ORDINANCE NO. 8135
AN ORDINANCE VACATING ALL PUBLIC UTILITY
EASEMENTS IN LOT 1, BLOCK 1, UNIVERSITY VILLAGE
SUBDIVISION, FILING NO. 1; AND ALL OF THE DRAINAGE,
SIDEWALK, AND INGRESS /EGRESS EASEMENTS IN LOTS
1 AND 2, BLOCK 2, UNIVERSITY SUBDIVISION, FILING NO.

BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described easements:
All Public Utility Easements in Lot 1, Block 1, University Village Subdivision,
Filing No. 1; and all of the Drainage, Sidewalk, and Ingress /Egress
Easements in Lots 1 and 2, Block 2, University Subdivision, Filing No. 2
are hereby vacated.
SECTION 2.
This Ordinance shall become effective immediately upon final passage and
approval.

ISSUE
Shall City Council approve the proposed vacation of the Public Utility, Drainage,
Sidewalk and Ingress /Egress Easements?
RECOMMENDATION
The Planning and Zoning Commission, at their December 9, 2009 Regular Meeting,
voted 4 -0 to recommend approval.
BACKGROUND
The project site was subdivided in two filings, the first was in 1987 and the second in
2001, both subdivisions included easements for drainage, sidewalk, and ingress /egress.
In order to facilitate resubdivision and construction of the remaining phases of the Wolf
Village Student Housing project all of the previously platted easements need to be
vacated. The proposed Wolf Village Subdivision, Filing No. 1 provides "Detention
Easements" and "Public Utility Easements." The plat dedication reserves the entire Lot
1, Block 1 for "Residential and Emergency Service Access."
