HomeMy WebLinkAbout01236RESOLUTION NO. 1236 A RESOLUTION ADOPTING RULES AND REGULATIONS FOR THE MANAGEMENT AND CONTROL OF MOUNTAIN VIE'; CME TERY BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: SECTION 1 In compliance with Sections 18 -5 and 18 -17 of the Code of Ordinances, City of Pueblo, the Rules and Regulations for Mountain View Cemetery and Annexes, a copy of which is attached hereto and made a part hereof by reference, is hereby made, adopted and promulgated. The Park Foreman regularly and permanently assigned to the Mountain View Cemetery and Annex shall be the authorized representative of the Director of Parks in all matters relating to the administration of laws and regula- tions relating to the Cemetery. Such Foreman and other employees of the City regularly and permanently assigned to work at the Cemetery under his supervision shall be at the Cemetery and ready to give information or render assistance to visitors and burial space owners from 5:00 A. M. to 500 P. M., on each day of the week, including Sundays and holidays. b. The Foreman shall have charge of the planting and removal of grass, trees and shrubs in accordance with the general plan for the ornamenta- tion of the Cemetery prepared by the Director of Parks. Such plan may be changed from time to time at the discretion of the Director of Parks with the approval of the City Manager. c. The Foreman shall look after and take proper care of the Cemetery and see that no burial space is used or occupied in violation of the Code of Ordinances of the City of Pueblo or of any provision of these P.- gulations. d. All fees and charges collected by the Foreman for duties and services performed in connection with the Cemetery shall be for the use of the City or the Mountain View Cementery Endowment Fund and shall be immedi- ately turned over by him to the Director of Finance. e. The Foreman shall keep full and complete records of the ownership of all burial spaces in the Cemetery, of the burial capacity of each space, sold and unsold, of the location of each grave, of the name of the person buried in each grave, and of the date of burial of each. f. Chairs, settees, vases, jars, artificial flowers, grave covers, toys and any article which has fulfilled its purpose, or is out of harmony with its surroundings or which for any other reason is objectionable are not permitted and shall be promptly removed by the Foreman without responsibility for the disposition thereof. - 2 - g. City employees assigned to the Cemetery are not permitted to perform any work for owners, or monument or ornamental merchants or contractors. h. For the purposes of these Regulations, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent wi;:h the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory. (1) "Cemetery" is the Mountain View Cemetery owned and operated by the City of Pueblo, Colorado, and includes all annexes thereto. (2) "Person" is any person, firm, partnership, association, corpora- tion, company or organization of any kind. (3) "Foreman" is the park forman regularly and permanently assigned to the Cemetery. (4) "Burial Space" is any cemetery lot intended for interment of a human body, but not used for such purpose. (5) "Grave" is any cemetery lot in which interment has been made or is immediately about to take place. (6) "Owner" is any person owning or possessing the privilege, license or right of interment in any burial space. 2. VISITORS -- GENERAL a. Visitors are welcome at all times while the Cemetery gates are open. Visitors shall be orderly, shall not walk on flower beds, graded grave sites or borders, shall not pluck or remove flowers or plants or break or injure any tree or shrub or injure or deface any stone, monument, marker, tablet, vault or memorial or other structure or property in the Cemetery. Picnicking shall not be permitted in the Cemetery. Children shd'll not be permitted to run at will. b. No person shall enter into or exit from the Cemetery except through designated entrances and exits. c. The Cemetery gates shall be open to owners and visitors each day of the week, including Sunday and Holidays, from 8 :00 A. M. to 5:;O0 P. M.. No person other than employees of the City assigned to work in such - 3 - Cemetery shall enter or be upon the premises at any other time, except with express written permission of the City Manager and the Director of Parks. d. No person shall place or deposit or throw away any litter, rubbish or garbage within the Cemetery. e. No person shall carry any weapon or firearm upon the Cemetery; provided, however, this rule sh.a'? not prohibit the use of firearms firing blank charges or other weapons with dulled blades at military funerals, lodge funerals and similar occasions. f. No person shall take or permit any dog, or other household pet upon the Cemetery. 3. VISITO -- AUTOMOBILE a. No person shall drive a vehicle in any Cemetery at a speed in excess of twelve (12) miles per hour. b. No person shall drive a vehicle in any Cemetery except upon lanes and paths expressly designated for such purpose. 4. BURIALS: a. No burial of any deceased person shall be permitted until: (1) A burial permit has been obtained from the Health Department. (2) The burial space in which burial is to be made has been fully paid for. (3) The person arranging for such burial has the right to use such burial space. (4) The proper record is made of the name and age of the deceased person and the exact location of the grave. b. Opening and closing of graves shall be under the supervision of the Foreman. c. Rates for opening and c1csing of graves shall be as determined by resolution of the City Council. d. Concrete grave liners shall be required for all burials in Cemetery Annex 1 and Annex 2, except Block 11. Concrete grave liners may be used in all other portions of the Cemetery but are not required. - 4 - e. Concrete grave liners shall be sold by the City at such rates as shall be determined by Resolution of the City Council. f. Not more than one deceased person shall be buried in any grave; pro- vided, however, a deceased infant may be buried with its deceased mother. For the purpose of this section, the word "infant" is defined to mean any child under the age of one (1) year. g. No person shall bury upon any burial space the remains of any person other than a member of the immediate family of the owner of such burial space unless the written consent of the owner shall first be filed with the Foreman. h. No burial shall be performed before 8 :00 A. M., or after r vcC© P. X.s on any week day or at any time on a Sunday or holiday. The following days shall be considered holidays for the purpose of this Section: January 1 May 30 July 4 First Monday in September November 11 Fourth Thursday in November December 25 (New Year Day) (Memorial Day) (Independence Day) (Labor Day) (Veteran *s Day) (Thanksgiving Day) (Christmas Day) Exceptions to this rule may be permitted upon the payment of a special fee as determined by Resolution of the City Council. 5. FUNERALS: a. Upon reaching the Cemetery, each funeral cortege shall be supervised by the Foreman or other City employee. b. Automobile motors shall not be permitted to idle or otherwise operate in the immediate vicinity of any funeral during the service. C. Funeral services shall not be permitted on Sundays or holidays except as specified in Section 4.0) above. d. All workmen, whether City employees or others, in the near vicinity of a funeral, shall suspend their labors and conceal the tools of their labor and any exposed raw earth or planking until the conclu- sion of funeral services. 6. GRADES: - 5 - a. In order to achieve proper drainage in harmony with a natural and pleasing effect, the grade of all burial spaces and other land in the Cemetery shall be determined by the Foreman. Such grades may be changed from time to time in the discretion of the Foreman with the ar rc�ral of the Director of Parks. b. After having settled, no grave shall be permitted to rise more than four inches above the grade established for such lot. Such rise shall be a gradual slope, without abrupt sides, corners or angles. 7. MONUMENTS, MEMORIALS, TABLETS, MARKERS, VAULTS, AND ORNAMENTATION (MONUMENTS) a. No person shall place or construct any stone, monument, marker, memorial or ornamentation upon any burial space until the purchase price of such burial space shall be paid in full. b. Any person desiring to place a monument upon any grave or burial space shall make application therefor to the Foreman upon application forms provided for that purpose by the City. The application shall set forth the following information: (1) The grave(s) or burial space(s) upon which such monument is to be placed. (2) The overall dimensions of the monument. (3) The date upon which it is expected that such monument- will be delivered to the Cemetery and placed upon the grave(&) or burial space(s) described. (4) A sketch of the monument showing overall dimensions shall accompany the application (5) Such other information as the Foreman shall deem necessary. Such application shall be filed with the Foreman at least two full working days before the monument described in the application is expected to be delivered and placed. The phrase "working day" as used in this section shall not include Saturdays, Sundays or holidays. c. Foundations shall be constructed by the City and shall be constructed cf concrete. Such concrete shall meet specifications for concrete promulgated by the Director of Public Works and approved by the City - 6 - Council of Pueblo by Resolution No. 1003 approved and adopted January 27, 1958, and especially Article 2 thereof. Foundations shall be laid to at least the depth of the grave. d. Monuments shall be constructed, placed or removed under the supervision of the Foreman. e. Bases of monuments shall be so squared as to permit a firm rest on the foundation. Wedges or shims shall not be permitted between a monument and its foundation. f. Planks shall be provided for dumping, rolling and skidding stone work on paths, gutters and lawns. g. No person shall construct or permit the construction of ornamental iron or steel grille work with component parts having a thickness of less than one - fourth ( *) inch upon any grave site in any city - owned and operated Cemetery. Ornamental grillwork shall be kept in good maintenance and repair and painted by the owner or the descend- ants of the owner of the lot upon which such grillwork is constructed. The Director of Parks is authorized to remove any ornamental grill- work not constructed, maintained, repaired or painted as required in this section, and the City and its officers, agents and employees shall not be responsible to the owner or the descendants of such owner for the disposition thereof. h. Work upon or in the preparation for any monument or other ornamental work shall not be permitted on Sundays or holidays. No material shall be admitted to the Cemetery on Saturdays or the day preceding any holiday. i. Persons engaged in creating any monument or ornamental work shall not be permitted to attach ropes or cables to other monuments or to trees. J. Persons engaged in erecting any monument or ornamental work shall use due haste in completion of their work, and shall leave the area clean and ready for use.
