AN ORDINANCE VACATING A PORTION OF A DRAINAGE

EASEMENT LOCATED 1315 EAST 7 STREET
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following described portion of street right of way:
LOT 1 EAST SIDE LIBRARY SUBDIVISION ALSO THE ALLEY VACATED BY THE CITY OF
PUEBLO LEGALLY DESCRIBED AS FOLLOWS: A PORTION OF THE SW4 29-20-64 +
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: AN E/W 16.00 FT WIDE ALLEY
BOUND ON THE N SIDE BY LOTS 19 THRU 26 BLK 121 OF FLETCHER HILL ADDITION TO
THE CITY OF PUEBLO, COUNTY OF PUEBLO, STATE OF COLORADO AS RECORDED IN
THE PUEBLO COUNTY RECORDS IN BK 3 PG 26 + BOUND ON THE S SIDE OF LOT 1,
EAST SIDE LIBRARY FORMERLY #04-293-34-014 + 017
is hereby vacated.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall be approved but shall not become effective until the final vacation
plat is recorded in the office of the Pueblo County Clerk and Recorder. If the vacation plat is not
recorded within one (1) year after of this Ordinance, or within any extended period granted by
Ordinance of the City Council, this Ordinance shall automatically be rescinded and repealed
thirty (30) days after written notice of such rescission and repeal is given to the applicant. No
vested rights shall accrue to the subdivision or be acquired until this Ordinance becomes
effective.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
The Pueblo City-County Library District is requesting to vacate 3,070 square feet of a
th
drainage easement located at 1315 East 7 Street to facilitate new construction.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The Pueblo City-County Library District is requesting this 3,070 square foot easement
vacation at 1315 East 7th Street, the Lucero Library branch, to facilitate the
construction of a 2,500 square foot addition to the west side of the building. Stormwater
detention on this site has historically been managed with a 514 cubic foot rain garden.
The requested vacation will vacate the northern 70x44 square feet and exclude most of
the rain garden, as its volume will only decrease from 514 cubic feet to 455 cubic feet.
There is also an underdrain flowing towards East 7th Street that will be unaffected by
the easement vacation. The City Stormwater department has approved this request and
stormwater detention.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
There are no financial implications for the City.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance, the drainage easement will remain
which will impede development of the site.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
