HomeMy WebLinkAbout10805ORDINANCE NO. 10805 AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE .48-ACRES OF LAND AT 3002 SOUTH PRAIRIE AVENUE FROM R-2, SINGLE FAMILY RESIDENTIAL ZONE DISTRICT TO I-2, INDUSTRIAL ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-2, Single Family Residential Zone District to I-2, Industrial Zone District: A PARCEL OF LAND IN THE SW 1/4 OF SECTION 14, TOWNSHIP 21 SOUTH, RANGE 65 WEST OF THE 6TH P.M., COUNTY OF PUEBLO, STATE OF COLORADO; BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SW CORNER OF SECTION 14; THENCE EAST 33 FEET; THENCE NORTH 805.97 FEET TO THE POINT OF BEGINNING; THENCE NORTH 100 FEET; THENCE EAST 209 FEET; THENCE SOUTH 100 FEET; THENCE WEST 209 FEET TO THE POINT OF BEGINNING. SECTION 2. As a condition of the approval of this Ordinance, within one year from the approval of the Ordinance, the property owner shall install a minimum, six-foot tall, opaque fence along the entire frontage of the rezoning area, which is adjacent to Prairie Avenue. The gate must also be constructed of the same opaque materials but can be a minimum of five-foot in height. Chain link fencing with attachments is not an acceptable opaque material. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The applicant, Roger Block, is requesting to rezone 3002 South Prairie Avenue from R- 2, Single Family Residential to I-2, Industrial District to allow the existing outdoor storage to continue as a use by right. The Polk reverse directories do not have a record of uses at this address. It appears that 3002 South Prairie was historically included with 3000 South Prairie, which was developed as a single-family residence in 1966 and is listed as a residence in the Polk directories. Both 3000 and 3002 South Prairie were annexed into the city in 1972, as possible non-conforming land uses. The surrounding properties north, east, and south were subdivided in 1976 to facilitate development of warehousing, light industrial and commercial uses, creating a light industrial and business park. Those properties were originally zoned B-3 and the warehousing uses have Special Use Permits. In 2022, the property to the immediate south was rezoned from B-3, Highway and Arterial Business District to BP, Business Park, to facilitate the development of a warehouse use. The land to the west is zoned I-2, Industrial, and contains a mixture of industrial and service uses. The Pueblo Regional Comprehensive Plan, future land use designation, for this property is Light Industrial. Since the site is primarily surrounded by industrial uses and the Comprehensive Plan calls for industrial zoning, the rezone request appears to be appropriate. Future development of structures on the parcel will require subdivision, as the site is not currently subdivided. When any new structures are added to the Property, site and structural improvements will be required to be completed in accordance with the Industrial Zone District Building and Site Design Standards for high visibility industrial areas. Staff recommends as a condition of a rezoning approval that the applicant install a minimum, six-foot tall, opaque fence along the entire frontage of the rezoning area, which is adjacent to Prairie Avenue. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their August 14, 2024 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be rezoned. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
