HomeMy WebLinkAbout08184ORDINANCE NO. 8184 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO NOTIFICATION PROCEDURES FOR PUBLIC HEARINGS TO REVIEW ALL HARP ZONED PROPERTIES AND PROVIDING PENALTIES FOR VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being deleted, underscoring indicating matter being added) SECTION 1. Section 17 -4 -51, of Chapter 4, Title XVII of the Pueblo Municipal Code, as amended, is hereby modified by the amendment of subsections (12.2)(d), (12.3)(d), and (12.3.1)(d) to read as follows: (12.2) Historic Arkansas Riverwalk of Pueblo Zone District — One (HARP -1) d. Review Process. 1. No building permit shall be issued nor shall any work be undertaken or commenced to construct, reconstruct, remodel, repair, paint, rehabilitate or in any way alter or modify the exterior of any building in a Historic Arkansas Riverwalk of Pueblo Zone District until the Planning and Zoning Commission after proper notice has been given and a public hearing has been held in the manner required for a zoning map amendment, has reviewed, approved and issued a written certificate of compliance for such work. (12.3) Historic Arkansas Riverwalk of Pueblo Zone District — Two (HARP 2) d. Review Process. 1. No building permit shall be issued nor shall any work be undertaken or commenced to construct, reconstruct, remodel, repair, paint, rehabilitate or in any way alter or modify the exterior of any building in a Historic Arkansas Riverwalk of Pueblo Zone District until the Planning and Zoning Commission after proper notice has been given and a public hearing has been held in the manner required for a zoning map amendment, has reviewed, approved and issued a written certificate of compliance for such work. (12.3.1) Historic Arkansas Riverwalk of Pueblo Zone District —Three (HARP 3) d. Review Process. 1. No building permit shall be issued nor shall any work be undertaken or commenced to construct, reconstruct, remodel, repair, paint, rehabilitate or in any way alter or modify the exterior of any building in a Historic Arkansas Riverwalk of Pueblo Zone District until the Planning and Zoning Commission after proper written certificate of compliance for such work. SECTION 2. This Ordinance and these amendments to Title XVII of the Pueblo Municipal Code shall be subject to administration and enforcement in accordance with Chapters 5 and 7 of Title XVII, Pueblo Municipal Code, as amended. Any person who violates any provision of this Ordinance or these amendments shall be guilty of a municipal offense and subject to punishment and all other remedies as provided in Chapter 7 of Title XVII of the Pueblo Municipal Code, as amended. SECTION 3. This Ordinance shall become effective immediately after final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO NOTIFICATION PROCEDURES FOR PUBLIC HEARINGS TO REVIEW ALL HARP ZONED PROPERTIES AND PROVIDING PENALTIES FOR VIOLATION THEREOF ISSUE Should the City Council amend Chapter 4 of Title XVII of the Pueblo Municipal Code relating to notification procedures for public hearings to review all HARP zoned properties? RECOMMENDATION The Planning and Zoning Commission, at their March 10, 2010 Regular Meeting, voted 7 -0 to recommend approval. BACKGROUND Currently, all applications for review involving HARP zoned properties are reviewed for approval by the Planning and Zoning Commission; however, there are not any requirements for the procedures to notice for a public hearing. This amendment will require that the review of all HARP zoned properties be done after public notice and public hearing. FINANCIAL IMPACT None.
