AN ORDINANCE APPROVING A TRANSPORTATION
ENHANCEMENT CONTRACT, ES2 CO20 -033, (17349)
BETWEEN THE COLORADO DEPARTMENT OF
TRANSPORTATION AND THE CITY OF PUEBLO, A
MUNICIPAL CORPORATION, AUTHORIZING THE
PRESIDENT OF CITY COUNCIL TO EXECUTE SAME,
ESTABLISHING CAPITAL PROJECT NO. ARPL02,
EASTERN GATEWAY LANDSCAPE PROJECT,
BUDGETING AND APPROPRIATING FUNDS IN THE
AMOUNT OF $437,424 AND AUTHORIZING THE
TRANSFER OF THE LOCAL MATCH THEREFORE
WHEREAS, State Of Colorado, Department Of Transportation, Has Offered
Funds through Contract ES2 CO20 -033 (17349) — Eastern Gateway Landscape Project;
WHEREAS, this agreement is wholly funded in the amount of $381,424 by the
American Recovery and Reinvestment Act (ARRA) funding received by the Federal
Government;
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Contract between Pueblo, a Municipal Corporation, and the State of
Colorado, for the use and benefit of the State Department of Transportation for
Transportation Enhancement Project ES2 CO20 -033, (17349) hereinafter referred to as
the "Contract'), a copy of which is on file in the office of the City Clerk, having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
Funds in the amount of $437,424 are hereby budgeted and appropriated for the
Eastern Gateway Landscape Project, ARPL02. Local match in the amount of $56,000
are hereby transferred from CP0701 to ARPL02.

ISSUE
Should City Council approve a Transportation Enhancement Contract between the
Colorado Department of Transportation and the City of Pueblo, authorize the President
of City Council to execute same, establish capital project No. ARPL02, Eastern
Gateway Landscape Project, budget and appropriate the funds in the amount of
$437,424 and authorize the transfer the local match therefore?
RECOMMENDATION
Approval of the Ordinance.
BACKGROUND
The City of Pueblo has been awarded a grant from the Colorado Department of
Transportation with federal funds from the American Recovery and Reinvestment Act
(ARRA) for the Eastern Gateway Landscape Project. The project is located at the
intersection of SHSO Bypass /SH47 /SH96 at the eastern City limit. The project will
landscape CDOT right of way in the interior four quadrants of the interchange. The
scope of work includes the installation of an irrigation system, grading, western
landscape grasses, plants and trees. The area is approximately 10 acres. The City has
obtained a Special Use Permit for the landscaping on CDOT right -of -way. The City's
Streets Department is currently responsible for the maintenance of the interchange.
The City has completed the perimeter tree planting project involving planting of 342
trees and an irrigation system.

The Planning and Public Works Departments is performing the design and construction
management. Due to federal funding and the use of American Recovery and
Reinvestment Act funds the final contract between CDOT and the City of Pueblo will be
signed after construction drawings are approved by mid - November. The Federal
Government requires this project to be "shovel ready" and a construction contract be
awarded by December 31, 2009. Construction is anticipated to start in March of 2010 to
avoid impacts from winter weather conditions.
Protect Funding Breakdown:
Federal Funds (ARRA) $381,424
Local Agency Match $ 56,000
Total Budget $437,424
FINANCIAL IMPACT
Funds in the amount of $437,424 shall be budgeted and appropriated for the Eastern
Gateway Landscape Project, ARPL02. Funds in the amount of $56,000 required as
local match are hereby transferred from the Citywide Aesthetic Improvement Fund,
CP0701 to ARPL02. Design and construction administration shall be performed in-
house.
Additional maintenance funds are required for the mowing, tree /shrub /perennial care
and irrigation.
