PRIVATE SANITARY SEWER EASEMENT: THE SOUTHERN 20 FEET OF LOTS 2 AND 9 AND THE EASTERN 10' OF LOT 2 AND THE EASTERN 10' OF LOT 1 PROLONGED TO THE NORTH TO THE SOUTHERN LOT LINE OF LOT 4. are hereby vacated. ELIZABETH STREET ISSUE Shall City Council approve a request to vacate the entire 10 -foot Public Utility Easement and the 20 -foot Private Sanitary Sewer Easement to facilitate resubdivision of the project site into one large lot negating the need for internal utility and sewer easements? The Planning and Zoning Commission, at their July 8, 2009 Regular Meeting, voted 7 -0 to recommend approval. BACKGROUND The project site was subdivided in 1978 into nine lots intended for commercial development. However, the property was never converted from a Mobile Home Park that existed since the 1950s into the nine lot, commercial area. The Public Utility Easement and Private Sanitary Sewer Easement were created to service Lots 1 -3 and 7 -9. The applicant is proposing to resubdivide the project site into one large lot negating the need for internal utility and sewer easements. Utility services for the site will be provided from the North Elizabeth Street right -of -way. FINANCIAL IMPACT None.
