HomeMy WebLinkAbout3542RESOLUTION NO. 3542 A RESOLUTIONV ASSUMING CERTAIN RESPONSIBILITIES RELATING TO ENVIRONMENTAL REVIEW PROCEDURES FOR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING THE CITY MANAGER TO ACT FOR AND ON BEHALF OF THE CITY OF PUEBLO WHEREAS, the City of Pueblo did, by Resolution No. 3472 authorize the filing of an application with the United States Department of Housing and Urban Development for Federal Community Development Funds, and WHEREAS, Part 58, Subtitle A, Title 24 of the Code of Federal Regulations authorize a procedure under which applicants may assume for specific projects the environmental review and decision making responsibilities that would apply to the Housing And Urban Development Secretary were he to undertake such projects as Federal projects. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO that: SECTION 1. The City of Pueblo does hereby assume and accept the environmental review and decision making responsibilities that would apply to the Housing and Urban Development Secretary were he to undertake the projects as Federal projects for such projects as have been included within the City of Pueblo's community development program fund application as said application has been approved or may be :subsequently amended. SECTION 2. The City Manager as the Chief Executive Officer of the City of Pueblo is hereby authorized and directed to consent to and assume the status of a responsible Federal Official under NEPA insofar as the provisions of NEPA apply to the .HUD responsibilities for environmental review, decision making and action to be assumed and carried out by the applicant. SECTION 3. That the City Manager as the Chief Executive Officer of the City of Pueblo is authorized to consent personally and on behalf of the City of Pueblo to accept the jurisdiction of the Federal Courts in the enforcement of all responsibilities referred to in Section 58.30(c)(5) of Part 58, Subtitle A of Title 24 of the Code of Federal Regulations.
