AP0804, RUNWAY 8L/26R REHABILITATION, INCREASING THE PROJECT FUNDING AMOUNT TO $5,466,123 AND TRANSFERRING $5,332 FROM THE 2009 AIRPORT OPERATING BUDGET TO CAPITAL PROJECT NO. AP0804 WHEREAS, the City of Pueblo accepted Federal Aviation Administration Grant Contract No. DOT- FA08NM -1098 on July 28, 2008; and WHEREAS, the Federal Aviation Administration has issued Letter Amendment No. Two to the Grant Contract increasing the maximum obligation of the United States by $101,307; and WHEREAS, the City of Pueblo is required to match the increased funding with $5,332; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Letter Amendment No. 2 is hereby approved and accepted. Funds in the amount of $106,639 are hereby budgeted and appropriated to Capital Project No. AP0804, Runway 8L/26R Rehabilitation and the project funding amount is hereby increased to $5,466,123. SECTION 2. The City matching funds in the amount of $5,332 are hereby transferred from previously appropriated funds in the 2009 Airport Operating Budget to Capital Project No. AP0804. AP0804 ISSUE Should City Council approve an ordinance related to increasing the funding amount in Capital Project No. AP0804 due to increased grant funds. RECOMMENDATION Approval of this Ordinance. BACKGROUND The City accepted a Federal Grant on July 28, 2008 to Rehabilitate Runway 8L/26R, Phase II; Construct New Training Runway, Phase I (Conduct Environmental Assessment); and Enhance the Runway 8R/26L Safety Areas (signs and markings). The signs and markings portion of the project has been completed but the final costs were higher than anticipated. The FAA has issued Letter Amendment No. Two to increase the grant by $101,307 (total grant obligation is now $5,192,817). The FAA grant is 95% of the project funds. The State issued a grant in 2008 to fund 2.5% of the project but they have not issued an amendment to cover the increase in FAA funding. However, they have verbally indicated their willingness to cover the increase at the end of the project. Therefore, we are requesting the full 5% match be taken from the 2009 Airport Operating Budget and transferred to the project. FINANCIAL IMPACT The City will receive $101,307 in funds from the FAA and the City's matching funds will need to be increased by $5,332. City matching funds will be transferred to Capital Project AP0804 from the 2009 Airport Operating Budget. This letter, together with your letter, effects the amendment, as requested, and commits the Federal Aviation Administration, acting for and on behalf of the United States of America, to increase the maximum obligation of the United States by $101,307 (from $5,091,510 to $5,192,817) to cover the Federal share of the total actual eligible and allowable project costs of the above referenced Grant Agreement. Under the terms of the Grant Agreement, this document is incorporated into and constitutes Amendment No. Two to the above referenced Grant Agreement.
