The following described public utility and ingress /egress easements: All public utility and ingress /egress easements within Parcel A of Candlewood Court Subdivision are hereby vacated. SECTION 2. PACHECO, DIRECTOR TITLE AN ORDINANCE VACATING ALL OF THE PUBLIC UTILITY AND INGRESS /EGRESS EASEMENTS WITHIN PARCEL A OF THE CANDLEWOOD COURT SUBDIVISION ISSUE Shall City Council approve vacating the public utility and ingress /egress easements located within Parcel A of the Candlewood Court Subdivision to facilitate resubdivision of the property for Candlewood Court Subdivision, Filing No. 2? RECOMMENDATION The Planning and Zoning Commission, at their November 12, 2008, Regular Meeting voted 5 -0 to recommend approval. BACKGROUND The applicant wishes to vacate all of Parcel A to facilitate Candlewood Subdivision, Filing No. 2. As platted, the entire portion of Parcel A may be used for public ingress /egress and utilities; therefore it must be vacated in order to resubdivide. The second filing will include a blanket ingress /egress and public utility easement provision similar to the original subdivision. FINANCIAL IMPACT None.
