A RESOLUTION RATIFYING THE AWARD OF AN EMERGENCY
CONSTRUCTION CONTRACT IN THE AMOUNT OF $22,487.00
TO RUSS GRADING & EXCAVATING LLC, A COLORADO
LIMITED LIABILITY COMPANY, FOR PROJECT NO. 23-040
(SWAN03) - FOR EMERGENCY STORM SEWER POINT
REPAIR AT THE INTERSECTION OF EVANS AVENUE AND
WASHINGTON STREET AND APPROVING A CHANGE ORDER
IN THE AMOUNT OF $75,978.91 FOR ADDITIONAL WORK AND
MATERIALS, AND AUTHORIZING AND APPROVING THE
PURCHASING AGENT'S EXECUTION OF THE SAME
WHEREAS, an emergency storm sewer repair was authorized by the Mayor in
accordance with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to Russ Grading & Excavating LLC,
under the 2023-2026 Storm Sewer Point Repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
City Council hereby ratifies and approves the contract for the emergency repair of the
storm sewer at the intersection of Evans Avenue and Washington Street with Russ Grading &
Excavating LLC, Project No. 23-040 (SWAN03) awarded to said bidder in the amount of
$98,465.91 which amount includes all contract change orders.
SECTION 2.
Funds for Project No. 23-040 (SWAN03) Emergency Storm Sewer Point Repair at the
intersection of Evans Avenue and Washington Street shall be paid from the Stormwater Utility
Fund Project Account SWAN03, Point Repairs & Pipe Cleaning.
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, A
Colorado Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto
and attested the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Resolution and the contract to implement the transactions described
therein. Furthermore, all actions previously taken by officers and staff of the City consistent with
the contract including any payments authorized under the contract and the contract change
order in the amount of $75,978.91 are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves the award of a construction contract in the
amount of $22,487.00 to Russ Grading & Excavating LLC, under Contract No. 23-040
for an emergency storm sewer point repair at the intersection of Evans Avenue and
Washington Street and approves a change order in the amount of $75,978.91.
PREVIOUS COUNCIL ACTION:
On 8/14/2023 City Council passed Resolution #15335, which approved the award of the
2023-2026 Storm Sewer Point Repair Contract to multiple contractors which were
qualified via competitive bid.
BACKGROUND:
Stormwater Utility was notified of a possible sinkhole at the intersection of Evans
Avenue and Washington Street. A visual inspection of the inlets, manholes, and a
CCTV inspection were conducted inside the stormwater pipes at the intersection. The
visual inspection of the inlet on the southeast side revealed the inlet was damaged. The
CCTV inspection of the pipes revealed that the pipe was collapsed, and it was full of
debris and sediment. An emergency point repair was required to repair the inlet and
pipes at the intersection.
The contract with the unit prices for the estimated work performed by Russ Grading &
Excavating LLC. can be found attached. This work was performed under the 2023-2026
Storm Sewer Point Repair Resolution #15335 through which contractors were qualified
via competitive bid.
FINANCIAL IMPLICATIONS:
Funding in the amount of $98,465.91 will be paid from the Stormwater Utility budget,
Project Account SWAN03, for Point Repairs and Pipe Cleaning.
