A RESOLUTION CALLING AN ELECTION ON A PROPOSED HEALTH AMENDMENT
TO THE CITY CHARTER
T�JHEREAS, it appears advisable to revise the Health Provisions of the Charter
of the City of Pueblo to empower the Council to consolidate by agreement any or
all health functions with the County of Pueblo and with other political subdivisions
within the County of Pueblo; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF PUEBLO:
Section 1. The following amendment, designated Amendment No. I, amending
Article IV Section 4 of the City Charter, be placed on the ballot of the General
Municipal Election of Pueblo, a Municipal Corporation, to be held November 6, 1951, so
that said proposed amendment may be voted upon by the qualified electors of Pueblo as
provided for by the Constitution and Laws of the State of Colorado, and the provisions
of the Charter of Pueblo, a Municipal Corporation.
Section 2. The proposed amendment shall be put on the ballot for said election
in substantially this form:
"Shall Amendment No. I, providing for the revision of the
Health provisions of the Charter of the City of Pueblo,
allowing the Council of the City of Pueblo to enter into
agreement with the County of Pueblo and with the governing
bodies of other political subdivisions within Pueblo County,
Colorado, for a mutual public health program, consolidation
or merger, in part or in whole, establishing a Board of
Health, and providing for Civil Service, be adopted ?"
Space shall be provided on the ballot for a "Yes" or "No" vote thereon in the
usual form.

AN ACT ENTITLED tt AN k1ENDNiENT TO AMEND SECTION 1,. OF
ARTICLE IV OF THE CHARTER OF THE CITY OF PUEBLO, COLO-
RADO, ALLOWING THE COUNCIL OF THE CITY OF PUEBLO TO
ENTER INTO AGREEMENTS WITH THE COUNTY OF PUEBLO AND
WITH THE GOVERNING BODIES OF OTHER POLITICAL SUBDIVI-
SIONS WITHIN PUEBLO COUNTY FOR A MUTUAL PUBLIC HEALTH
PROGRAM, CONSOLIDATION OR MERGER, IN PART OR IN WHOLE,
ESTABLISHING A BOARD OF HEALTH, AND PROVIDING FOR
CIVIL SERVICE"
BE IT ENACTED by the qualified electors of the City of Pueblo that Section 4
of Article IV of the Charter of said City of Pueblo.. Colorado, be and the same is
hereby amended to read as follows, to wit:
HEALTH - The City Council shall have and exercise all powers and shall make
all ordinances and regulations which may be necessary and expedient for the preser-
vation of the public health and the suppression of disease, and may establish and
maintain a Health Department with a Board. of Health, a Health Officer and such
other personnel as deemed necessary. The City Council may by ordinance enter into
agreement with the governing body of the County of Pueblo and with the governing
bodies of other political subdivisions within the County of Pueblo for a mutual
public health program, and consolidation or merger of any and all public health
functions now or which may hereafter be assumed, which agreement may run indefin-
itely provided that the City Council may give 4 monthts notice to each party to
such agreement of intention to terminate the agreement at the end of any fiscal
year. The Board of Health shall be composed of five members: one member appointed
by the City Council, one member appointed by the governing board of the County of
Pueblo during the term of any such agreement with same, and others broadly inter-
ested in public health as governed by ordinance or agreement. The Board of Health
shall meet regularly at least once each month, and shall advise the Health Officer,
the City Council, and the governing bodies of other participating political sub-
divisions, if any, on all matters of public health.
The civil service provisions of the charter shall apply to all persons cur-
rently employed, or employed thereafter, under such agreement; provided that,
all personnel continued in the same or other positions at the request of the
governing body of Pueblo County and other participating political subdivisions
may be granted civil service status at the date of the agreement, or within six
months thereafter. The Health Officer shall not be subject to civil service.
All provisions of the Charter of Pueblo inconsistent with this amendment
are hereby repealed, insofar as said provisions are inconsistent herewith, and in
all other respects said provisions shall remain in full force and effect.
