AN ORDINANCE AMENDING CHAPTER 4 OF TITLE IV OF
THE PUEBLO MUNICIPAL CODE RELATING TO
PLUMBING REGULATIONS AND ADOPTING THE 2009
UNIFORM PLUMBING CODE PUBLISHED BY THE
INTERNATIONAL ASSOCIATION OF PLUMBING AND
MECHANICAL OFFICIALS, INC., AND PROVIDING
PENALTIES FOR THE VIOLATION THEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate
matter being deleted; underscoring indicates new matter being added.)
SECTION 1.
Section 1 of Chapter 4, Title IV of the Pueblo Municipal Code is hereby repealed
in its entirety and reenacted to read as follows:

Sec 4-4-1. Uniform Plumbing Code; adoption by reference.
The Uniform Plumbing Code, 2003 edition, including all appendices,
tables and installation standards, promulgated and published by the International
Association of Plumbing and Mechanical Officials, 5001 E. Philadelphia St.,
Ontario, CA 91761-2816, herein referred to as Plumbing Code or U.P.C., as
amended by this Chapter, together with the minor codes entitled, "Uniform
Swimming Pool, Spa and Hot Tub Code," (U.S.P.S.H.T.C.), 2003 edition,
published by the International Association of Plumbing and Mechanical Officials,
5001 E. Philadelphia St., Ontario, CA 91761-2816, and the Uniform Solar Energy
Code (U.S.E.C.), 2003 edition, published by the International Association of
Plumbing and Mechanical Officials, 5001 E. Philadelphia St., Ontario, CA 91761-
2816 and the National Fire Protection Association (N.F.P.A.), Standard "24"
Installation of Private Fire Service Mains and Their Appurtenances, 2002 edition,
published by the National Fire Protection Association, Batterymarch Park,
Quincy, Massachusetts 02269, are hereby adopted and enacted by reference,
and made a part hereof as if set forth in full; provided, however, that the following
portions of the U.P.C. are not adopted and are expressly deleted: Table 1-1
entitled "Plumbing Permit Fees," Chapter 5 entitled "Water Heaters," Chapter 12
entitled "Fuel Piping," Chapter 13 entitled "Medical Gas Systems," and including
Appendix E entitled "Manufactured/ Mobile Home Parks And Recreational
Vehicle Parks," Appendix G entitled "Graywater Systems for Single Family
Dwellings," Appendix J entitled "Reclaimed Water Systems for Non-Residential
Buildings, Appendix K entitled "Private Sewage Disposal Systems," and
Appendix L entitled "Alternate Plumbing Systems " Copies of these Codes are
available in the office of the Regional Building Department for distribution and
sale to the public. All plumbing and drainage pipes, equipment and systems or
parts thereof within the City shall be regulated by and installed, constructed,
altered and repaired in conformance with the terms and provisions of this
Chapter and the Uniform Plumbing Code, 2003 edition, herein adopted by
reference, except as the same may be excluded from and specifically not
]
covered by this Chapter and said Uniform Plumbing Code.
4-4-1 Uniform Plumbing Code; adoption by reference. The Uniform
Plumbing Code, 2009 edition, including all appendices, tables and
installation standards, promulgated and published by the International
Association of Plumbing and Mechanical Officials, 5001 E. Philadelphia St.,
Ontario, CA 91761-2816, herein referred to as Plumbing Code or U.P.C., as
amended by this Chapter, together with the minor codes entitled, "Uniform
Swimming Pool, Spa and Hot Tub Code," (U.S.P.S.H.T.C.), 2009 edition,
published by the International Association of Plumbing and Mechanical
Officials, 5001 E. Philadelphia St., Ontario, CA 91761- 2816, and the
National Fire Protection Association (N.F.P.A.), Standard "24" Installation
of Private Fire Service Mains and Their Appurtenances, 2002 edition,
published by the National Fire Protection Association, Batterymarch Park,
Quincy, Massachusetts 02269, are hereby adopted and enacted by
reference, and made a part hereof as if set forth in full; provided, however,
that the following portions of the U.P.C. are not adopted and are expressly
deleted: Table 1-1 entitled "Plumbing Permit Fees," Chapter 5 entitled
"Water Heaters," Chapter 12 entitled "Fuel Piping," Chapter 13 entitled "
Health Care Facilities and Medical Gas and Vacuum Systems," and Chapter
16 entitled “Non potable water reuse systems Part II” and including
Appendix E entitled "Manufactured/ Mobile Home Parks And Recreational
Vehicle Parks," Appendix F, “Firefighter Breathing Air Replenishment
Systems,” Appendix G entitled "Graywater Systems for Single Family
Dwellings," Appendix K entitled "Private Sewage Disposal Systems".
Copies of these Codes are available in the office of the Regional
Building Department for distribution and sale to the public. All plumbing
and drainage pipes, equipment and systems or parts thereof within the City
shall be regulated by and installed, constructed, altered and repaired in
conformance with the terms and provisions of this Chapter and the
Uniform Plumbing Code, 2009 edition, herein adopted by reference, except
as the same may be excluded from and specifically not covered by this
Chapter and said Uniform Plumbing Code.
SECTION 2.
Section 2 of Chapter 4, Title IV of the Pueblo Municipal Code is hereby repealed
in its entirety and reenacted to read as follows:

Sec. 4-4-2. Amendments to the Uniform Plumbing Code.
(a) Section 102.1 of the U.P.C. entitled "Authority Having Jurisdiction"
is amended to read as follows:
"Administration and enforcement of this Code and all related codes are
delegated to the Pueblo Regional Building Department."
(b) Section 102.3 of the U.P.C. entitled "Violations and Penalties" is
amended to read as follows:
"Any person, firm, or corporation violating any of the provisions of this
Code, upon conviction shall be punished as provided in Section 4-4-9 of the
Pueblo Municipal Code. The application of any such penalty shall not be held to
prevent the enforced removal of prohibited conditions."
(c) Section 103.4.1 of the U.P.C. entitled "Permit Fees" is amended to
read as follows:
"Fees shall be as set in the fee schedule adopted by the City Council."
(d) Section 103.4.2 of the U.P.C. entitled "Plan Review Fees" is
amended to read as follows:
"Fees shall be as set in the fee schedule adopted by the City Council."
(e) Section 103.5.6 of the U.P.C. entitled "Reinspections" the fourth
paragraph is amended to read as follows:
"To obtain reinspection, the applicant shall file a written application upon a
furnished form and pay the reinspection fee as set in the fee resolution adopted
by the City Council."
(f) The Uniform Plumbing Code is amended by the addition of a new
Section to read as follows.
"Section 104.0 "Plumbing Board of Appeals." There is hereby created a
Plumbing Board of Appeals to perform the functions set forth in Chapter 1 of Title
IV of the Pueblo Municipal Code."
(g) Section 202.0 of the U.P.C. entitled "Definition of Terms". The
following terms are amended to read as follows:
"Authority Having Jurisdiction" - as defined in Section 102.1 of this Code
as amended.
"Plumbing" is the practice, materials and fixtures used in the installation.
maintenance, extension and alteration of all piping, fixtures, appliances and
appurtenances in connection with any of the following: sanitary or storm
drainage facilities, the venting systems and the public or private water supply
systems within or adjacent to any buildings, structure, or conveyance; also the
practice and materials used in the installation, maintenance, extension or
alteration of stormwater, liquid waste or sewerage, and water supply systems of
any premises from the public water main or other acceptable source of water
supply to its connection with any point of public disposal or other acceptable
disposal system.
"Plumbing system" means and includes all potable water supply and
distribution pipes, all plumbing fixtures and traps, all drainage and vent pipes and
all building drains, including their respective joints and connections, devices,
receptacles and appurtenances within the property lines of the premises, and
shall include potable water piping, potable water treating or water-connected
equipment."
(h) Section 202.0 of the U.P.C. entitled "Definition of Terms" is
amended to include the term jurisdiction which shall be defined as follows:
"Jurisdiction shall mean the City Council as defined in Section 4-1-2 of the
Pueblo Municipal Code."
(i) Section 305.0 "Sewers Required" is amended by the addition of a
new Section to read as follows:
"Section 305.4 Taps made to existing sanitary sewers for building sewers
draining into the existing sanitary sewer system of the City shall be made by an
approved mechanical cutting device and an approved saddle or by removing a
section of sewer pipe, and the installation of a new pipe section or sections with a
wye saddle and an approved coupling to make the joint at the juncture of the new
pipe with the existing system. Such work shall be done by either a Plumbing
Contractor or Plumbing Utility Contractor who is licensed to do such work as
provided by Title IV, Chapter 1 of the Pueblo Municipal Code. Connections to new
sanitary sewers or newly repaired sanitary systems and installations of building
sewers from the main sewer to the building drain (as required by Section 305.0)
shall be installed by a Plumbing Contractor or a Plumbing Utility Contractor who is
licensed to do such work. When a sewer main is installed in the street or alley
right-of-way, the building sewer, as defined in this Code, shall be installed to the
property line and properly marked with magnetic ductile tape for the full length of
said sewer line. Building sewers, including each tap and wye, shall be inspected
by personnel of either the Pueblo Regional Building Department or the City
Department of Wastewater."
(j) Section 413.1 of the U.P.C. entitled "Fixture Count" is amended to
read as follows:
"Each building shall be provided with sanitary facilities as prescribed in
Table 4-1 of this Code as amended."
(k) Section 413.2 of the U.P.C. entitled "Access to Fixtures" is deleted.
(l) Section 415.1 of the U.P.C. is amended to read as follows:
"A removable panel of sufficient size shall be provided to access the pump,
but in no case less than a fourteen (14) inch by fourteen (14) inch opening with at
least eighteen (18) inches clear space in front of the access opening."
(m) Table 4-1 of the U.P.C. entitled "Minimum Plumbing Facilities" is
amended to read as follows:
"Each building shall be provided with sanitary facilities, including provisions
for handicap accessibility in accordance with Chapter 11 of the 2003 International
Building Code and the 1998 ICC/ANSI A117.1 Accessible and Usable Buildings
and Facilities Standards.
"The total occupant load shall be determined by using Table 10-A
"Occupant Load Factor" of the 2003 International Building Code and is assumed
to be based on fifty percent (50%) male and fifty percent (50%) female.
"EXCEPTION: Where circumstances dictate a different ratio is needed,
the adjustment shall be approved by the Building Official."
(n) Section 601.0 of the U.P.C., entitled "Running Water Required," is
amended by the addition of a new Section to read as follows:
"Section 601.4 In dwellings and buildings intended for human occupancy,
hot water shall be supplied to all plumbing fixtures and equipment used for bathing,
washing, culinary purposes, cleaning of laundry or building maintenance."
(o) Section 604.1 of the U.P.C. is amended by the addition of the
following exception, to read as follows:
"EXCEPTION: All new or replaced water service piping fewer than two (2)
inches (51 mm) from the main to the meter shall be no lighter than Type L Copper or
PEX, PE-AL-PE, and PEX-AL-PEX pipe. A blue 14-gauge tracer wire shall be
installed with all nonmetallic water services. All service piping two (2) inches (51
mm) or larger shall be Type K Copper, Class 50 or Ductile Iron, Class 150 Asbestos
Cement, or PVC American Water Works Association approved pressure pipe or
other approved material. Water service piping shall be installed to a minimum of
forty-eight (48) inches (1219.2 mm) depth from the top of the pipe."
(p) Section 605.3 of the U.P.C., the first sentence is amended to read
as follows:
"A fullway valve controlling all outlets shall be installed inside a building or
structure on the water service line in a readily accessible area."
(q) Section 707.10 of the U.P.C. is amended to read as follows:
"Each cleanout in piping two (2) inches (51 mm) or less in size shall be so
installed so there is a clearance of not less than twelve (12) inches (305 mm) in
front of the cleanout. Cleanouts in piping larger than two (2) inches (51 mm) shall
have a clearance of not less than eighteen (18) inches (457 mm) in front of the
cleanout."
(r) Section 713.0 of the U.P.C., entitled "Building Sewers" is amended
by the addition of a new Section, to read as follows:
"Section 713.7 'Private Sewer (Mains),' as defined in Chapter 2 of this
Code, connecting to a public sewer system shall be installed according to the
specifications and requirements of the City Department of Public Works. Plans
and permits shall be as required by Chapter 1 of the U.P.C. Private sewer
inspections shall be made by the City Department of Public Works or the Pueblo
Regional Building Department."
(s) Subsection 408.6 of the U.P.C., entitled "Setting," is amended by
the addition of a paragraph, to read as follows:
"Where more than one (1) water closet or water closets and urinals are
installed in a room, they shall be separated by an approved partition wall. Urinals
set next to each other or another fixture shall have an approved splash guard."
(t) Table 4-1 of the U.P.C. is amended by the addition of the following
provisions, the addition of footnotes 15, 16 and 17, and the amendment to
footnote 14, as provided below:

"14. The total number of water closets for females shall be at least equal to the total number
of water closets and urinals required for males. This requirement shall not apply to retail or
wholesale stores.
"15. For smaller-type public and professional offices such as banks, dental offices, law offices,
real estate offices, architectural offices, engineering offices and similar uses. A public area in
these offices shall use the requirements for retail or wholesale stores.
"16. Where more than one (1) water closet or water closets and urinals are installed in a
room, they shall be separated by an approved partition wall. Urinals set next to each other or
another fixture shall have an approved splash guard.
"17. In each bathroom or toilet room, urinals shall not be substituted for more than 67% of the
required water closets."
(u) Table 4-1 Footnote 3 of the U.P.C. is amended to read as follows:
"Drinking fountains, mop sinks or service sinks shall not be installed in
restrooms. Service sinks shall be required on each floor where toilet facilities are
required."
(v) Section 603.0 of the U.P.C., entitled "Cross-Connection Control," is
amended by the following addition:
"All new or remodeled public buildings shall have a reduced pressure-type
backflow preventer installed on the water service supplying such buildings or any
portion thereof."
(w) Subsection 604.2, the Exceptions, is amended to read as follows:
"Type 'M' copper tubing may be used for water piping when piping is
above ground in or on a building."
(x) Subsection 1501.1, entitled "Applicability," is amended to read as
follows:
"All piping penetrations of required fire resistance-rated walls, partitions,
floor, floor/ceiling assemblies, roof/ceiling assemblies or shaft enclosures shall be
protected in accordance with the requirements of the 2003 International Building
]
Code, Chapter 6 and this Chapter."
Section 4-4-2. Amendments to the Uniform Plumbing Code.
(a) Section 102.1 of the U.P.C. entitled "Authority Having
Jurisdiction" is amended to read as follows:
"Administration and enforcement of this Code and all related codes
are delegated to the Pueblo Regional Building Department."
(b) Section 102.3 of the U.P.C. entitled "Violations and Penalties"
is amended to read as follows:
"Any person, firm, or corporation violating any of the provisions of

(e) Section 103.5.6 of the U.P.C. entitled "Reinspections" the

(f) The Uniform Plumbing Code is amended by the addition of a

(g) Section 203.0 of the U.P.C. entitled “A” and the term

(h) Section 212.0 of the U.P.C. “J” is amended to include the term
“Jurisdiction,” which shall read as follows:
"Jurisdiction shall mean the City Council as defined in Section 4-1-2
of the Pueblo Municipal Code."
(i) Section 218.0 of the U.P.C. entitled "P” and the term
“Plumbing System” are amended to read as follows:
"Plumbing" is the practice, materials and fixtures used in the
installation, maintenance, extension and alteration of all piping, fixtures,
appliances and appurtenances in connection with any of the following:
sanitary or storm drainage facilities, the venting systems and the public or
private water supply systems within or adjacent to any buildings, structure,
or conveyance; also the practice and materials used in the installation,
maintenance, extension or alteration of stormwater, liquid waste or
sewerage, and water supply systems of any premises from the public water
main or other acceptable source of water supply to its connection with any

(k) Section 405.0 of the U.P.C. entitled “Prohibited Fixtures” is
amended by the addition of the following sentence added to Section 405.1:
“Drinking fountains, mop sinks or service sinks shall not be installed
in public toilet rooms.”
(l) Section 409.0 of the U.P.C. entitled “Urinals” is amended by
the addition of the following paragraph.
“Surrounding materials, wall and floor space to a point two (2) feet in
front of urinal lip and four (4) feet above the floor and not less than two (2)
feet to each side of the urinal shall be lined with non-absorbent materials.”
(m) Section 412.1 of the U.P.C. entitled "Fixture Count" is amended
to read as follows:
"Each building shall be provided with sanitary facilities as prescribed
in Table 4-1 of this Code as amended."
(n) Section 414.1 of the U.P.C. is amended to read as follows:
"A removable panel of sufficient size shall be provided to access the

a. The fixtures shown are based on one fixture being the minimum required
for the number of persons indicated or any fraction of the number of persons indicated.
The number of occupants shall be determined by Table 1004.1.1 of the 2009 International
Building Code
b. Toilet facilities for employees shall be separate from facilities for inmates
or patients.
c. A single-occupant toilet room with one water closet and one lavatory
serving not more than two adjacent patient sleeping units shall be permitted where such
room is provided with direct access from each patient sleeping unit and with provisions
for privacy.
d. The occupant load for seasonal outdoor seating and entertainment areas
shall be included when determining the minimum number of facilities required.
e. The minimum number of required drinking fountains shall comply with
Table 4.1 and Chapter 11 of the 2009 International Building Code.
f. Drinking fountains are not required for an occupant load of 15 or fewer.
g. Drinking fountains, mop sinks or service sinks shall not be installed in
restrooms.
h. In each bathroom or toilet room, urinals shall not be substituted for more
than 67% of the required water closets in assembly and educational occupancies. Urinals
shall not be substituted for more than 50 % of the required water closets in all other
occupancies.
(p) Section 601.0 of the U.P.C., entitled "Hot and Cold Water
Required," is amended by the addition of a new Section to read as follows:
"Section 601.1.1 In dwellings and buildings intended for human
occupancy, hot water shall be supplied to all plumbing fixtures and
equipment used for bathing, washing, culinary purposes, cleaning of
laundry or building maintenance."
(q) Section 604.1 of the U.P.C. is amended by the addition of the
following exception, to read as follows:
"EXCEPTION: All new or replaced water service piping fewer than
two (2) inches (51 mm) from the main to the meter shall be no lighter than
Type L Copper or PEX, PE-AL-PE, and PEX-AL-PEX pipe. A blue 14-gauge
tracer wire shall be installed with all nonmetallic water services. All service
piping two (2) inches (51 mm) or larger shall be Type K Copper, Class 50 or
Ductile Iron, Class 150 Asbestos Cement, or PVC American Water Works
Association approved pressure pipe or other approved material. Water
service piping shall be installed to a minimum of forty-eight (48) inches
(1219.2 mm) depth from the top of the pipe."
(r) Section 605.3 of the U.P.C., the first sentence is amended to
read as follows:
"A fullway valve controlling all outlets shall be installed inside a
building or structure on the water service line in a readily accessible area."
(s) Section 713.0 of the U.P.C., entitled "Sewer Required" is
amended by the addition of a new Section, to read as follows:
"Section 713.7 'Private Sewer (Mains),' as defined in Chapter 2 of this
Code, connecting to a public sewer system shall be installed according to
the specifications and requirements of the City Department of Public
Works. Plans and permits shall be as required by Chapter 1 of the U.P.C.
Private sewer inspections shall be made by the City Department of Public
Works or the Pueblo Regional Building Department."
(t) Subsection 407.5 of the U.P.C., entitled "Setting," is amended
by the addition of a paragraph, to read as follows:
"Where more than one (1) water closet or water closets and urinals
are installed in a room, they shall be separated by an approved partition
wall. Urinals set next to each other or another fixture shall have an
approved splash guard."
(u) Section 603.0 of the U.P.C., entitled "Cross-Connection
Control," is amended by the following addition:
"All new or remodeled public buildings shall have a reduced
pressure-type backflow preventer installed on the water service supplying
such buildings or any portion thereof."
(v) Subsection 604.2, the Exceptions, is amended to read as
follows:
"Type 'M' copper tubing may be used for water piping when piping is
above ground in or on a building."

SECTION 4.
Sections 4-4-4 and 4-4-5 are readopted without changes, to read as follows:
Section 4-4-4. Interpretation of the Uniform Plumbing Code.
Wherever in the Uniform Plumbing Code it is provided that anything must
be done to the approval of or subject to the direction of the authority having
jurisdiction, this shall be construed to give such officer only the discretion to
determine whether the rules and standards established by the Uniform Plumbing
Code have been complied with; and no such provision shall be construed as
giving any officer discretionary powers as to what such regulations or standards
shall be, or power to require conditions not prescribed by the Uniform Plumbing
Code or to enforce the provisions of the Uniform Plumbing Code in an arbitrary or
discriminatory manner.
Article II
Exclusion
Section 4-4-5. Exclusions for Water Board.
This Chapter shall not be construed to interfere with the Pueblo Board of
Water Works to install and repair of water mains in the City, to install or repair
water meters, water service lines and appurtenances, or to inspect property to
protect the public water supply, to insure delivery of water which is free from
potential backflow and cross-connection hazards, to detect waste or theft of
potable water and to set water rates. Neither a license nor permits shall be
required for the Board of Water Works or its employees to do such work.
SECTION 5.
Section 6 of Chapter 4, Title IV of the Pueblo Municipal Code is hereby repealed.

Section 4-4-6. Garbage disposal units.
(a) All new residences and buildings which are designed, equipped
and used for storing or sheltering food or food stuffs for human consumption,
including fruits, vegetables and meats, which are to be sold either at retail at
stores, clubs, hotels, restaurants, schools or other food establishments or at
wholesale, or which are prepared at food manufacturing or processing plants,
including slaughter houses, whether such places of business are licensed under
the provisions of any ordinance of the City, or not, and all buildings where foods
for human consumption are prepared, sold, handled, stored or served in any
manner whatsoever, and all existing buildings and residences so designed,
equipped and used, when substantially remodeled or altered in those facilities
wherein such foodstuffs are processed, prepared, sold, handled, stored or
served, and all residences and all buildings where foods for human consumption
are prepared, sold, handled, stored or served in any manner whatsoever, which
shall hereafter be newly connected to the sewer system of the City, shall be
equipped with an appropriate type of food-waste grinder, or garbage disposal unit
in good operating condition, properly connected to the kitchen sink or house
drain, which grinder and connections shall be of sufficient size to grind all
garbage and food processing wastes produced in such building, and shall be
suitably located so as to discharge such ground material by flushing it with water
through the drain pipes into the sewer.
(b) A food-waste grinder or garbage disposal unit is any device
connected with the City sewerage system which reduces garbage or food waste
to smaller units by grinding, pulverizing, screening or other methods suitable for

passage in a sewerage system.
SECTION 6.
Sections 4-4-7 and 4-4-8 are readopted without changes, to read as follows:
Section 4-4-7. Domestic appliances.
(a) For the purpose of this Code, the term domestic appliance shall
include apparatus and equipment used for household purposes where the same
are connected to the water supply system and are not connected to a drainage
system. Included, without limiting the generality of the foregoing, are washing
machines, dishwashing machines, lawn sprinkling systems, humidifiers and ice
cube makers.
(1) The term water heating appliances shall include those
having a heating capacity not in excess of two hundred (200) gallons per
hour, based on a temperature rise of sixty degrees (60º) per hour, other
than those used for building heating purposes exclusively.
(2) The term water conditioning appliances shall include
equipment which is designed to soften or otherwise treat water but is not
connected to a drainage system.
(3) The term connection to a water supply system shall not be
construed to include connections to existing faucets.
(b) Any person who shall make a connection to a water supply system
for the purpose of installing, altering or repairing any appliance as defined in this
Section shall be licensed as a "water connected appliance contractor" as
provided in Article III, Chapter 1 of Title IV of this Code.
(c) All connections made to a water supply system for the purpose of
installing, altering or repairing water service pipes, domestic appliances, water
heating appliances and water conditioning appliances as herein defined shall be
made in conformance with all other provisions of this Code.
(d) In all cases where a permit shall have been obtained for another
purpose directly connected with the installation, alteration or repair of such
appliance, it shall not be required that a separate permit be obtained under the
provisions of this Chapter; provided; however, that in any case wherein a permit
is not required for other purposes in the installation, alteration or repair of such
appliance, a permit for such installation, alteration or repair shall be obtained
under the provisions of this Chapter.
Section 4-4-8. Plumbing utility contractor.
It shall be unlawful for any person not registered as a plumbing contractor
to engage in the business of a plumbing utility contractor without first being
licensed by the Plumbing Board of Appeals. A plumbing utility contractor includes
any person who engages in the business of installing one (1) or more of the
following: water service lines, building sewers, private fire mains and similar
installations. A person may be licensed to install one (1) or more of such items,
but in no event shall such license authorize the licensee to install waste, drain or
venting piping. A person licensed as a plumbing contractor or master plumber by
the State may be licensed as a plumbing utility contractor to install water service
lines and/or building sewers without examination. In addition, the plumbing utility
contractor shall comply with all requirements of the City Department of Public
Works.
SECTION 7.
Section 9 of Chapter 4, Title IV of the Pueblo Municipal Code is amended to read
as follows:
Section 4-4-9. Offenses; criminal penalties; permit revocation; other
enforcement
.
(a) It shall be unlawful and a Class 1 municipal offense for any person
to knowingly violate, disobey, omit, neglect, refuse or fail to comply with or resist
the enforcement of any provision of this Chapter or of the Uniform Plumbing
Code, and, upon conviction thereof, the punishment therefor shall be a fine of not
more than one thousand dollars ($1,000.00) or imprisonment for not more than
one (1) year, or both such fine and imprisonment.
(b) It shall be unlawful and a Class 1 municipal offense for any person
to refuse or fail to timely comply with an order issued by the Building Official or
other designated plumbing inspector pursuant to the provisions of this Chapter or
the Uniform Plumbing Code, and, upon conviction thereof, the punishment
therefor shall be a fine of not more than one thousand dollars ($1,000.00) or
imprisonment for not more than one (1) year, or both such fine and
imprisonment.
(c) It shall be unlawful and a Class 1 municipal offense for any person
to knowingly make any false statement, representation or certification in any
application, record, report, plan or other document filed or required to be
maintained pursuant to any requirement of this Chapter or the Uniform Plumbing
Code, and, upon conviction thereof, the punishment therefor shall be a fine of not
more than one thousand dollars ($1,000.00) or imprisonment for not more than
one (1) year, or both such fine and imprisonment.
(d) Any permit issued pursuant to the provisions of this Chapter or the
Uniform Plumbing Code may be suspended, terminated or revoked by the
Building Official for: (1) any of the reasons stated in Subsection 103.3.5 of the
Uniform Plumbing Code; or (2) any material violation of the terms of said permit
or requirements applicable thereto.
(e) In the event any owner or occupant of premises within the City shall
refuse entry to the Building Official or any plumbing inspector, or if any premises
are locked and the Building Official or any plumbing inspector has been unable to
obtain permission of the owner or occupant to enter, The Pueblo Municipal Court
is authorized to issue a search or inspection warrant authorizing such entry in
accordance with the procedures set forth in the Colorado Municipal Court Rules
of Procedure.
(f) In the event any owner or occupant of premises within the City, or
any licensed contractor or any permittee, shall fail or refuse to comply with any
provision of this Chapter, the U.P.C. or any license or permit issued thereunder,
the City may initiate an action for injunctive relief in any court of competent
jurisdiction to compel compliance with this Chapter or the U.P.C., license or
permit.
(g) The enforcement remedies in this Section are expressly declared to
be cumulative, and the exercise of any one (1) or more of them is not dependent
upon the exercise of any other remedy, nor does the exercise of any one (1) or
more of them constitute any bar or limitation to the exercise of any other.

(h) Table 4-1 set forth in the Uniform Plumbing Code, 2003
Edition, shall control except as otherwise amended herein.
SECTION 8.
A public hearing to consider the adoption of the 2009 Uniform Plumbing Code,
with modifications, shall be held in the Council Chambers, City Hall, 1 City Hall Place,
Pueblo, Colorado at 7:00 p.m. on March 22, 2010. The City Clerk is directed to publish
notice of such hearing pursuant to Section 31-16-203 of the Colorado Revised Statutes.
SECTION 9.
The adoption of this Ordinance and the 2009 Uniform Plumbing Code shall not
create any duty to any person, firm, corporation, or other entity with regard to the
enforcement or nonenforcement of this Ordinance or said code. No person, firm,
corporation, or other entity shall have any private right of action, claim, or civil liability
remedy against the City of Pueblo or the Pueblo Regional Building Department, or their
officers, employees or agents, for any damage arising out of or in any way connected
with the adoption, enforcement, or nonenforcement of this Ordinance or said code.
Nothing in the Ordinance or in said code shall be construed to create any liability, or to
waive any of the immunities, limitations on liability, or other provisions of the
Governmental Immunity Act, Section 24-10-101, C.R.S. et seq., or to waive any
immunities or limitation on liability otherwise available to the City of Pueblo or the
Pueblo Regional Building Department, or their officers, employees or agents.
SECTION 10.
If any part, section, subsection, sentence, clause or phrase of this Ordinance or
the adopted 2009 Uniform Plumbing Code is for any reason held to be invalid, such
decision shall not affect the validity of the remaining portions of this Ordinance or of the
2009 International Building Code.
SECTION 11.
The Council finds and declares that a certified true copy of the 2009 Uniform
Plumbing Code, has been on file in the office of the City Clerk of the City of Pueblo for
not less than 15 days preceding the public hearing referred to in Section 8 of this
Ordinance, and shall remain in said office for public inspection. After adoption of this
Ordinance, a copy of the 2009 Uniform Plumbing Code shall be kept in the office of the

Building Official at the Pueblo Regional Building Department, 316 15 Street W, Pueblo,
Colorado. Copies of the 2009 Uniform Plumbing Code shall be available through the
Pueblo Regional Building Department for purchase by the public at a moderate price.
SECTION 12.
It shall be unlawful and a municipal offense for any person, firm, partnership,
corporation, limited liability company or other entity to violate, disobey, omit, neglect,
refuse or fail to comply with or resist the enforcement of any provision of this Ordinance
or of the 2009 Uniform Plumbing Code adopted herein. Any person found guilty of a
violation of this Ordinance or of the Uniform Plumbing Code shall be punished as
provided in Section 4-4-9 of the Pueblo Municipal Code, as amended. In addition
thereto, the City is authorized to enforce this Ordinance through the exercise of any one
or more of the remedies set forth in Section 4-4-9 of the Pueblo Municipal Code, as
amended, which remedies are hereby expressly declared to be cumulative, the exercise
of any one or more not constituting any bar or limitation to the exercise of any other.
SECTION 13.
This Ordinance shall become effective 30 days after final passage and approval.
