AN ORDINANCE AMENDING ZONING RESTRICTIONS TO
REZONE 3215 LAKE AVENUE, LOCATED SOUTH OF PUEBLO
BOULEVARD AND WEST OF LAKE AVENUE FROM I-
2,INDUSTRIAL ZONE DISTRICT TO R-6, MULTIPLE
RESIDENTIAL AND COMMERCIAL ZONE DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights-of-way, together generally identified in the
attached Rezone Exhibit, is hereby changed from R-2, Single-Family Residential Zone District
to CCN, Commercial Charter Neighborhood Zone District:

SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.

DISTRICT TO R-6, MULTIPLE RESIDENTIAL AND COMMERCIAL
ZONE DISTRICT
SUMMARY:
The applicant is requesting to rezone approximately 17.93-acres at 3215 Lake Avenue,
generally located south of Pueblo Boulevard and west of Lake Avenue from I-2,
Industrial Zone District to R-6, Multiple Residential and Commercial District to facilitate
a mixed-use development of the site.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
3215 Lake Avenue is a 17.93-acre lot in the Lake Garden Subdivision south of West
Pueblo Boulevard. It was originally developed as a dog track in 1962 and held live
greyhound races until 1999. Currently, the dog track is closed, and no commercial
activity is on the site. Copper Spur Properties, LLC would like to redevelop the lot into a
mixed-use development with multi-family residential, hotel, and commercial uses. The
property is currently zoned I-2, which does not support the proposed uses, so the R-6
Zone District is being proposed. The I-2 zoning will remain to the south and the west of
the property and the existing surrounding light industrial uses shall remain. There are
two properties adjacent to the north. One is a gas station and will remain I-2. The other
is zoned B-3 and is currently classified as commercial use however the portion of that
parcel adjacent to the Dog Track Site is vacant. To the east is a small mixed-use
development that has a couple of hotels, fast-food restaurants, and small retail shops.
The Pueblo Regional Comprehensive Plan has identified this area for commercial
mixed-use. Characteristics of commercial mixed-use include a mix of commercial,
employment, and service-oriented uses that serve adjacent neighborhoods and the
broader region. Infill and redevelopment are encouraged to reduce surface parking and
revitalize underutilized areas. Commercial Mixed-Use areas have a limited mix of uses,
the introduction of a broader mix of usesincluding multi-family residentialis
encouraged. All of which make the requested rezoning for the proposed uses highly
compatible with the long-range plan.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their September 25, 2024 Regular Meeting,
voted 5-0 to recommend approval, Commissioners Aznar and Maestri absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing
ALTERNATIVES:
If City Council does not approve this Ordinance the property will not be zoned in
accordance with the Pueblo Municipal Code.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
