BE IT RESOLVED BY THE COUNCIL OF PUEBLO:
That a warrant be drawn in the sum of
$750,00 in favor of the Fountain Sand & Gravel
Company in full settlement of their claim filed
against the City of Pueblo for dwnageq to their
property, described in said claim, on account of
damages caused thereto by the construction and
maintenance of the East Eighth Street Bridge, Viaduct
and Approaches.

A S S I G N M E N T.
KNOW ALL 14EN BY THESE PRESENTS:
That the undersigned, THE COLORADO AND SOUTH &RN RAILWAY
CORM_ ANY, a corporation of the State of Colorado, for and in con-
sideration of the sun of One Dollar, and other good and valuable
considerations, in hand paid to it by THE FOUNTAIN SAND AND GRAV-
EL COM2ANY, likewise a corporation of the State of Colorado, re-
ceipt whereof is hereby acknowledged by said undersigned, does
hereby transfer, set over and assign unto said The Fountain Sand
and Gravel Company any and all rights, claims, demands, actions
or causes of action which it has or could assert against PUEBLO,
a city of the first class situate in Pueblo County, Colorado, on
account of damages arising from the construction and existence
of the East Eighth Street Bridge and Viaduct in said City of
Pueblo, to the following described real estate situate in the
County of Pueblo and State of Colorado, and which has been con-
veyed by the undersigned to said The Fountain Sand and Gravel
Company, to -wit:-
Lots Two (2), Three (3), Twenty (20) and Twenty -one
(21), in Block Two (2); Lots Five (5), Six (6) and Seven-
teen (17), in Block Three (3); Lots Eight (8), Nine (9)
and Fourteen (14), in Block Four (4), all in the Fountain
Addition to the City of Pueblo, according to the recorded
plat of said addition.
Also the follow_ng described tract of land situate in said
County of Pueblo and State of Colorado, to -wit:
Beginning at the point where the south line of
Eleventh Street of the City of Pueblo produced, intersects
the east line of the northwest quarter of the southwest
quarter of Section Thirty, Township Twenty, South of Range
Sixty -four West, which point-is thirty and thirty -four
hundredths feet north of the southeast corner of said
Northwest quarter of the Southwest quarter of Section
Thirty; thence West on the South line of said Eleventh
Street two hundred fifty -one and eight - tenths feet, to
the eastern line of the right of way of the Denver and Rio
Grande Railroad; thence northwesterly along said right of
way line, forty -nine and three tenths feet; thence north-
easterly on a curved line having a radius of 662.3 feet
and having the center of the circle located three hundred
and ninety -eight feet east and twenty -two feet north of

the before mentioned southeast corner of the northwest
quarter of the southwest quarter of Sectio# Thirty, five
hundred and sixty -eight and two tenths feet to the east
line of the said northwest quarter of the southwest quar-
ter of Section Thirty; thence south on said east line
five hundred and thirty -one and five - tenths feet to the
place of beginning; containing two and twenty -two hun-
dredths acres; said tract being a portion of the north -
wes% quarter of the southwest quarter of Section Thirty,
Township Twenty South, of Range Sixty-four West, in said
County of Pueblo and State of Colorado.
Also the following described tract of land situate in said
County of Pueblo and State of Colorado, to -wit:
A strip of land fifty feet wide, being twenty -five
feet in width on each side of the center line of The
Colorado and Southern Railway Companyts track as the same
was constructed on, over and across Lots 5 6, 7, 8, 9
and 10, of Block 3 of Patton & Smithts Addition to the
City of Pueblo, according to the recorded plat of said
addition.
IN WITNESS WHEREOF said The Colorado and Southern Railway
Company has caused this assignment to be executed in its cor-
porate name by its Vice- President .and General Manager, and
its corporate seal to be hereunto affixed, attested by its
Secretary, this 31 day of December, 1928.
