HomeMy WebLinkAbout08120ORDINANCE NO. 8120 AN ORDINANCE AMENDING CHAPTER 11 OF TITLE XVI OF THE PUEBLO MUNICIPAL CODE RELATING TO REFUNDS OF SANITARY SEWER CONNECTION FEE CHARGES AND PLANT INVESTMENT FEE CHARGES BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (brackets indicate matter being omitted; underscoring indicates new matter being added) SECTION 1 Section 16 -11 -5 of Chapter 11 of Title XVI of the Pueblo Municipal Code, as amended, is amended to read as follows: Sec. 16 -11 -5. Refunds. (a) Unless specifically authorized by formal action of the City [Council] Manager no refund shall be authorized or granted for sanitary sewer connection fee charges nor for plant investment fee charges. (b) Refund applications will only be considered by the City [Council] Manager with respect to fees paid for connections which had not been made within a two -year period from the date of payment of the connection fee and not thereafter. Applications for refund shall be made, in writing, to the Director of Wastewater, stating the date the sanitary sewer connection fee was paid, who paid it and the reason for refund request. (c) If approved by the City [Council] Manager [by duly adopted resolution], refunds will be paid only to the person who actually paid the sanitary sewer connection fee, upon proof of payment. (d) No refund shall be made to any customer for a decrease in size of meter or abandonment of service. SECTION 2 This Ordinance shall become effective thirty days after final passage and approval. RECOMMENDATION Approval of Ordinance BACKGROUND The Pueblo Municipal Code presently provides at Section 16 -11 -5 that refunds of sanitary sewer connection fees and plant investment fees can only be authorized by the City Council via a resolution. Customers sometimes pay these fees for connection to Pueblo's sanitary sewer system, then discover that they are unable to complete their project and request a refund of sewer fees. Because these requests involve minor administrative action usually involving relatively low dollar values (less than $2,000), and because they are well supported by documentation, granting the authority to approve these refunds to the City Manager appears to provide several advantages. It would provide greater efficiency by limiting staff time to prepare resolutions and Council time to act on them, improved customer service by expediting refunds; and continues to protect against misappropriation of funds by requiring the same level of documentation. FINANCIAL IMPACT None
