AN ORDINANCE AMENDING ZONING RESTRICTIONS OF THE
BELMONT PLACE, PLANNED UNIT DEVELOPMENT TO A
COMBINATION OF THREE ZONE DISTRICTS: B-3, HIGHWAY
AND ARTERIAL BUSINESS ZONE DISTRICT, R-2, SINGLE
FAMILY RESIDENTIAL ZONE DISTRICT AND R-5, MULTIPLE-
RESIDENTIAL AND OFFICE ZONE DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights-of-way, together generally identified in the
attached Rezone Exhibit, is hereby changed from R-4, Mixed Residential Zone District to RCN,
Residential Charter Neighborhood Zone District:
PARCEL 1
A parcel of land located within a portion of the W ½ of the NW ¼ of Section 21, Township 20
South, Range 64 West of the Sixth Principal Meridian, being more particularly described as
follows:
BEGINNING at a point on the west line of the said W ½ of the NW ¼ of Section 21; from which

and City Council.

SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS OF THE
BELMONT PLACE, PLANNED UNIT DEVELOPMENT TO A
COMBINATION OF THREE ZONE DISTRICTS: B-3, HIGHWAY AND
ARTERIAL BUSINESS ZONE DISTRICT, R-2, SINGLE FAMILY
RESIDENTIAL ZONE DISTRICT AND R-5, MULTIPLE-RESIDENTIAL
AND OFFICE ZONE DISTRICT
SUMMARY:
The applicant is requesting to rezone the current 114-acre Belmont Place, Planned Unit
Development to a combination of three zone districts: B-3, 19.77-acres, R-2, 38.21-
acres, and R-5, 55.29-acres to allow for commercial, commercial mixed use, and
residential development.
PREVIOUS COUNCIL ACTION:
The applicant is concurrently requesting to subdivide (S-22-07) 113-acres into six (6)
commercial lots in two (2) blocks and create four (4) parcels reserved for future
development. The proposed subdivision covers all of the Belmont Place, Planned Unit
Development.
BACKGROUND:
The subject site is currently unimproved and is located east of Troy Avenue and south
of Cesar Chavez Boulevard (SH 47). The area was annexed into the City in 1972 and is
identified as an Urban Neighborhood by the Pueblo Comprehensive Plan. The property
is currently zoned in the Belmont Place PUD which serves as the master plan for
development as requirement by the Comprehensive Plan. This rezoning request would
change northwestern portion of the property (Parcel 1 of the Rezone Exhibit) to a B-3,
Highway and Arterial Business District, which will allow commercial development in the
six large lots that are planned in the Belmont Place, Filing No. 1 Subdivision. The R-2
zoning (Parcels 2 and 4 on the Rezone Exhibit) is proposed to be subdivided in Filing
No. 1 as a non-buildable Parcels A and C in the Belmont Place, Filing No. 1
Subdivision. The proposed R-2 zoning is located south of the B-3 Zone District along
the western boundary of the development site. The R-5 zoning (Parcel 3 of the Rezone
Exhibit) is in the eastern and central portion of the development site and is proposed to
be subdivided as non-buildable Parcel B in Belmont Place, Filing No. 1 Subdivision.
The proposed zoning for the property closely mirrors the Land Use Map approved in the
Amended PUD Development Guide, approved through Ordinance 9973 in 2021. The
proposed rezoning, like the current PUD, includes provisions to allow commercial,
multifamily residential, single-family residential and park development. The applicant
commercial development at the far northwest section of the property, where Nottingham
Drive is planned to extend east and south through the proposed development. The
remaining southern portion of the property will be rezoned to R-2, Single Family
Residential, and R-5, Multiple Residential and Office, which is proposed to be
subdivided as non-buildable parcels in the Belmont Place, Filing No. 1 Subdivision and
will require future re-subdivision prior to development.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their February 14, 2024 Regular Meeting,
voted 5-0 to recommend approval, Commissioners Martinez and Spinuzzi absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance the property will not be zoned in
accordance with the Pueblo Municipal Code.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
