HomeMy WebLinkAbout08115ORDINANCE NO. 8115 AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO BICYCLE PARKING AND PEDESTRIAN CIRCULATION REQUIREMENTS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: (Brackets indicate matter being deleted; underscoring indicates matter added.) SECTION 1. Section 17 -4 -43 of Chapter 4, Title XVI I of the Pueblo Municipal Codes, as amended, is hereby amended by the addition of a new subsection (c) thereto to read as follows: Sec. 17 -4-43 Off - street parking nonresidential. (c) Required number of bicycle parking spaces. (1) Bicycle parking shall be provided for industrial, institutional, commercial and multi - family zone districts. For automobile parking areas providing forty (40) or more parking spaces, a minimum number of bicycle parking spaces equivalent to five percent (5 %) of the total number of automobile parking spaces shall be provided. Parking areas with fewer than forty (40) automobile parking spaces will be encouraged but not required to provide bicycle parking. SECTION 2. Section 17 -4 -44 of Chapter 4, Title XVII of the Pueblo Municipal Codes, as amended, is hereby amended by the addition of new subsections (q), (r), and (s) thereto to read as follows: Sec. 17 -4-44. Off - street parking general requirements. (q) Primary Pedestrian Connection. At least one (1) ADA accessible route shall be provided within the boundary of the site to the accessible building entrance from the following: public transportation stops if provided, accessible parking spaces, passenger loading zones if provided, and public sidewalks. (1) Accessible routes, no fewer than five (5) feet in width, shall be vertically separated from the vehicular drive aisle by a minimum of six 6 inches. (2) Accessible routes may use parking lot landscape areas at the discretion of the Land Use Administrator. (3) Lots with multiple frontages shall provide at least one (1) sidewalk connection to the street frontage where the main entrance faces. If the main entrances does not face a public or private roadway the sidewalk connection shall be made to either roadway (r) Bicycle Parking. Bicycle parking facilities shall include provisions to store and lock bicycles, either in lockers or secure racks, or an equivalent installation for the user to lock the bicycle frame or wheels. (1) Bicycle parking areas shall be located in a highly visible area without interfering with pedestrian traffic. (2) Bicycle parking areas may also be located in landscape areas not to exceed 40 square feet. (3) The ground surface surrounding and beneath the bicycle storage facility shall be surfaced to prevent accumulation of mud and dust. Surfaces may include but are not limited to, pavers, grass, gravel or concrete. (4) Trees, fences, light poles, benches, public art and other outdoor furnishing or improvements shall not be used as designated bicycle parking facilities. (5) Bicycle parking areas shall be provided on the same lot or parcel they serve. SECTION 3. This Ordinance, and the amendments made herein to Title XVII of the Pueblo Municipal Code shall be subject to administration and enforcement in accordance with Chapter 5 and 7 of the Title XVII, Pueblo Municipal Code, as amended. Any person who violates any provision of this Ordinance or the amendments made herein to Title XVII of the Pueblo Municipal Code shall be guilty of a municipal offense and subject to the punishment and all other remedies as provided in Chapter 7 of Title XVII of the Pueblo Municipal Code, as amended. SECTION 4. This Ordinance shall become effective upon final passage and approval. PACHECO, DIRECTOR TITLE AN ORDINANCE AMENDING CHAPTER 4 OF TITLE XVII OF THE PUEBLO MUNICIPAL CODE RELATING TO BICYCLE PARKING AND PEDESTRIAN CIRCULATION REQUIREMENTS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF ISSUE Should the City Council amend Chapter 4 of Title XVII of the Pueblo Municipal Code relating to bicycle parking and pedestrian circulation? RECOMMENDATION The Planning and Zoning Commission, at their October 14, 2009 Regular Meeting, voted 6 -0 to recommend approval. BACKGROUND The proposed Ordinance is being requested by the Pueblo Active Community Environments (PACE) as a way to promote active lifestyles in Pueblo and to increase the overall health of the citizens. This amendment will coincide with federal ADA regulations and with other Colorado communities. FINANCIAL IMPACT None.
