A RESOLUTION RELATING TO FIXING OF THE PURCHASE
PRICE, ENDOWMENT AND FEES FOR THE OPENING AND
CLOSING OF LOTS AND OTHER CHARGES IN CITY
CEMETERIES AND RESCINDING RESOLUTIONS NO. 2487,
2723, 2994, 3113 and 3202
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO,
that:
SECTION 1. DEFINITIONS
A. "Adult" shall mean a place of burial for the body
of a person who requires a casket larger than 48 inches in length.
B. "Child" shall mean a place of burial for the body of
a person who requires a casket not larger than 48 inches in length.
SECTION 2. PURCHASE PRICE
A. The purchase price of lots in Mountain View Cemetery
shall be as follows:
(1) Original Cemetery (Non- endowed Section)

SECTION 3. OPENING AND CLOSING FEE
The fee for opening and closing shall be as follows:

SECTION 4. DISINTERMENT
A. The fee for disinterment shall be as follows:
Adult ....................$165.00

B. When disinterments are followed by reinterment in
Mountain View Cemetery, the total charge will be the cost of dis-
interment plus the charges of the new grave, open and close and the
liner unless a vault is to be used.
SECTION 5. SPECIAL ARRANGEMENTS
The fee for services before 8:00 A.M. or after 4:00 P.M.:

SECTION 6. REPURCHASE OF LOTS BY PUEBLO
A. Repurchase of lots in Annex One and Annex Two shall
not exceed the original purchase price.
B. Repurchase of lots in the original Cemetery will be
up to $50.00 or the original purchase price, whichever is greater.
C. All repurchase shall be at the discretion of the
Mountain View Cemetery under the direction of the Director of Parks.
SECTION 7. TITLE TRANSFERS
The fee for title transfers shall be ......... $2.00.
SECTION 8. CERTIFICATE
The certificate of purchase of lots in Mountain View
Cemetery shall be in substantially the following form:

SECTION 14. RECISSION OF PREVIOUS RESOLUTIONS
Resolution No. 2487, passed and approved July 25, 1964;
Resolution No. 2723, passed and approved April 12, 1971, Resolution
No. 2994, passed and approved November 13, 1972; Resolution No.
3113, passed and approved May 14, 1973; and Resolution No. 3202,
passed and approved October 23, 1973, and all other Resolutions
or parts of Resolutions in conflict herewith are hereby rescinded.
SECTION 15.
This Resolution shall become effective immediately upon
approval.

RULES AND REGULATIONS
MOUNTAIN VIEW CEMETERY
AND ANNEXES
I.ADMINISTRATION:
a. The Park Foreman regularly and permanently assigned to the Mountain
View Cemetery and Annex shall be the authorized representative of the
Director of Parks in all matters relating to the administration of laws
and regulations relating to the Cemetery. Such Foreman and other
employees of the City regularly and permanently assigned to work at
the Cemetery under his supervision shall be at the Cemetery and ready to
give information or render assistance to visitors and burial space owners
from 8:00 AM to 4:30 PM, Monday through Friday
b. The Foreman shall have charge of all planting and removal of trees,
shrubs and grass in accordance with the general plan for the
ornamentation of the Cemetery as prepared by the Director of Parks.
Planting of trees and shrubs shall not be permitted on Cemetery grounds
except by Cemetery personnel.
c. The Foreman shall look after and take proper care of the Cemetery and
see that no burial space is used or occupied in violation of the Code
of Ordinances of the City of Pueblo or of any provisions of these
Regulations.
d. All fees and charges collected by the Foreman for duties and services
performed in connection with the Cemetery shall be for the use of the
City or the Mountain View Cemetery Endowment Fund and shall be
immediately turned over by him to the Director of Finance.
e. The Foreman shall supervise the keeping of full and complete records
of the ownership of all burial spaces in the Cemetery, of the burial
capacity of each space, sold or unsold, of the location of each grave,
of the name of the person buried in each grave, and of the date of
burial of each.
f. Chairs, settees, vases, artificial flowers, grave covers, toys or any
other article which has fulfilled its purpose, or is out of harmony
with its surroundings or which for any other reason is objectionable
are not permitted and shall be removed by the Foreman without
responsibility for the disposition thereof. Glass containers of any
type shall not be used for the purp o decoration within the
Cemetery.
g. Flowers and artificial decorations will be permitted in the Cemetery
only in approved vases installed by the Cemetery personnel.
h. During the mowing season (May 15 - November 1) flowers in the approved
containers must be organic or fresh cut, NO ARTIFICIAL FLOWERS OR
DECORATIONS WILL BE PERMITTED, EXCEPT - during the Memorial Day season,
(May 24 - June 15) decorations of any kind may be placed in the vases.
At the termination of the Memorial Day season, June 15th, all non-
conforming decorations will be removed.
i. The decoration period for the Christmas and New Year Holidays will be
from December 1 through February 1. Beginning February 1, all such
decorations shall be removed by Cemetery Personnel.
j. City employees assigned to the Cemetery are not permitted to perform
any work for owners, or monument or ornamental merchants or other
contractors.
k. For the purpose of these Regulations, the following terms, phrases,
words and their derivations shall have the meaning given herein.
When not inconsistent with the context, words used in the present tense
include the future, words in the plural number include the singular
number and words in the singular number include the plural number.
The word "shall" is always mandatory and not merely directory.

(1) "Cemetery" is the Mountain View Cemetery, owned and operated
by the City of Pueblo, Colorado, and includes all annexes
thereto.
(2) "Person" is any person, firm, partnership, association,
corporation, company or organization of any kind.
(3) "Foreman" is the Park Foreman regularly and permanently
assigned to the Cemetery.
(4) "Burial Space" is any cemetery grave intended for interment
of a human body, but not used for such purposes.
(5) "Grave" is any cemetery grave space in which interment has
been made or is immediately about to take place.
(6) "Owner" is any person owning or possessing the privilege,
license or right of interment in any burial space.
II. VISITORS -- GENERAL
a. Visitors are welcome at all times while the Cemetery gates are open.
Visitors shall be orderly, shall not walk in flower beds, graded grave
sites or borders, shall not pluck or remove flowers or plants or break
or injure any tree or shrub or injure or deface any stone, monument,
marker, tablet, vault or memorial or other structure or property in
the Cemetery. Picnicking shall not be permitted in the Cemetery.
Children shall not be permitted to run at will.
b. No person shall enter into or exit from the Cemetery except through
designated entrances or exits.
c. The Cemetery gates shall be open to owners and visitors each day of the
week, including Sundays and holidays, from 8:00 AM to 8:00 PM . No
person other than employees of the City assigned to work in the
Cemetery shall enter or be upon the premises at any other time, except
with express written permission of the City Manager and the Director
of Parks.
d. No person shall place or deposit or throw away any litter, rubish or
garbage within the Cemetery.
e. No person shall carry any weapon or firearm upon the Cemetery; provided
however, this rule shall not prohibit the use of firearms firing blank,
charges or other weapons with dulled blades at military funerals, lodge
funerals and similar occasions.
f. No person shall take or permit any dog, or other household pet upon
the Cemetery.
III. VISITORS -- AUTOMOBILE:
a. No person shall drive a vehicle in the Cemetery at a speed in excess
of twelve (12) miles per hour.
b. No person shall drive a vehicle in the Cemetery except upon streets
expressly designed for such purpose.
IV. BURIALS:
a. No burial of any deceased person shall be permitted until:
(1) A burial permit has been obtained from the Health Department.
(2) The burial space in which burial is to be made has been fully
paid for.
(3) The person arranging for such burial has the right to use the
burial space.
(4) The proper record is made of the name and the age of the
deceased person and the exact location of the grave.

b. Opening and closing of graves shall be under the supervision of the
Foreman.
c. Rates for opening and closing of graves shall be as determined by
resolution of the City Council.
d. Concrete grave liners shall be required for all burials in Mountain
View Cemetery. Vaults and cryptocribs shall be accepted in place
of concrete liners.
e. Concrete grave liners shall be sold by the City at such rates as
shall be determined by Resolution of the City Council.
f. Not more than one deceased person shall be buried in any grave; pro-
vided, however, a deceased infant may be buried with its deceased
mother. For the purpose of this section, the word "infant" is
defined to mean any child under the age of (1) year.
g. No person shall bury upon any burial space the remains of any person
other than a member of the immediate family of the owner of such
burial space unless the written consent of the owner shall first
be filed with the Foreman.
h.
No burial shall be performed before 8:00 AM, or after 4:00 PM
on any week day or at any time on a Sunday or holiday. Exceptions
to this rule may be permitted upon the payment of a special fee as

NOTE: THE HOLIDAYS AS LISTED MAY BE SUBJECT TO CHANGE AT THE DISCRETION
OF THE CITY COUNCIL.
i. In indigent cases where governmental agencies may aid or other social
services assist. °in the burial cost, burials will be permitted as follows
(1) The existing charge for grave liner must be paid before buria
(2) Burial space and open and closing cost must be laid in full
before a monument can be installed.
(3) Credit terms arranged for payment
J. Cremain residue interment will be permitted. Full ceme cost to be
paid and a liner must be used. Cremains must be in an approved
container and shall not exceeU capacity of the liner.
k. B urial spaces at North Side Cemetery to be held in reserve until
Mountain View Cemetery pre -needs have all been sold. Burial spaces
presently owned at North Side Cemetery may be used as nee a at t e
existing rate in effect at Mountain View Cemetery. All requirements
i n efrect at oun ain View Cemetery will apply to the Nortfi Side
The following days shall be considered holidays for the purpose of
this section:

V. BURIALS:
a._ Twenty -four (24) hour notice requirement from the Mortuary will be
enforced. This notification will not include Saturday, Sunday or
Holiday
b. Services for Monday, or after a three day holiday, must be confirmed
by noon of the last regularly scheduled work day.
c. Time of service to be confirmed with the Cemetery before it is
confirmed with the family in order to avoid conflictin services.
d. All sales of graves to be made during regular working hours or
an additional fee of $20.00 will be charged
e. Upon reaching the Cemetery, each funeral cortege shall be supervised
by the Foreman or other City Employee.
f. Automobile motors shall not be permitted to idle or otherwise operate
in the immediate vicinity of any funeral during the service.
g. Funeral services shall not be permitted on Sundays or holidays except
as specified in Section 4.
h. All workmen, whether City employees or others, in the near vicinity
of a funeral, shall suspend their labors and conceal the tools of
their labor and any exposed raw earth or planking until the conclu-
sion of funeral services.
VI. GRADES:
a. In order to achieve proper drainage in harmony with a natural and
pleasing effect, the grade of all burial spaces and other land in the
Cemetery shall be determined by the Foreman. Such grades may be
changed from time to time in the discretion of the Foreman with the
approval of the Director of Parks.
b. After having settled, no grave shall be permitted to rise more than
four inches above the grade established for such lot. Such rises
shall be a gradual slope, without abrupt sides, corners or angles.
VII. MONUMENTS, MEMORIALS, TABLETS, MARKERS, VAULTS AND ORNAMENTATION:
a. Cemetery business shall be conducted during office hours only.
8 am to 4:30 pm weekdays.
b. ALL deliveries to the Cemetery must be reported at the Cemetery
office before they can be set off on the grounds.
c. No stone shall be removed from the Cemetery grounds without the
approval of the Foreman or person in charge.
d. Stones being removed permanently will require the removal of any
foundation material. Vacated areas will be filled and lan
by Cemetery personne
e. Stones being removed and reset, will be done at one -half (�) th
existing foundation charge.
f. No person shall place or construct any stone, monument, marker,
memorial or ornamentation upon awn' burial space until the purchase
price of such burial space shall be paid in full.
g. Any person desiring to place a monument upon any grave or burial
space shall make application therefor to the Foreman upon application
forms provided for that purpose by the City. The application shall
set forth the following information.

(1) The grave(s) or burial space(s) upon which the monument
is to be placed.
(2) The overall dimensions of the monument.
(3) The date upon which it is expected that such monument will
be delivered to the Cemetery and placed upon the grave(s)
or burial space(s) described.
(4) A sketch of the monument showing overall dimensions shall
accompany the application.
(5) Such other information as the Foreman shall deem necessary.
h. Such application shall be filed with the Foreman at least two full
working days before the monument described in the application is
expected to be delivered and placed. The phrase "working day" as
used in this section shall not include Saturday, Sundays or holidays.
i. Foundations shall be constructed by the City and shall be constructed
of concrete. Such concrete shall meet specifications for concrete
promulgated by the Director of Public Works and approved by the City
Council of Pueblo by Resolution No. 1003 approved and adopted on
January 27, 1958 and especially Article 2 thereof.
j. Bases of monuments shall be so squared as to permit a firm rest on
the foundation. Wedges or shims shall not be permitted between a
monument and its foundation.
k. When stones are delivered to the Cemetery for installation, they
are to be placed on blocks that will allow at least two inches (2 ")
of clearance between the base of the monument and the grass. These
blocks will not be provided by the Cemetery
1. No trellis or ornamental iron work of any type will be allowed afte
September 1, 1974.
m. The ornamental iron work that has already been installed shal be
kept in good maintenance and repair and painted by the owner or the
descendants of the owner of the grave upon which such grillwork
is constructed. The Director of Parks is authorized to remove any
ornamental grillwork that was not constructed, maintained, repaired
or painted as required in this section, and the City and its officers,
agents and employees shall not be responsible to the owner or the
descendents of such owner for the disposition thereof.
n. Work upon or in the preparation for any monument or other ornamental
work shall not be permitted on Sundays or holidays. No material shall
be admitted to the Cemetery on Saturdays or the day preceding any
holiday.
o. Persons installing any monument work shall not be petmitted to attach
ropes or cables to other monuments or to trees.
p. Persons engaged in erecting any monument shall use due haste in
completing their work, and shall leave the area clean and ready for use.
q. No vases shall be installed in front or back of markers, monuments or
stones.
r. In B locks 7,8,9,10 & 12 no monument with a height of more than (18 ")
eighteen inches can be installed. In all other sections of the
Cemetery, there is no restriction as to height.
s. All monuments, markers, stones, vases and etc., must comply with
Cemetery standards before they will be approved for installation
within the Cemetery
VIII. GRAVE SPACE AND MONUMENT SIZES:
The following sizes are the dimensions of both the grave spaces and
the monuments that may be placed on them and are established as a
