STREET TO OPERATE AS AN OVERNIGHT EMERGENCY
SHELTER AND SUSPENDING ORDINANCES AND
REGULATIONS OF THE CITY IN CONFLICT THEREWITH
WHEREAS, extreme temperatures and weather events pose significant danger to the
health of the City's unhoused residents; and
WHEREAS, appropriate emergency shelters are necessary to protect unhoused
outdoors; and
WHEREAS, the City is also experiencing an increase in man-made circumstances
resulting in an increase in the number of unhoused, as well as other exigent circumstance which
oused residents regardless of
extreme temperatures or weather events; and
WHEREAS, there is a need for temporary overnight shelters outside the current
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The City of Pueblo hereby declares that a housing and shelter emergency currently
current access to appropriate overnight shelters to protect their health and safety against
dangerous weather events or man-made circumstances when they are outdoors.
SECTION 2.
Ordinance No. 10058, dated November 22, 2021, shall be hereby expanded, enlarged,
and amended to allow the Mayor, during declared temporary housing and shelter emergencies,

to declare the property located at 710 W. 4 Street, Pueblo, Colorado 81003, be considered to
have an Assembly Group A-3 occupancy use with a 40 square feet per person occupant density
consistent with emergency sheltering design standards. This use and occupancy classification
is intended to incorporate those classifications contained in the International Fire Code and
International Building Code, as previously adopted by the City.
SECTION 3.
Except as amended hereby, Ordinance No. 10058, as previously amended by
Ordinances 10326, 10582, and 10697, is hereby ratified, and shall remain in full force and
effect.
SECTION 4.
The immediate enactment of this Ordinance is necessary to preserve and protect the
health, safety, and welfare of the residents of the City. Pursuant to Section 3-20 of the City
Charter, this Ordinance shall become effective on the date of final action by the Mayor and City
Council.
SECTION 5.
The officers and staff of the City are authorized and directed to perform any and all acts
consistent with this Ordinance to implement the policies and procedures described herein.

SUMMARY:
Attached is a proposed Emergency Ordinance which allows the Mayor, during declared
housing and shelter emergencies, to authorize and declare the property located at 710

W. 4 Street, Pueblo, Colorado 81003, which is currently classified for business
occupancy only, to be considered to have an A-3 occupancy use with a 40 square feet
per person occupant density consistent with the International Fire Code, International
Building Code, and emergency sheltering design standards.
PREVIOUS COUNCIL ACTION:
On November 22, 2021, by Ordinance No. 10058, City Council authorized the Mayor,

when temperatures reach dangerous levels between December 1 and March 31 of
each year, to dec
mosques, temples, and other religious institutions to be used as temporary shelters for
Fire, and Building Code ordinances and regulations in conflict with such use were
temporarily suspended during such temporary emergencies.
On November 14, 2022, by Ordinance 10326, City Council enlarged this authority from

December 1 to November 1.
On October 23, 2023, by Ordinance No. 10582, City Council enlarged this authority to

declare a housing and shelter emergency before November 1of each year.
On April 22, 2024, by Ordinance No. 10697, City Council enlarged this authority to
declare a housing and shelter emergency throughout the year.
BACKGROUND:
The City is experiencing an increase in the frequency of extreme weather events to
include fire, flooding, heat, and cold in addition to certain man-made circumstances and
unhoused residents outside of the current emergency housing and

shelter authorization. Currently the property at 710 W. 4 Street is classified as a
Business Group B occupancy for building use purposes. This emergency ordinance will
nd privileges associated
with an Assembly Group A-3 occupancy classification during declared housing and
shelter emergencies, with a 40 square feet per person occupant density pursuant to
emergency sheltering design standards.
