AN ORDINANCE VACATING A 90 SQUARE FOOT PORTION
OF THE 15 -FOOT PUBLIC INGRESS /EGRESS EASEMENT
LOCATED AT 4790 EAGLERIDGE CIRCLE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described Ingress /Egress Easements within the Village Inn
Subdivision
TWO EASEMENTS LOCATED IN THE NORTHEAST PORTION OF LOT 1, BLOCK 1,
VILLAGE INN SUBDIVISION, RECORDED AT RECEPTION NO 1293897 OF THE
RECORDS OF PUEBLO COUNTY, STATE OF COLORADO, BEING WITHIN A PORTION
OF THE SOUTHWEST QUARTER OF SECTION 12, TOWNSHIP 20 SOUTH, RANGE 65
WEST OF THE 6TH P M , AND BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS
BASIS OF BEARINGS A COURSE ON THE SOUTHEASTERLY BOUNDARY LINE OF
THE EASTERLY PORTION OF SAID LOT 1, ASSUMED TO BEAR S62 °01'14 "W A

SECTION 2.
The vacation is approved with the condition that the signage for the Hampton Inn will
be restricted to a single pole, freestanding sign to prevent view obstructions for vehicles
leaving the site
SECTION 3.
This Ordinance shall become effective immediately upon final passage and
approval

PUBLIC INGRESS /EGRESS EASEMENT LOCATED AT 4790 EAGLERIDGE CIRCLE
ISSUE
Shall City Council approve a request to vacate a 90 square foot portion of the 15 -foot
Public Ingress /Egress Easement to allow signage for the proposed Hampton Inn and
Suites?
The Planning and Zoning Commission, at their October 14, 2009 Regular Meeting,
voted 6 -0 to recommend approval with the following condition:
The signage for the Hampton Inn will be restricted to a single pole, freestanding sign to
prevent view obstructions for vehicles leaving the site.
BACKGROUND
The subject site was resubdivided in 1999 as the Village Inn Subdivision. Lot 1 was
platted as a 2.44 -acre lot with a 15 -foot wide flag -pole frontage along Eagleridge Circle.
The entire width of the flagpole is dedicated for public use as an Ingress /Egress
Easement. As platted, accommodations have not been provided for business signage
along the right of way. Because of this, the applicant is requesting to vacate a 90-
square -foot portion of the easement to place a Hampton Inn and Suites freestanding
sign along Eagleridge Circle. The easement vacation will facilitate appropriate
identification and way- finding signage for the hotel chain.
