AN ORDINANCE VACATING THE STORM WATER
DETENTION, DRAINAGE AND PRIVATE SANITARY SEWER
EASEMENTS LOCATED IN PARCEL B OF COLLEGE ROAD
SUBDIVISION, 3 RD FILING
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described Storm Water Detention, Drainage and Private Sanitary
Sewer Easements:
All of Easement A (Storm Water Detention Easement) as described in the Easement
Vacation and Easement Dedication Plat recorded October 22, 1998 under Reception
No. 1244877 of the Pueblo County Records.
2. All of Easement B (Storm Water Detention Easement) as described in the Easement
Vacation and Easement Dedication Plat recorded October 22, 1998 under Reception
No. 1244877 of the Pueblo County Records.
3. All of the (20' Private Sanitary Sewer Easement) described as being the East 20' of
Parcel B of College Road Subdivision 3 rd Filing recorded May 8, 1996 at Reception No.
1120751 of the Pueblo County Records.
4. All of the (20' Drainage Easement) as shown on the Plat of College Road Subdivision
3` Filing recorded May 8, 1996 at Reception No. 1120751 of the Pueblo County
Records. Lying in the South' /2 of said Subdivision.
All of the (20' Private Sanitary Sewer Easement Book 3078 at Page 1), as shown on
the Easement Vacation and Easement Dedication Plat recorded October 22, 1998
under Reception No. 1244877 of the Pueblo County Records.
Except that portion more particularly described as follows:
Beginning at a point on the East line of College Road Subdivision 3` Filing from which
the Northeast corner Bears N 00 37' 00" W a distance of 353.67 Feet;
Thence S 88 25' 00" W a distance of 144.51 Feet;
Thence N 29 39'44" W a distance of 22.66 Feet;
Thence N 88 25'00" E a distance of 155.52 Feet to the East line of said College Road
Subdivision 3` Filing;
Thence S 00 0 37' 00" E along said East line a distance of 20.00 Feet to the Point of
Beginning.
are hereby vacated.
SECTION 2. '
This Ordinance shall become effective immediately upon final passage and
approval.

AN ORDINANCE VACATING THE STORM WATER DETENTION, DRAINAGE AND
PRIVATE SANITARY SEWER EASEMENTS LOCATED IN PARCEL B OF COLLEGE
ROAD SUBDIVISION, 3 RD FILING
ISSUE
Shall City Council approve the proposed vacation of the Storm Water Detention, Drainage and
Private Sanitary Sewer Easements located in Parcel B of College Road Subdivision, 3rd
Filing?
RECOMMENDATION
The Planning and Zoning Commission, at their July 8, 2009 Regular Meeting, voted 7 -0 to
recommend approval.
BACKGROUND
The project site was subdivided in 1996 as part of the College Road Subdivision, 3 Filing.
College Road Subdivision created two parcels, A and B. Parcel A was developed by the U.S.
Postal Service and Parcel B was reserved for future development. The proposed
resubdivision of Parcel B will require the existing easements be reconfigured to accommodate
19 commercial lots and the Crane Ridge Drive right -of -way. New easements for drainage,
detention and public utilities will be dedicated in the proposed College Road Subdivision, 4 th
Filing.

None.
