ORDINANCE NO. 8173
AN ORDINANCE VACATING THE DRAINAGE EASEMENT
WITHIN LOT 1, BLOCK 1, SKYVIEW SUBDIVISION
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described easement:
A 20.00 foot wide drainage easement located within a portion of Lot 1, Block 1, Skyview,
according to the recorded plat thereof, filed for record November 5, 1980 in Book 2049 at
Page 905 in the records of the Pueblo County Clerk and Recorder, being within a portion of
the N 1/2 of Section 12, Township 20 South, Range 65 West of the Sixth Principal
Meridian, being more particularly described as follows:
BEGINNING at a point on the northerly line of said Lot 1, said point also being on the
centerline intersection of a 30.00 foot wide drainage easement as established on the said
recorded plat of Skyview; thence along said northerly line, along the arc of a curve to the
right whose center bears S 18 °28'02 "W (bearings based on the westerly line of Lot 1, Block
1, Skyview, according to the recorded plat thereof, filed for record November 5, 1980 in
Book 2049 at Page 905 in the records of the Pueblo County Clerk and Recorder,
monumented at the NW corner with a No. 4 rebar with yellow plastic cap P.L.S. No. 22101
and monumented at the SW corner with a No. 4 rebar with yellow plastic cap P.L.S. No.
12933, to bear S 04 °40'27 "E), having a central angle of 1 °35'30" and a radius of 360.00
feet, a distance of 10.00 feet; thence S 18 °28'02 "W, a distance of 20.67 feet; thence S
85 °19'29 "W, a distance of 147.34 feet; thence S 04 °40'27 "E, a distance of 236.84 feet to
a point on the southerly line of said Lot 1; thence N 89 °59'19 "W, along said southerly line,
a distance of 20.07 feet to the SW corner of said Lot 1; thence N 04 °40'27 "W, along the
westerly line of said Lot 1, a distance of 302.34 feet to the NW corner of said Lot 1; thence
S 81 °43'46 "E, along said northerly line of Lot 1, a distance of 20.52 feet; thence S
04 °40'27 "E, a distance of 42.54 feet; thence N 85 °19'29 "E, a distance of 134.14 feet;
thence N 18 °28'02 "E, a distance of 7.47 feet to a point on said northerly line of Lot 1;
thence along said northerly line, along the arc of a curve to the right, whose center bears S
16°52'31"W, having a central angle of 1 °35'30" and a radius of 360.00 feet, a distance of
10.00 feet to the POINT OF BEGINNING.
Said 20.00 foot wide drainage easement contains 0.21 acres, more or less.
is hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the proposed vacation of the Drainage Easement located
within Lot 1, Block 1, Skyview Subdivision?
The Planning and Zoning Commission, at their January 13, 2010 Regular Meeting,
voted 7 -0 to recommend approval.
BACKGROUND
The project site was subdivided in 1980 into two lots. A 30 -foot Drainage Easement,
bisecting the lot, was dedicated on the plat. The central location of the easement
impairs the property owner's ability to develop the lot, therefore a vacation has been
requested and a replacement easement has been proposed. The replacement
easement runs along the northern property line and south along the western property
line. The new easement will unencumber the buildable portion of the lot facilitating
development.
