AN ORDINANCE CHANGING ZONING RESTRICTIONS
FROM R -4, MIXED RESIDENTIAL DISTRICT TO 1 -2, LIGHT
INDUSTRIAL DISTRICT COVERING A PARCEL OF LAND
COMMONLY KNOWN AS 1017 SOUTH SANTA FE
AVENUE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property be changed
from R -4, Mixed Residential District to 1 -2, Light Industrial District, and upon passage of
this Ordinance, zoning restrictions affecting 1 -2, Light Industrial District, shall apply to
said property as follows:
Lot 3, Eiler Addition
and more commonly known as:
1017 South Santa Fe Avenue.
SECTION 2.
The zoning change is approved with the condition that landscaping must be
brought into compliance once a building permit is issued for any of the three lots.

ISSUE
Shall City Council approve a request to rezone the subject site from an R -4, Mixed
Residential District to 1 -2, Light Industrial District?
The Planning and Zoning Commission, at their October 14, 2009, Regular Meeting
voted 6 -0 to recommend approval with the following condition:
The rezoning action is to correct having two zone districts on a single parcel. Since the
use of the property is not changing, landscaping must be brought into compliance once
a building permit is issued for any of the three lots.
BACKGROUND
The applicant, Mr. Day, owns a parcel that is comprised of three lots and portions of the
vacated Summit Avenue. Lots 1 and 2 and the vacated portions of Summit Avenue are
zoned 1 -2, Lot 3 is zoned R -4. The applicant developed the site with the Chem -Way
business under the pretence that the entire property was zoned 1 -2. The purpose of this
request is to clean up the zoning on the parcel to comply with the current use and to
facilitate future redevelopment.
The subject property was subdivided in 1954 as unincorporated county and annexed
into the City in 1962, as R -4. The official 400 - scale, 1968 City Zoning Map depicts the
site as R -4, however, the official 600 - scale, 1968 Zoning Map depicts the current zoning
configuration, Lots 1 -2 are zoned 1 -2 and Lot 3 is zoned R -4. After close examination it
is unclear if either map has been altered to reflect subsequent zoning changes on this
parcel. No zoning cases have been found for the subject parcel, however a 1972
rezoning of Lots 4 -7, Eilers Addition was found. The 1972 rezoning application requests
a zone change from R -4 to 1 -2, and states that the majority of the surrounding properties
are 1 -2. The application specifically states that Lots 1 -2, Eilers Addition are zoned 1 -2,
but does not reference Lot 3. This parcel has an incomplete zoning history. The
applicant would like to clean up the zoning on the parcel to an 1 -2, Light Industrial
District, which conforms to the Comprehensive Plan.
