, more or less, to the north line of
said Lot 3; thence East along the north lines of said Lots 1 thru 3, a
distance of 123.9 feet, more or less, to the point of beginning;

All that part of Lots 9 thru 14 in Block 14 of State Addition to the
City of Pueblo, Colorado according to the recorded plat thereof, described
as follows:
Beginning at a point on the north line of said Lot 14 that is 41.50
feet east of the northwest corner thereof, (for the purpose of this descrip-
tion, the south line of said Block 14 will have an assumed bearing of South
89 55' west); thence South 54 25' 04" west across said Lot 14, a distance
of 50.97 feet to a point on the west line of said Lot 14 that is 29.6 feet
south of the northwest corner thereof; thence South 54 24' 13" West across
said Lots 13, 12, and 11 a distance of 155.63 feet to a point on the South
line of said Lot 11 that is 5.32 feet east of the southwest corner thereof;
thence North 59 51' 09" West a distance of 16.09 feet to a point; thence
North 26 26' 35" West a distance of 124.86 feet to a point on the north
line of said Lot 9 that is 24.00 feet east of the northwest corner thereof;

All that part of Lots 4 and 5 in Block 3 of State Addition to the City
of Pueblo, Colorado according to the recorded plat thereof, described as
follows:
Beginning at the northwest corner of said Lot 5; thence East along the
north lines of said Lot 4 and 5, a distance of 88.0 feet, to the northeast
corner of said Lot 4; thence South along the east line of said Lot 4, a
distance of 40.0 feet, more or less, to a point that is 100.0 feet south-
easterly of and normally distant to the original centerline of Track No. 13
(east leg of the wye, now relocated) of The Atchison, Topeka and Santa Fe
Railway Company; thence Southwesterly along a curved line to the left, having
a radius of 446.44 feet, a length of 99.0 feet more or less, to a point on
the west line of said Lot 5, said curve also being 100.0 feet southeasterly
of and parallel to said original centerline of Track No. 13 of said Railway
Company; thence North along the west line of said Lot 5, a distance of 85.0
feet, more or less, to the point of beginning;
Containing 2,958 square feet of land, more or less.
PARCEL N0. 14
All that part of Lots 9 thru 11 in Block 41 of the original Town now City
of Pueblo, Colorado according to the recorded plat thereof, described as
follows:
Beginning at the southwest corner of said Lot 9; thence North along the
west line of said Lot 9, a distance of 70.72 feet to a point 25.0 feet north-
easterly of and normally distant to the centerline of Track No. 110 (originally
Track No. 26) of The Atchison, Topeka and Santa Fe Railway Company; thence
Southeasterly on an angle of 128 15' to the right of last described course
produced north and along a line that is 25.0 feet northeasterly of and parallel
to said centerline of Track No. 110 (originally Track No. 26) of said Railway
Company, a distance of 80.28 feet; thence Southeasterly on an angle of 1 05'
to the right of last described course produced southeasterly and along a line
that is 25.0 feet northeasterly of and parallel to said centerline of Track
No.110 (originally Track No. 26) of said Railway Company, a distance of 32.71
feet to a point on the south line of said Lot 11; thence West along the
south lines of said Lots 9 thru 11, a distance of 88.26 feet to the point of
beginning;
Containing 3,146 square feet of land, more or less.
PARCEL N0. 15
All that part of Lots 1 thru 7 in Block 42 of the original Town now
City of Pueblo, Colorado according to the recorded plat thereof, described
as follows:
Beginning at a point on the north line of said Lot 7 that is 59.88
feet east of the northwest corner of said Lot 8 and that is 10.0 feet south-
westerly of and normally distant to the centerline of Track No. 13 of The
Atchison, Topeka and Santa Fe Railway Company; thence East along the north
lines of said Lots 4 thru 7, a distance of 113.43 feet to a point that is
25.0 feet northeasterly of and normally distant to the centerline of Track
No. 110 (originally Track No. 26) of said Railway Company; thence Southeast-
erly on an angle of 37 25' to the right of last described course produced
east and along a straight line across said Lots 1 thru 4, that is 25.0 feet
northeasterly of and parallel to the centerline of said Track No. 110 (orig-
inally Track No. 26) of said Railway Company, a distance of 197.49 feet,
more or less, to a point on the south line of said Lot 1; thence West along
the south lines of said Lots 1 thru 3, a distance of 70.21 feet, more or less;
thence Northwesterly on an angle of 33 10' to the right of last described
course produced west, a distance of 93.13 feet, more or less to a point that
is 10.0 feet southwesterly of and normally distant to the centerline of Track
No 13 of said Railway Company; thence continue Northwesterly on an angle of
0 45' to the left of last described course produced Northwesterly, a distance
of 49.45 feet, more or less, to a point that is 10.0 feet southwesterly of
and normally distant to said centerline of Track No. 13 of said Railway
Company; thence continue Northwesterly on an angle of 4 19' to the left of
last described course produced northwesterly, a distance of 91.11 feet, more

PARCEL N0. 16
All that part of Lots 15 and 16 in Block 42 of the original Town now
City of Pueblo, Colorado according to the recorded plat thereof, described
as follows:
Beginning at a point on the east line of said Lot 16 that is 0.37 feet
south of the northeast corner of said Lot 16 and also being 25.0 feet north-
easterly of and normally distant to the centerline of Track No. 110 (origin-
ally Track No. 26) of The Atchison, Topeka and Santa Fe Railway Company; thence
South along the east line of said Lot 16, a distance of 43.78 feet, more or
less, to a point that is 10.0 feet southwesterly of and normally distant to
the centerline of Track No. 110 (originally Track No. 26) of said Railway
Company; thence Northwesterly on an angle of 122 59' to the right of last
described course produced south, a distance of 80.71 feet, more or less, to
a point on the north line of said Lot 15; thence East along the north line
of said Lots 15 and 16, a distance of 67.22 feet, more or less, to a point
that is 25.0 feet northeasterly of and normally distant to the centerline of
said Track No. 110 (originally Track No. 26) of said Railway Company; thence
Southeasterly on an angle of 37 25' to the right of last described course
produced east and along a line that is 25.0 feet northeasterly of and par-
allel to the centerline of said Track No. 110 (originally Track No. 26) of
said Railway Company; a distance of 0.61 feet, more or less, to the point
of beginning;
Containing 1,494 square feet of land, more or less.
PARCEL N0. 17
All of Lot 9 and part of Lots 10 thru 12 in Block 31 of the original
Town now City of Pueblo, Colorado according to the recorded plat thereof,
described as follows:
Beginning at the northwest corner of said Lot 9; thence East along the
north lines of said Lots 9 and 10, a distance of 60.75 feet, more or less,
thence Southeasterly on an angle of 45 20' to the right of last described
course produced east, a distance of 162.6 feet, more or less, to a point on
the northwesterly line of Union Avenue, said point being 100.0 feet north-
easterly of the original centerline of the main track (now taken up) of The
Atchison, Topeka and Santa Fe Railway Company as measured along said north-
westerly line of Union Avenue; thence Southwesterly along the northwesterly
line of Union Avenue, a distance of 6.2 feet, more or less, to a point on
the north line of First Street as conveyed to the City of Pueblo, Colorado
by an Easement from the Atchison, Topeka and Santa Fe Railway Company,
dated March 18, 1965 recorded in the records of Pueblo County; thence West
along the north line of said First Street as conveyed by said Easement, a
distance of 170.6 feet, more or less, to the east line of Court Street and
the west line of said Lot 9; thence North along the west line of said Lot 9,
a distance of 120.0 feet to the point of beginning;
Containing 14,382 square feet of land, more or less.
PARCEL NO. 18
The parcel is a 100 foot wide R.O.W. between Santa Fe Avenue and Pueblo
Junction, being located in Section 31, T -20 -S, R -644, the centerline of which
is more particularly described as follows:
Beginning at a stone located 10 feet north and 20 feet west of the inter-
section of the centerlines of Hobson Street and Santa Fe Avenue; thence due
South along the stone line extended, a distance of 375.14 feet to the center-
line of the Atchison, Topeka and Santa Fe Railway Company R.O.W.; thence
South 52 45' East along said centerline a distance of 87.94 feet to the east
property line of Santa Fe Avenue. Said point being R.R. Station No. 7794 +
82.46, and also being the true point of beginning; thence continuing South
52 45' East, a distance of 574.06 feet to a point of curvature; thence left
along the arc of a curve to the left, said curve having a radius of 2,864.93
feet, a distance of 855.40 feet to the North R.O.W. line of the D. & R.G.W.
Railroad, said point also being the end of the 100 foot wide R.O.W. to be
acquired and being R.R. Station No. 7780 + 53.00. Said parcel of land contains
approximately 142,946 square feet, or 3.2816 Acres.
There is an aggregate of 355,341.84 square feet, more or less of land
contained in Parcels 1 thru 18.
SECTION 3
If the City Manager is unable, after good faith negotiations, to
acquire said properties, then the City Attorney is hereby authorized to institute
such proceedings as may be necessary to take, damage, condemn or appropriate by
right of eminent domain, the above described property.

Resolution No. 4938, passed and approved on March 8, 1982 by the City
Council of Pueblo, Colorado is hereby rescinded.
