A RESOLUTION AUTHORIZING THE CITY COUNCIL TO ENTER INTO A LEASE WITH THE PUEBLO METROPOLITAN MUSEUM ASSOCIATION WHEREBY THE CITY OF PUEBLO WILL LEASE AND MAINTAIN AS A PARK THE GROUNDS SURROUNDING THE METROPOLITAN MUSEUM OF PUEBLO, FORMERLY KNOWN AS THE RAYMOND THATCHER HOUSE, AU- THORIZING THE PRESIDENT OF THE CITY COUNCIL TO EXECUTE SAID LEASE, AND AUTHORIZING A TRANSFER OF FUNDS FOR SAID PURPOSE BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, A certain Lease dated the 24th day of March, 1969, a copy of which is attached hereto and made a part hereof by refer- ence after having been approved as to form by the City Attorney, by and between the Metropolitan Museum of Pueblo and Pueblo, a Municipal Corporation, whereby the City of Pueblo agrees to main- tain as a park the grounds surrounding the Metropolitan Museum of Pueblo, formerly known as the Raymond Thatcher House, be and the same is hereby approved. SECTION 2. The President of the Council is hereby authorized to execute said Lease on behalf of the City of Pueblo, a Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the same. SECTION 3. The Director of Finance is hereby authorized to make the following transfer of funds: FROM IC- 31.1 -- Contingent Account............ $3,500 ATTEST: r / City Clerk 3/20/69 PA -2 -1 -- Personal Services ............. $2,500 PA- 2 -40 -- Capitol Outlay ............... $1,000 INTRODUCED _ -� "� '4 , 1969 BY JOHN BALLAS Councilman APPROVED: P resident of the ouncil LEASE This contract entered into this 24th day of March, 1969, by and between PUEBLO, a Municipal Corporation, of the State of Colorado, hereinafter referred to as the City, and the PUEBLO METROPOLITAN MUSEUM ASSOCIATION, hereinafter referred to as the Association, WITNESSETH: For and in consideration of the following the parties agree as follows: 1. The Association leases to the City the grass and grounds for the block of property commonly known as the Metropo- litan Museum Association of Pueblo, formerly known as the Raymond Thatcher House, located at 419 W. 19th Street, Pueblo, Colorado, exclusive of the improvements thereon for a period of five years. 2. The City shall maintain said grass and grounds for said period and said maintenance shall be under the supervision of the Pueblo Parks Department Director. 3. That said lease shall continue from periods of not less than five years, until cancelled by either or both parties on one year's notice in writing. 4. That this lease and agreement shall be subserviant to any other agreement now existant, between said parties except- ing as to the grass and grounds specifically mentioned herein in which sole matter this lease shall take precedence. 5. The cost of said maintenance of said grass and grounds only shall be borne by the City. 6. The City shall not be liable in any way for any oc- currence whatsoever relating to said grass and grounds, excepting any matters arising out of its exclusive maintenance and the Association agrees to indemnify the City, its agents, employees or representatives, and save them harmless from and against any claims or Court actions arising directly or indirectly out of acts of the Association and /or its employees, or officers, or agents. Said indemnification to include attorneys fees. IN WITNESS THEREOF, the parties hereto have caused the same to be signed by their properly designated officers, the date and year above stated. BY �-✓ T E ,6, APPROVED AS TO FORM: City Attorney - 2 - City of Pueblo MEMORANDUM TO: Fred Weisbrod, City Manager FROM: George Williams, Director of Parks & Recreation SUBJECT: FINDINGS AT THE NEW MUSEUM GROUNDS DATE: November 27, 1968 I have been over these grounds with my maintenance men and with the groundskeeper, who was formerly employed by the late Raymond Thatcher since 1960, and presently by the Museum Association. The walkways around the entire block are in bad order, and the concrete walkways around the exterior part of the building are also in bad order due to breakage and unevenness. I find that there are six water meters; each serving a small portion of the ground. One meter is serving the building. I am advised by Mr. Dewey Fullenwider, who is the groundskeeper, that the lawn was last fertilized in 1960. The hydrants and other water mains have been neglected. The shrubs and many trees are badly in need of care. The equipment that has been used is antique, and it is not feasible to repair it. This ground site should have one (1) Lawn King Mower.... Estimate..$500.00; one (1) 18" Rotary Trimmer Mower.... Estimate ..$250.00; Small tools and water hose..$250.00..Estimated Total..$1,000.00. .An illustration of the need for tools is that the groundskeeper brings his own rake to rake the leaves. The groundskeeper further advises me that he has kept busy six and sometimes seven days per week in caring for the grounds with some help from the former chauffeur, Mr. Ted Schnack. Looking at the surface, it will require one full -time man, who is qualified to take care of lawns, shrubs and flowers. It will also re- quire some part -time help in the early summer months ... I would estimate approximately three months of part -time employment. A park caretaker's salary is $395.00 per month at the beginning rate, and approximately $325.00 per month for a laborer on a part -time basis. Until we get further into the program, it is impossible to determine the present condition of the water lines; however, I am advised by the groundskeeper that some of the 1" water lines that they have the occasion to dig in the last year, have had openings approximately the size of your finger. This means that they have served for many, many years.
