PREVIOUS COUNCIL ACTION: None. BACKGROUND: The Pueblo City-County Library District is requesting this 3,070 square foot easement vacation at 1315 East 7th Street, the Lucero Library branch, to facilitate the construction of a 2,500 square foot addition to the west side of the building. Stormwater detention on this site has historically been managed with a 514 cubic foot rain garden. The requested vacation will vacate the northern 70x44 square feet and exclude most of the rain garden, as its volume will only decrease from 514 cubic feet to 455 cubic feet. There is also an underdrain flowing towards East 7th Street that will be unaffected by the easement vacation. The City Stormwater department has approved this request and stormwater detention. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: There are no financial implications for the City. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, the drainage easement will remain which will impede development of the site. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
