AN ORDINANCE AMENDING SECTION 7 -7 -1 OF
CHAPTER 7, OF TITLE VII OF THE PUEBLO MUNICIPAL
CODE, CONCERNING SERVICE CHARGES FOR
DELIVERY OF SOLID WASTE TO A SOLID WASTE
FACILITY
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate
matter being deleted; underscoring indicates new matter being added)
SECTION 1
Section 7 -7 -1 of Chapter 7, of Title VII of the Pueblo Municipal Code, as
amended, is hereby amended to read as follows:
Sec. 7 -7 -1. Definitions.
(a) Certificate of designation means a certificate to operate a solid
waste disposal site and facility issued pursuant to Chapter 12 of Title IV of this
Code.
(b) Facility means and includes both a solid waste disposal site and
facility for which a certificate of designation has been issued and a solid waste
transfer station.
(c) Operator means the person owns or operates a facility.
(d) Service charge means [twenty -five cents ($0.25)] fifty cents
($0.50) for each cubic yard of solid waste [delivered to a facility for disposal.] or
two dollars ($2.00) per ton [Each ton] of compacted or baled solid waste [shall
be deemed to be the equivalent of four (4) cubic yards of solid waste.] delivered
to a facility for disposal.
(e) Solid waste transfer station means a location, structure or building
at which solid waste, awaiting transportation to a disposal site, is transferred from
one (1) type of containerized collection receptacle and placed into another or is
processed for compaction.
(f) User means a person who delivers solid waste to a facility for
disposal.
SECTION 2
The service charges created by this ordinance shall apply to waste delivered to a
facility for disposal on or after June 1, 2010.

OF SOLID WASTE TO A SOLID WASTE FACILITY
ISSUE:
Should the City Council adopt an ordinance amending Section 7 -7 -1 Pueblo Municipal
Code to increase the service fee for delivering solid waste to a solid waste facility from
twenty five cents ($0.25) per cubic yard or one dollar ($1.00) per ton to fifty cents
($0.50) per cubic yard or two dollars ($2.00) per ton?
RECOMMENDATION:
This ordinance was prepared at the request of Councilman Ray Aguilera.
BACKGROUND:
Under Section 7 -7 -1 of the Pueblo Municipal Code as currently written, the City receives
a service fee of ($0.25) per cubic yard or one dollar ($1.00) per ton for solid waste
delivered to a solid waste disposal site or transfer station.
The proposed ordinance would increase the service fee from ($0.25) per cubic yard or
one dollar ($1.00) per ton to fifty cents ($0.50) per cubic yard or two dollars ($2.00) per
ton.
FINANCIAL IMPACT:
The existing service charge generates approximately one hundred five thousand dollars
($105,000) in revenue each year. The proposed ordinance should generate an
additional one hundred five thousand ($105,000) each year (a total of two hundred ten
thousand dollars ($210,000) per year). The ordinance does not require any additional
expenditures.
