AN ORDINANCE VACATING THE DRAINAGE,
INGRESS /EGRESS AND PUBLIC UTILITY EASEMENTS
LOCATED BETWEEN LOTS 4 & 5, BLOCK 1, SOUTHERN
COLORADO MEDICAL CENTER FILING, NO. 1
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described easements:
All of the Ingress /Egress, Drainage and Public Utility easement Adjacent to
Lot 4 and Lot 5, Block 1, in Southern Colorado Medical Center, Filing No. 1
according to the recorded plat thereof as filed for record at Reception No.
1216941 in the Pueblo County Records.
EXCEPTING THEREFROM:
The Westerly 15 feet and the Southerly 10 feet of the Public Utility Easement
as recorded at Reception No. 1216941
are hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the proposed vacation of the Drainage, Ingress /Egress and
Public Utility Easements located between Lots 4 & 5, Block 1, Southern Colorado
Medical Center Filing, No. 1?
RECOMMENDATION
The Planning and Zoning Commission, at their February 10, 2010 Regular Meeting,
voted 5 -0 to recommend approval.
BACKGROUND
The project site was subdivided in 1998 for office development. A 30 -foot Drainage
Easement running north and south between Lots 4 and 5 was dedicated on the plat.
The central location of the easement impairs the property owner's ability to develop both
lots. To facilitate development of the lots, a vacation has been requested for the
existing 30 -foot easement and a replacement five -foot easement to accommodate the
existing QWEST line has been recorded. Access for Lot 5 will be provided from Parker
Boulevard and access for Lot 4 will be provided by an easement adjacent to Spaulding
Avenue. Drainage issues will be addressed at the time of development.
