HomeMy WebLinkAbout154aRESOLUTION NO. 154a WHEREAS; the Board of Commissioners Public Water Works District Number Two of Pueblo, Colorado, has, by resolution; requested the Council of Pueblo to pass an ordinance providing for the submission to the qualified taxpaying electors. of said District the question of issuing bonds for the extension, improvement, repair and maintenance of the Water Works System of said District, and WHEREAS; the Council of Pueblo, is compliance with said request, has passed such an ordinance, being ordinance No. 1148 entitled: "PROVIDING FOR THE SUBMISSION TO THE QUALIFIED TAXPAYING ELECTORS OF PUBLIC WATER WORKS DISTRICT NUMBER TWO OF THE QUESTION OF ISSUING BONDS FOR THE EXTENSION, IMPROVEMENT, REPAIR AND MAINTENANCE OF THE WATER WORKS SYSTEM OF SAID DISTRICT," passed August 20th, 1923, and WHEREAS; the said qualified taxpaying electors will vote upon said question as provided in said ordinance on November 6th, 1923, and WHEREAS, if a majority of the votes cast at said election upon the question of the issuance of said bonds shall be in favor of their issuance, then said bonds will be duly authorized in the amount of Two Hundred Fifty Thousand ($250,000.00) Dollars, and the said Board of Commissioners of said Water Works District will thereupon desire to proceed to enter into a contract or contracts or purchases concerning said extension, improvement, repair and maintenance of the Water Works System of said District, involving an expenditure or indebtedness in excess of Twenty -five Thousand ($25,000.00) Dollars, and WHEREAS, it is provided by Section 9 of Article XIV of the Charter of Pueblo that no contract or purchase involving an expenditure or indebtedness in excess of Twenty -five Thousand ($25,000.00) Dollars shall be entered into or made, by the Trustees or Commissioners of any of the Water Districts of Pueblo, until submitted to a vote of the legal voters residing within such water district, and approved by the vote of a majority of those voting on the question, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF PUEBLO that there be submitted to the legal voters residing within Public Water Works District No. 2 of Pueblo, Colorado, at the General City Election to be held on November 6th, A. D., 1923, the question of approving the entering into or making by the Board of Commissioners of Public Water Works District No. 2 a contract or contracts or purchases involving an expenditure or indebtedness in excess of Twenty -five Thousand ($25,000.00) Dollars for the extension, improvement, repair and maintenance of the Water Works System of said District, and BE IT FURTHER RESOLVED that notice of the submission of said question shall be published and posted for the same length of time and in the same manner, and the election shall be conducted and the result thereof determined, declared and certified in all respects as nearly as may be in conformity with the provisions of the law governing the election of municipal officers of this City and the said question of the entering into such contract or contracts or purchase shall be placed upon the legal ballots to be cast by the qualified electors at said election residing within said water district, and shall contain the words: "FOR AUTHORIZING THE MAKING OF EXPENDITURE BY PUBLIC WATER WORKS DISTRICT NUMBER TWO IN EXCESS OF $25,000.00 FOR IMPROVEMENT OF WATER WORKS SYSTEM" and the words: "'AGAINST AUTHORIZING THE MAKING OF EXPENDITURE BY PUBLIC WATER WORKS DISTRICT NUMBER TWO IN EXCESS OF $25,000.00 FOR IMPROVEMENT OF WATER WORKS SYSTEM ", and provisions shall be made thereon so that the voters may express their choice upon the question submitted by making a cross (X) opposite the words expressing their choice, and BE IT FURTHER RESOLVED that no person shall vote on the question of entering into or making such contract or contracts or purchase unless said person be a legal voter or qualified elector residing within Public Water Works District Number Two in Pueblo, Colorado, and BE IT FURTHER RESOLVED that after the returns of said election have been canvassed, the City Clerk shall prepare a certificate setting forth the result of said election upon said question and deliver the same to the Board of Water Works or other Board of Commission in charge of the affairs of said Water District. If a majority of the votes cast at said election upon said , question shall be in favor thereof then said contract or contracts or purchase involving an expenditure or indebtedness in excess of Twenty -five Thousand ($25,000.00) Dollars for the extension, improvement, repair and maintenance of the Water Works System of said District may be entered into or made, otherwise, the Board of said Water Works shall have no authority to enter or make any such contract or contracts or purchase.
