HomeMy WebLinkAbout10809ORDINANCE NO. 10809 AN ORDINANCE APPROVING A SPECIAL AREA PLAN FOR THE NORTH VISTA HIGHLANDS, FILING NO. 9 WHEREAS, a request for a Special Area Plan for the North Vista Highlands, Filing No. 9, A Special Area Plan, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17-4-29 of the Pueblo Municipal Code, and, WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17-4-29 can and will be met, and, WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for North Visa Highlands, Filing No. 9, A Special Area Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: A parcel of land located in the Northwest one-quarter of Section 8, Township 20 South, Range 64 West of the 6th P.M. in the County of Pueblo and State of Colorado and being more particularly described as follows: All of Lot 1, Block 2, according to the recorded plat of North Vista Highlands, Filing No. 2 as filed for record on August 20, 2021 at Reception No. 2240303 in the office of the Pueblo County Clerk and Recorder. Containing 19.52-acres, more or less. attached hereto, is hereby approved. SECTION 2. The North Vista Highlands, Filing No. 9, A Special Area Plan is approved without conditions. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Action by City Council: Introduced and initial adoption of Ordinance by City Council on September 09, 2024. PREVIOUS COUNCIL ACTION: The applicant is concurrently requesting to vacate a portion of a drainage easement (V- 23-11) located in Lot 1, Block 2, North Vista, Highlands, Filing No. 2 and is also requesting to subdivide 19.52-acres, (S-23-11) into 136 townhome lots and two multifamily residential lots. BACKGROUND: The applicant is requesting to subdivide and establish a Special Area Plan for 19.52- acres to facilitate the development of 136 townhomes and future multifamily residential lots. A Special Area Plan is proposed for this subdivision to allow for the unique development of attached townhomes on individual lots that do not meet the minimum required lot width as prescribed by the North Vista Highlands PUD Development Guide and private streets. Each townhome will be located on an individual lot and will have a two-car garage that is accessed from the private street. The townhome lots will have reduced lot widths, setbacks, and be accessed from private streets. The Subdivision and Special Area Plan also includes two multifamily residential lots, and a park in Planning Area 3 of the North Vista Highlands PUD. The proposed townhome development will be accessed from El Principio Drive and Walking Stick Boulevard. Private streets within the development will provide access to the proposed 136 townhome lots, two multifamily lots, and all parcels within the subdivision. The townhomes will face an internal pedestrian network located within parcels, similar to a as typically found in a green court development. The proposed development will include one small private park (36,388 sq. ft.) located directly adjacent to the neighborhood park dedicated in North Vista Highlands, Filing No. 5. Two guest parking areas, parcels for drainage, detention, and landscaping are also included in the subdivision and special area plan. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their July 10, 2023 Regular Meeting, voted 7- 0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, a Special Area Plan will not be created. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
