AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A
GRANT AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE U.S.
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD)
CONCERNING THE YEAR 2009 AMERICAN RECOVERY AND REINVESTMENT
ACT HOMELESSNESS PREVENTION AND RAPID RE- HOUSING PROGRAM
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Grant Agreement between the U S Department of Housing and Urban Development "HUD" and
the City of Pueblo, which is identified as Grant Number S- 09 -MY -08 -0006 for the Homelessness Prevention
and Rapid Re- Housing Program, copies of which are attached hereto, are hereby approved.
SECTION 2.
The President of the City Council is hereby authorized and directed to execute said Grant Agreement in
the name of the City and the City Clerk is hereby authorized and directed to affix the official seal of the City of
Pueblo and attest to same.
SECTION 3.
The City Manager, or his duly authorized representatives, and other officials of the City are hereby
authorized and directed to do all things required in order to obtain payments under the Grant Agreement,
including, but not limited to, making required certifications, submitting requests for payment, contracting, on
behalf of the City, with persons and organizations in order to carry out the provisions of the Grant Agreement,
filing reports and keeping records relating to fiscal, performance and evaluation matters, and submitting other
materials, as required to HUD.

The payments made by HUD to the City pursuant to and under the Grant Agreement shall be transmitted
to the Finance Department of the City and credited to Special Fund No. 240 for the Homelessness Prevention
and Rapid Re- Housing Program.

DEVELOPMENT (HUD) CONCERNING THE YEAR 2009 AMERICAN RECOVERY AND
REINVESTMENT ACT HOMELESSNESS PREVENTION AND RAPID RE- HOUSING PROGRAM
ISSUE
Should the City Council approve a grant agreement with HUD for Homelessness Prevention and Rapid Re-
Housing (HPRP) for the purpose of providing rental assistance to those at risk of homelessness.
RECOMMENDATION
Approval of the Ordinance
BACKGROUND
In February of 2009, President Obama, signed the American Recovery and Reinvestment Act and a component
of the Act was the Homelessness Prevention and Rapid Re- housing Program. The Program seeks to prevent
homelessness for those individuals that have been adversely affected by the recent economic crisis. This is not
a program intended for the chronic homeless population, though it does allow for services to that population.
The City submitted the required application to HUD on June 18, 2009. Said application was the "Substantial
Amendment to the Consolidated Plan 2008 Action Plan for the Homelessness Prevention and Rapid Re-
Housing Program" (HPRP), and it incorporated all required certifications and assurances. The Amendment was
approved through Ordinance No. 8015. We received a notice of award and the grant contract on July 21, 2009.
By 2010, 60% of the funding must be spent, with remaining funds to be spent by 2012. The Department of
Housing and Citizen Services has posted on its website a Request for Proposals for a homeless services
provider, as well as sending the RFP to all the members of the Pueblo Continuum of Care. The RFP is due by
August 28, 2009. All contracts must be in place by September 30, 2009, as required by HUD.
FINANCIAL IMPACT
It is anticipated that this is a one -time grant from HUD. The City will receive $678,970 to provide the specified
activities under the grant.

GRANT AGREEMENT
HOMELESSNESS PREVENTION AND RAPID RE- HOUSING PROGRAM
This Grant Agreement is made by and between the U.S. Department of Housing and Urban
Development (HUD) and the city of Pueblo, Colorado (Grantee) for the Homelessness Prevention
and Rapid Re- Housing Program (HPRP) in the amount of $678.970 pursuant to the provisions
under the Homelessness Prevention Fund heading of Division A, Title XII of the American
Recovery and Reinvestment Act of 2009, Public Law 111 -5, 123 Stat. 115 (Feb. 17, 2009)
(Recovery Act). The requirements set forth in the Notice of Allocations, Application Procedures,
and Requirements for Homelessness Prevention and Rapid Re- Housing Program Grantees under
the American Recovery and Reinvestment Act of 2009, dated on March 19, 2009 and as may be
amended (the Notice), the requirements set forth under the Homelessness Prevention Fund heading
of Title Xll, and sections 1512, 1515, and 1553 of the Recovery Act, and the Grantee's
submissions pursuant to the Notice are incorporated as part of this Agreement.
In reliance upon the Grantee's submissions pursuant to the Notice, HUD agrees, upon
execution of this Grant Agreement, to provide the Grantee with the agreed HPRP grant funds. The
Grantee agrees to distribute and use its HPRP grant funds as specified in the submission to HUD
that HUD approved pursuant to the Notice.
The Grantee is responsible for ensuring that each entity that administers all or a portion of
the Grantee's HPRP grant funds or receives all or a portion of the Grantee's HPRP grant funds to
carry out HPRP activities fully complies with the HPRP requirements.
The period of this Grant Agreement begins on the date the HUD official signs this Grant
Agreement (Availability Date) and ends on the date that is three years after the Availability Date.
The Grantee authorizes HUD to increase the amount of HPRP grant funds available to the
Grantee pursuant to this Grant Agreement by execution of an amendment by HUD, without the
Grantee's execution of the amendment or other consent. If the Grantee fails to expend 60 percent
of the grant within 2 years of the Availability Date HUD may, by its execution of an amendment,
deobligate the funds required to be expended without the Grantee's execution of the amendment
or other consent.
The following parties execute this Grant Agreement on the dates set forth below as follows:
