AN ORDINANCE AMENDING CHAPTER 8 OF TITLE VI
OF THE PUEBLO MUNICIPAL CODE RELATING TO
PERSONNEL VACANCIES
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets
indicate matter being deleted, underscoring indicates new matter being added)

Section 6 -8 -5 of Chapter 8, Title VI of the Pueblo Municipal Code, as amended,
is hereby amended to read as follows:
Sec. 6-8-5. Vacancies.
(a) A vacancy shall exist whenever the number of positions established
by the budget exceeds the number of employees in such positions.
(b) The City Manager may, upon written notice to the Director, declare
that a vacancy shall remain open for a period not to exceed [six (6)] twelve (12)
months.
(c) The City Council may at any time declare that any portion of all
existing or future vacancies shall remain open for such period or periods as the
City Council shall determine by resolution.
(d) Unless held open as provided in Subsections (b) and (c) above,
vacancies shall be filled as soon as the Director can certify to the department
head as provided in Section 6 -8 -6.
(e) During the time a vacancy is held open, the eligible list pertaining to
such vacancy shall remain frozen and no new eligible list shall be established
until action is taken on such vacancy.
SECTION 2
This Ordinance shall become effective immediately upon final passage and
approval, and shall apply to all vacancies existing on the date of passage of this
Ordinance or arising thereafter.

AN ORDINANCE AMENDING CHAPTER 8 OF TITLE VI OF THE PUEBLO
MUNICIPAL CODE RELATING TO PERSONNEL VACANCIES
ISSUE
Should the City Council authorize the City Manager to be able to freeze vacancies for
up to twelve months instead the current maximum of six months?
BACKGROUND
This measure would allow the City Manager to "freeze" vacant positions for up to 12
months (instead of the current 6 month maximum), rather than asking Council to hold
positions open or abolish the positions by amendment of the staffing ordinance and
budget. This eliminates the burden of preparing resolutions or ordinances for Council's
consideration to freeze or abolish positions which will likely be restored when the
economy improves.
This Ordinance would have no effect upon employees in the Fire bargaining unit due to
Article 46 of the Fire collective bargaining agreement.
RECOMMENDATION
Approval of the Ordinance.
FINANCIAL IMPACT
Due to projected budget shortfalls, it may be necessary to hold vacancies open for
longer than 6 months, which is the maximum currently authorized by Ordinance. There
may be incidental cost savings attributable to reduced paperwork.
